'AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING CHAPTER 5.16 OF THE
"EL SEGUNDO MUNICIPAL CODE" WHICH SAID
CHAPTER RELATES TO VEHICLES FOR HIRE.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA DOES ORDAIN AS FOLLOWS:
SECTION 1. Chapter 5.16 of the "El Segundo Municipal
Code" is hereby amended by amending Sections 5.16. 220, 5.16. 230,
5. 16. 240, 5. 16. 250, 5. 16. 280, 5. 16. 310, 5. 16. 330 and 5. 16. 340 to
read as follows:
"5.16.220 PERMIT -- DURATION. All permits issued
under the provisions of this chapter shall be for a period not to
exceed one year. All these permits shall expire upon the 31st
day of December of each year at midnight with the exception of
the operation permit which shall remain in effect until revoked
or suspended by the City Council; provided, however, that all
permits issued for street stands, except those issued upon the
written consent of a person operating a hotel which may be re-
newed yearly, shall remain in full force and effect until the
same shall be cancelled, either by the City Council or traffic
authority, or upon the request of the permittee, or the person
who has given the written consent to use the stand has notified
the City Council that the permission has been withdrawn.
"5. 16. 230 OPERATION PERMIT-- REQUIRED - -EX-
CEPTION, It is unlawful for any person to operate or cause to
be operated any of the vehicles defined in Section 5. 16. 010,
without having first obtained a permit from the City Council in
writing so to do as provided in this Chapter; provided, however,
that no such permit shall be required for the operation of any
vehicle which is being operated in accordance with the terms
and conditions of a franchise granted by the City Council to the
operator of the vehicle.
"5.16.240 OPERATION PERMIT -APPLICATION
CONSIDERATION. The City Council, in determining whether or
not public convenience and necessity exists in the case of any
application for the permit required by Section 5.16. 230, may
take into consideration any and all facts and conditions which
the Council may deem pertinent or proper, including, but not
limited to, a consideration of:
(I) The financial responsibility of the applicant;
(2) The effect of the granting of the permit applied for
on the businesses and operations of prior permittees, then
operating;
(3) Whether or not prior permittees, then operating are:
(a) Under efficient management earning a fair and reasonable re- -
turn on their capital devoted to the service; and (b) Under normal
conditions adequately serving the public.
(4) The applicant complies with the minimum
standards as prescribed by the City Council, and other itt-
formation as the traffic authority may require.
"5.16.250 OPERATION PERMIT -INSURANCE.
Before any permit required by Section 5.16. 230 is issued for
any vehicle defined in Section 5.16. 010, the owner shall be re-
quired to file with the City Council, and thereafter keep in full
force and effect, a policy of insurance in such form as the City
Council may deem proper, and executed by an insurance company
approved by the City Council, insuring the public against any loss
or damage that :may result to any person or property from the
operation of the vehicles; provided, that the minimum amount of
recovery in the policy of insurance specified shall not be less
than the following sums;
For the injury to any one person,
or the death of any one person,
in any one accident or occurrence ................ $250,000.00
For the injury to two or more persons,
or the death of two or more persons,
in any one accident or occurrence................ $500,000.00
For the injury or destruction of property
in any one accident ............................. $100, 000. 00
"All liability insurance policies shall bear an endorsement or
shall have attached a rider whereby it is provided that, in the event
of expiration or proposed cancellation of such policies for any rea-
son whatsoever, the City Clerk shall be notified by registered mail
not less than thirty days before expiration or cancellation is effective.
if It is unlawful for any owner to operate or cause to be
operated any vehicle without having a policy as described in this
section in full force and effect at all times during the operation
of the vehicles.
if As an alternative, the owner may file with the City Council
a financial statement together with a certificate of insurance show-
ing, to the City Council's satisfaction, reasonable ability to respond
to all the minimum amount recoveries hereinabove provided to be
insured against.
"5.16.280 PERMIT - LICENSE REGULATIONS. The permit
required by Section 5. 16. 230 shall entitle the holder thereof to ob-
tain a license to engage in the business described in the permit from
the City Council upon the payment of the license fee therefor. The
Director of Finance shall issue to the holder of the permit a license
setting forth the kind of transportation for which the license is issued
and the year when issued. The permit shall be filed with the City
Clerk.
"5.16.310 DRIVER'S PERMIT - APPLICATION. Appli-
cants for the permit to drive any of the vehicles defined in Section
5. 16. 010 shall file with the traffic authority an application upon
forms furnished by the City containing the information required to
meet the minimum standards as prescribed by the City Council, and
other information as the traffic authority may require.
"5.16.330 DRIVER'S PERMIT - ISSUANCE. Application for
a driver's permit shall be processed upon payment to the City of a
processing fee of ten dollars for the first application by any appli-
cant and five dollars for each application for renewal. Each successr
ful applicant shall be issued an identification card which he shall
have in his immediate possession while in charge of or driving a
taxicab.

"5.16.340 STREET STAND OCCUPATION PERMIT -
APPLICATION. The permit authorized by Section 5.16. 350
shall not be granted except upon the written application of the
person desiring a street stand, filed with the traffic authority,
to include the minimum standards as prescribed by the City
Council, and other information as the traffic authority may re-
quire. "
SECTION 2. Chapter 5. 16 of the "E1 Segundo Municipal Code"
is amended by adding Sections 5. 16. 420, 5. 16.430, 5. 16.440 and 5. 16. 450
to read as follows:
"5.16.420 VEHICLE PERMIT -- REQUIRED. No vehicle as
defined by Section 5. 16. 010 shall be operated within the city limits
without a vehicle permit. This permit shall be issued annually upon
completion of the inspection of the vehicle and shall be non - transferable
to any new or replacement vehicle. This permit shall be issued by the
traffic authority.
"5.16.430 VEHICLE PERMIT EXCEPTIONS. Notwithstanding
the provisions of Sections 5. 16.420, 5. 16.440 and 5. 16.450, the
Chief of Police may waive the requirements for a vehicle permit in
the City of E1 Segundo, provided he finds that the vehicle is duly
licensed by another city in the County of Los Angeles and that the
inspection procedure of such other city is adequate to insure the
safety of the vehicle being operated in the City of El Segundo. The
Chief of Police may prescribe an annual fee for such waiver which
said fee shall be paid to the City Treasurer.
"5.16.440 VEHICLE PERMIT -- APPLICATION. Applicants
for a vehicle permit shall file with the traffic authority an applica-
tion upon forms furnished oy the City, containing the information
prescribed by the City Council, and other information as the traffic
authority may require.
"5.16.450 VEHICLE PERMIT -- ISSUANCE. Application for
a vehicle permit shall be processed upon payment to the City of a
$5. 00 annual inspection fee. Each applicant shall be issued a vehi-
cle permit upon successful completion of an inspection of the vehi-
cle. The permit shall be posted in a conspicuous place within the
vehicle. "
SECTION 3. This ordinance shall become effective at midnight
on the thirtieth day from and after the date of the final passage and adoption
thereof.
SECTION 4. The City Clerk shall certify to the passage and
adoption of this ordinance; shall cause the same to be entered in the book of
original ordinances of said city; shall make a minute of the passage and adop-
tion thereof in the records of the meeting at which the same is passed and
adopted; and shall within fifteen days after the passage and adoption thereof,
cause the same to be published once in the E1 Segundo Herald a weekly news-
paper of general circulation, published and circulated within said City of
