ORDINANCE 733441% ORDINANCE NO. 733 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING TITLE 8 OF THE "EL SEGUNDO MUNICIPAL CODE ", RELATING TO ANIMALS. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 8. 04. 20 of Chapter 8. 04 of Title 8 of the "E1 Segundo Municipal Code" is hereby amended to read as follows: "8.04.020 EXPENSE OF ESTABLISHING AND MAINTAINING. All expenses of keeping, maintaining and establishing the public pound, unless otherwise pro- vided for in the contract referred to in Section 8. 04. 040 shall be paid by the city. All claims therefor, unless provided otherwise in such contract shall be presented, allowed and paid as other claims against the city are pre- sented, allowed and paid. (Prior code § 3. 18)." SECTION 2. Chapter 8. 04 of Title 8 of the "E1 Segundo Municipal Code" is hereby amended by repealing Section 8. 04. 050. SECTION 3. Sections 8. 08. 070 and 8. 08. 100 of Chapter 8. 08 of Title 8 of the "E1 Segundo Municipal Code" are hereby amended to read as follows: "8.08.070 DUTIES - -CITY DOG LICENSE COLLEC- TOR. The poundmaster, or city treasurer in the event no other person is acting as poundmaster by appointment or contract as contemplated under this chapter, is hereby declared the city dog license collector and the poundmaster shall, upon the payment of the license fee as contemplated in this title by any owner or person having control or charge of any dog within the city, deliver to the person an appropri- ate tag for which the license fee has been paid and shall also deliver to the person a receipt signed by the poundmaster for a sum of money as has been paid as the license fee. (Prior code § 3. 34). " "8. 08. 100 DUTIES - -FEE COLLECTION. The pound - master shall collect from the owner of all animals and fowl impounded the following fees for impounding and keeping the same: "For every horse, mare, colt, goat, sheep, cow, mule, jack, jenny, ass, bull, ox, steer or calf impounded by him, the sum of ten dollars as an impounding fee and the further sum of two dollars per day for each day the annimal is neces- sarily held in such pound. -1- 4418 "For every dog impounded by him, the sum of five dollars and a further charge of one dollar per day for each day any dog so impounded is necessarily held in the public pound. For all other animals not hereinabove specifically mentioned and all fowl impounded in the public pound, the poundmaster shall collect the sum of two dollars and fifty cents as an impounding fee and in addition thereto the sum of fifty cents per day for each day the animal or fowl is necessarily held in the pound. (Prior code § 3. 37). " SECTION 4. Sections 8. 12. 040, 8. 12. 050, 8. 12. 060, 8.12. 080, 8.12. 090, 8. 12. 110 and 8.12. 120 of Chapter 8. 12 of Title 8 of the "E1 Segundo Municipal Code" are hereby amended to read as follows: "8. 12. 040 LICENSE - -FEES. The license fee for keep- ing and maintaining a dog in the city is hereby fixed in the sum of four dollars per year except for dogs entitled to pay a per- centage of that fee pursuant to Section 38792 of the Government Code of the State of California. (Prior code § 3. 5). "8.12.050 LICENSE - -PLACE OF ISSUANCE. In order to accommodate the public of the city and to expedite the issuance of licenses under this division, the city treasurer is hereby authorized, subject to the general authority of the poundmaster, to issue at the office of the city treasurer in the city hall any license contemplated under this chapter. (Prior code § 3. 6). "8.12.060 LICENSE - -DATE PAYABLE. Any license fee required to be paid by this chapter shall be payable annually in advance on the first day of April of each year, and the license shall expire at midnight on the thirty -first day of March of the succeeding year. Any license fee payable under the provisions of this chapter remaining unpaid for a period of thirty days after the same shall become payable hereunder shall be subject to a penalty of one dollar, which penalty shall be collected by the license collector at the time of the collection of the license fee, and shall be in addition to the principal sum thereof. In determining whether or not a penalty has accrued under the pro- visions of this chapter, the license collector may require an affidavit from any person claiming exemption from the payment of any penalty hereunder, which affidavit shall set forth the facts upon which the claim for the exemption is based. (Prior code § 3. 7). "8. 12. 080 LICENSE TAG -- CONTENTS. The city shall each year, procure a sufficient number of suitable metallic license tags to meet the requirements of this chapter, numbered from one upward consecutively, on which tags shall be stamped the date of their expiration and the license number, and shall issue the same to the poundmaster in consecutive order as may be required, keeping an account thereof. (Prior code § 3. 9). "8. 12. 090 TAG -- DUPLICATE. A charge of one dollar shall be made for the issuance of a license and metallic tag to replace a lost license or tag. (Prior code § 3. 10). "8. 12. 110 TAG -- RECEIPT BLANKS. The city shall cause to be printed a sufficient number of receipt blanks to meet the -2- 44t9 "requirements of this chapter. The receipt blanks shall pro- vide for the description of the dog for which the license fee is paid, the number of the metallic license tag which has been issued for the dog and also the name and address of the owner of the dog. The receipts shall also designate the rabies vaccina- tion date and tag number and the sex of the dog for which the license fee has been paid. (Prior code § 3. 12). "8. 12. 120 KENNEL LICENSE -- REQUIRED - -FEE. Any person conducting, managing or maintaining a dog kennel as defined in Section 8. 12. 010, shall pay to the city for the privilege of conducting or maintaining the dog kennel a fee of twenty -four dollars per annum for the kennel which shall entitle the kennel operator to maintain ten or fewer dogs. An additional license fee of twenty -four dollars shall be paid for ten dogs, or fraction thereof, in excess of the first ten dogs. (Prior code § 3. 13). SECTION 5. That this ordinance shall become effective at midnight on the thirtieth day from and after the final passage and adoption thereof. SECTION 6. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and cir- culated within said City of El Segundo and which is hereby designated for that purpose.
