ORDINANCE 795ORDINANCE NO. 795 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTER 5.08 OF THE "EL SEGUNDO MUNICIPAL CODE" WHICH SAID CHAPTER RELATES TO BUSINESS LICENSES. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Sections5. 08. 230, 5. 08. 235 and 5. 08. 236 of the "El Segundo Municipal Code" are hereby amended to read as f ollows : "5.08.230 COIN - OPERATED DEVICES -- MERCHANDISE AND SERVICES. Except for coin - operated devices regulated by Sections 16002. 2 and 16002. 5 of the Business and Professions Code, for conducting the business of placing, maintaining and operating or offering for operation vending machines or vending devices, vending or delivering merchandise of any character or providing a service, which for the coin or coins inserted, delivers merchandise or provides a service, the license fees shall be as follows: 1) For a machine operated by a one cent coin, one dollar per year; 2) For a machine operated by a coin or coins totaling two cents and not exceeding five cents, two dollars per year; 3) For a machine operated by a coin or coins totaling six cents and not exceeding ten cents, four dollars per year; 4) For a machine operated by a coin or coins totaling eleven cents and not exceeding fifteen cents, six dollars per year; 5) For a machine operated by a coin or coins totaling sixteen cents and not exceeding twenty -five cents, ten dollars per year; 6) For a machine operated by a coin or coins totaling twenty -six cents or more, sixteen dollars per year. "5.08.235 COIN - OPERATED DEVICES -- TAX REGULATED BY STATE LAW. The tax for automatic laundry and dry cleaning and for the privilege of renting, leasing or operating coin - operated vending machines by an individual or firm whose business is limited exclusively to the renting, leasing or operating of such machines, shall be one percent of the gross receipts of such operation actually derived from the conduct of business within this city; the tax shall be paid upon an estimate of the gross receipts but the estimate shall be not less than the gross receipts for the previous year and within thirty days after going out of business or thirty days of the end of the fiscal year, licensee shall file a statement showing his true gross receipts and if such gross receipts exceed the estimate, shall pay to the city the difference, if the gross receipts are less than the estimate, no refund shall be made but a credit shall be allowed on the following year's tax to the same taxpayer, provided however that the business license fee required by this section shall be not less than ten dollars per annum. This section shall not apply to coin - operated laundry equipment owned and operated by a retail establishment providing coin - operated laundry equipment for general public use. "5.08.236 COIN - OPERATED DEVICES -- AUTOMATIC LAUNDRY AND DRY CLEANING. The tax for automatic laundry and dry cleaning establishments not regulated by Section 16002. 2 of the Business and Professions Code shall be one dollar per year per machine. Said tax shall be in lieu of the tax set forth in Sections 5. 08. 230 and 5. 08. 235. " SECTION 2. That this ordinance shall become effective at midnight on the thirtieth day from and after the final passage and adop- tion thereof. SECTION 3. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minutes of the pass- age and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circu- lated within said City of El Segundo and which is hereby designated for that purpose.
