ORDINANCE 751Ll �4 ORDINANCE NO. 751 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 5 OF THE "EL SEGUNDO MUNICIPAL CODE" WHICH SAID TITLE RELATES TO BUSINESS LICENSES. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 5.04. 085, 5. 08.185 and 5. 08. 525 are added to the "El Segundo Municipal Code" to read as follows: "5.04.085. EXEMPTION STATEMENT -- INTERSTATE COMMERCE. Each person claiming exemption from payment of any license fee provided for in this Title upon the grounds that the imposition of such fee casts an undue burden upon his right to engage in commerce with foreign nations, or among the several states, or conflicts with the regulation of Interstate Com- merce by the United States of America, shall file a verified state- ment with the Director of Finance of the City, disclosing the inter- state or other character of his business entitling him to such exemp- tion. Such statement shall include the name and location of the per- son for whom the orders are to be solicited or secured, the name of the nearest local or State manager, if any, and his address; the kind of goods, wares, merchandise or services to be delivered or performed; the place from which the same are to be shipped or for- warded or the services performed; the method of solicitation or of taking orders; the location of any warehouse, factory, or plant with- in the State; the method of delivery; the applicant's residence, or any other facts necessary to establish such claim of exemption. The applicant shall also be required to furnish his fingerprints and thumb- prints. A copy of the order blank, contract form or other papers used by such person in taking orders shall be attached to the affida- vit. An application for exemption of license fee shall be filed with the Director of Finance and the applicant shall pay a fee of $10. 00 for processing the application. If the application is approved by the Director of Finance a Certificate of Exemption will be issued. The applicant shall not conduct any business prior to the issuance of this Certificate of Exemption. "5.08.185. BRANCH ESTABLISHMENTS. On and after Janu- ary 1, 1972, a location license is required for each location of each branch establishment or separate place of business. The license shall identify the type of business at each location. Two or more types of businesses at the same location, or at different locations, owned by the same person, shall pay one fee calculated under the schedule that applies to that type of business, plus five dollars for each additional branch or location. "5.08.525. MOTION PICTURE OR TELEVISION--COMMER- CIAL USE. For motion picture or television production not opera- ting from a fixed place of business in the City, using either public or private property, a license fee of twenty -five dollars per day shall be paid.' SECTION 2. That Section 5. 08. 571 of the "E1 Segundo Municipal . Code" is amended to read as follows: "5.08.571. PROFESSIONAL SERVICES SPECIAL RULES 1971. For the period commencing January 1, 1971 and ending December 31, 1971, Section 5. 08. 570 shall be con- strued to provide a maximum annual license fee for professional services of twenty -four dollars per year. " SECTION 3. That this ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 4. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circu- lated within said City of El Segundo, and which is hereby designated for that purpose.
