ORDINANCE 786ORDINANCE NO. 786 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING CHAPTERS 16.04 (THE BUILDING CODE), 16.08 (THE ELECTRICAL CODE), 16.12 (THE PLUMBING CODE) AND 16.16 (THE MECHANICAL CODE) OF THE "EL SEGUNDO MUNI- CIPAL CODE" RELATING TO REFUND OF FEES. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 16. 04. 07 5 is added to the "E1 Segundo Municipal Code" to read as follows: "16.04.075 SECTION 303(d) ADDED -- REFUNDS. Section 303(d) is added to read as follows: "(d) Refunds. In the event any person shall have obtain- ed a building permit and no portion of the work or construction covered by such permit shall have been commenced, and such permit shall have been cancelled as provided for in subsection (d) of Section 302, or in the further event there has been a sur- render of said permit because of the abandonment of the con- templated project with no portion of the work or construction covered by the permit issued by the Building Official under the provisions of this Code having been commenced, the person to whom such permit has been issued may deliver such permit to the Building Official with a written request that such permit be cancelled. The Building Official shall thereupon stamp or write on the face of such permit the words 'Cancelled at the request of the permittee', or as in the first part, 'Expired by time limitation'. Thereupon such permit shall be null and void and of no effect. Upon such presentation to said Building Official of a written request for refund, the permittee shall be entitled to a refund of eighty percent of the building permit fee actually paid. When such refund is granted, a subsequent reapplication for the same project will require the payment of a full plan check- ing and building permit fte. "The Building Official, upon verifying that no work involving city inspections has been done, shall approve such claim to be paid as provided by law for the payment of claims against the City. "Eighty percent of the plan check fee may be refunded only if such plans have not been checked. " SECTION 2. Section 16. 08.205 is added to the "E1 Segundo Municipal Code" to read as follows: "16. 08.205 FEES -- REFUNDS. In the event any person shall have obtained an electrical permit and no portion of the work or construction covered by such permit shall have been commenced, and such permit is surrendered, or in the further event there has been a surrender of said permit because of the abandonment of the contemplated project with no portion of the work or construction covered by the permit issued by the Build- ing Official under the provisions of this Code having been com- "menced, the person to whom such permit has been issued may deliver such permit to the Building Official with a written re- quest that such permit be cancelled. The Building Official shall thereupon stamp or write on the face of such permit the words 'Cancelled at the request of the permittee', or 'Expired by time limitation'. Thereupon such permit shall be null and void and of no effect. Section 16. 12.115 is added to the "El Segundo Municipal Code" to read as follows: "16.12.115 SECTION 1. 12 AMENDED -- SCHEDULE OF FEES. Section 1. 12 Schedule of Fees on Page 6a is amended by adding a paragraph to the end thereof to read as follows: "Refunds. In the event any person shall have obtained a plumbing permit and no portion of the work or construction covered by such permit shall have been commenced, and such permit is surrendered, or in the further event there has been a surrender of said permit because of the abandonment of the contemplated project with no portion of the work or construc- tion covered by the permit issued by the Building Official under the provisions of this Code having been commenced, the person to whom such permit has been issued may deliver such permit to the Building Official with a written request that such permit be cancelled. The Building Official shall thereupon stamp or write on the face of such permit the words 'Cancelled at the re- quest of the permittee', or 'Expired by time limitation'. There- upon such permit shall be null and void and of no effect. "Eighty percent of the plan check fee may be refunded only if such plans have not been checked. " SECTION 4. Section 16. 16.045 is added to the "E1 Segundo Municipal Code" to read as follows: "16.16.045 SECTION 304 AMENDED -- PERMIT FEES. Sec- tion 304 Permit Fees on Pages 18 and 19 is amended by adding a &a "paragraph to the end thereof to read as follows: "Refunds. In the event any person shall have obtained a mechani— 'carpermit and no portion of the work or construc- tion covered by such permit shall have been commenced, and such permit is surrendered, or in the further event there has been a surrender of said permit because of the abandonment of the contemplated project with no portion of the work or con- struction covered by the permit issued by the Building Official under the provisions of this Code having been commenced, the person to whom such permit has been issued may deliver such permit to the Building Official with a written request that such permit be cancelled. The Building Official shall thereupon stamp or write on the face of such permit the words 'Cancelled at the request of the permittee'slor 'Expired by time limitation'. Thereupon such permit shall be null and void and of no effect. Upon such presentation to said Building Official of a written re- quest for refund, the permittee shall be entitled to a refund of eighty percent of the mechanical permit fee actually paid. When such refund is granted, a subsequent reapplication for the same project will require the payment of a full plan checking and mechanical permit fee. "Eighty percent of the plan check fee may be refunded only if such plans have not been checked. " SECTION 5. That this ordinance shall become effective at mid- night on the thirtieth day from and after the final passage and adoption there- of. SECTION 6. That the City Clerk shall certify to the passage and adoption of this Ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption there- of, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo, and which is hereby designated for that purpose.
