ORDINANCE NO.732
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING THE "EL SEGUNDO
MUNICIPAL CODE" BY ADDING SECTIONS
19. 04. 025 AND 19. 04. 045 - DEFINITIONS, AND
BY ADDING CHAPTER 19.40 RELATING TO DIVI-
SION OF LANDS INTO FOUR OR LESS LOTS.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. That Chapter 19. 04 of Title 19 of the "E1 Segundo
Municipal Code" is amended by adding Sections 19. 04. 025 and 19. 04. 045
to read as follows:
"19.04.025 CIRCULATION ELEMENT OF THE GENERAL
PLAN. The Circulation Element means the E1 Segundo street sys-
tem of the City street development adopted by the City Council
May 12, 1969. (Resolution No. 2267)
"19. 04. 045 DIVISION OF LANDS. Division of lands means
the separating of ownership or otherwise dividing of real property
into two, three or four lots or parcels. "
SECTION 2. That Chapter 19. 40, consisting of Sections
19. 40. 010 to 19. 40. 090, both inclusive, is added to Title 19 of the
"E1 Segundo Municipal CodE" to read as follows:
"CHAPTER 19.40
"DIVISION OF LANDS INTO FOUR OR LESS LOTS
"19. 40. 010 INTENT. The division of lands into four or
less lots is intended to assure compliance with the provisions
of thisTitle and Title 20 of this Code and various elements of
the Comprehensive Plan; assure lots of compatible size in
accordance with this Title and Title 20 of this Code; prevent
the creation of new flag lots; and prevent interference with
opening, widening, or extension of streets for proper access
to existing and future developments.
"19. 40. 020 LIMITATIONS. (1) No land shall be separa-
ted in ownership or otherwise divided into four or less lots or
parcels unless approved by the Planning Director. Appeals may
be made in accordance with Section 19. 40. 080.
(2) Except as provided in this Chapter, no building shall
be erected, reconstructed, or structurally altered, nor shall
any building or land be used in violation of the provisions of
this Chapter.
(3) This Chapter shall not apply to the financing or leasing
of apartments, offices, stores, or similar space within apart-
ment buildings, industrial buildings, commercial buildings, or
trailer parks, nor shall this Chapter apply to the following:

A. Subdivisions made in compliance with this Title.
B. Division of lands made in compliance with the applicable
laws of the City and recorded in the office of the County Recorder
prior to May 14, 1954.
C. Division of lands made solely for the purpose of open-
ing, widening, or extension of public streets, alleys, ease-
ments, or other public facilities by governmental agencies.
When such action results in the creation of a substandard
residential lot, the City may permit the property owner to
construct one single - family dwelling on the residential lot,
provided:
i. The residential lot or parcel contains a twenty -five
foot minimum public street frontage and a minimum of twenty -
five hundred square feet of property.
ii. The permitted single - family dwelling shall be com-
patible and not have adverse or detrimental effects on the abutting
or surrounding properties.
"19.40.030 LOT SIZE AND AREA REQUIREMENTS. Divi-
sion of lands into four or less lots pursuant to this Chapter shall
comply with the following schedule:
(1) Residential. A. Every lot or parcel created after
May 14, 1954, shall conform to this Title and provide a minimum
street frontage of fifty feet and a minimum lot area of five thou-
sand square feet.
B. Every lot or parcel created prior to May 14, 1954, and
recorded in the office of the County Recorder shall conform to the
provisions of Section 20. 20. 080 of this Code.
(2) Commercial. Every lot or parcel created after the
effective date of this Chapter shall conform to the provisions of
this Title, and provide a minimum street frontage of fifty feet and
a minimum lot area of five thousand square feet.
(3) Industrial. Every lot or parcel created after the effective
date of this Chapter shall conform to the provisions of this Title,
and provide a minimum street frontage of fifty feet and a minimum .
lot area of five thousand square feet.
"19.40.040 APPLICATION. Every person applying for
approval of a division of lands into four or less lots or parcels
shall file with the Planning Director an application, other neces-
sary information, and an application fee of twenty -five dollars
($25. 00) to cover the cost of examining and processing the appli-
cation.
"19.40.050 DIVISION OF LANDS MAP REQUIREMENTS.
The division of lands map shall show and contain the following
matters or information to aid the Planning Director in his consi-
deration of the design of the division of land, provided, however,
if impossible or impractical to place upon the map information
required, the information shall be furnished in a written statement
and submitted with the map. All applications submitted for a divi-
sion of lands approval shall meet the requirements of the Business
and Professions Code of the State of California, in addition to the
following:

(1) The existing subdivision, lot and block number;
(2) Sufficient legal description of the land so as to define
the boundaries of the proposed division' of lands and each lot;
(3) The location, names and existing widths of all adjoin-
ing highways, streets or alleys;
(4) The widths and approximate grades of highways, streets,
or alleys within the proposed division of lands;
"(5) The widths and approximate locations of all existing
or proposed easements, whether public or private, for roads,
drainage, sewers, or public utility purposes;
(6) Approximate lot layout and dimension of each lot;
(7) Approximate location of all areas subject to inundation
or storm water overflow and the location, width and direction of
flow of all water courses;
(8) Location and size of all existing and proposed utilities
which are to serve the lots;
(9) Date, north point and scale;
(10) Approximate location of each area covered by trees,
location and outline to scale of each building or structure which
is not to be removed in the development of the division of lands;
(11) The names and addresses of all property owners of lots
or parcels immediately adjacent to the division of lands;
(12) When requested by the City Engineer, the applicant shall
furnish the information and data required by Sections 19. 28. 010
through 19. 28. 030 of this Title.
"19.40.060 APPROVAL OF DIVISION OF LANDS. (1) Upon
receipt of the application and accompanying documents the Planning
Director shall forward copies to the respective department heads
and each member of the Planning Commission for their review and
comments. The department heads shall return the application to
the Planning Director within five working days with their comments.
(2) When the Planning Director and the City Engineer deter-
mine the proposed division of lands map complies with all provi-
sions herein and no dedication or improvements are required, the
Planning Director shall approve the map.
(3) When the Planning Director and City Engineer determine
the proposed division of lands map complies with all provisions
herein, but dedication or improvements are required, the Planning
Director shall approve the map when the following conditions are
fulfille d:
A. An offer by the applicant or owner be made to dedicate
the necessary property for the opening, widening, or extension of
streets, alleys, or easements in accordance with Section 19. 08. 020
of this Code. This offer shall be properly executed by all parties
having interest and shall be on a form approved by the City Engineer
and the City Attorney. The offer shall provide that dedication is
completed and recorded in the office of the County Recorder,
Los Angeles, California, before approval of the map by the Planning
Director.

B. That such improvements as required by the City shall be
constructed in accordance with Chapter 19. 32 of this Title.
C. When such improvements as required have been completed
to the satisfaction of the City Engineer and Planning Director, the
applicant shall be so notified that the property may be divided into
four or less lots and considered as separate lots or parcels for the
purpose of securing building permits.
"(4) Approval of the division of lands map for four or less
lots or parcels shall be deemed as final approval and no final map
need be submitted, except in case of numerous changes as required
by the Planning Director, or where, in the opinion of the Planning
Director, the intent is to ultimately subdivide into five or more lots
or parcels.
(5) The approval of a division of lands by the Planning Direc-
tor shall not constitute a waiver of compliance with other applicable
provisions of this Title, nor shall approval authorize a violation or
the failure to comply with other applicable provisions of the law.
"19. 40. 070 DISAPPROVAL. In the event the division of lands
map is disapproved by the Planning Director, the disapproval shall
be in writing setting forth the reasons for such disapproval. Copies
of the Planning Director's findings and decision shall be mailed to
each member of the Planning Commission and to the applicant.
"19. 40. 080 APPEALS. Applicants dissatisfied with the find-
ings and decisions of the Planning Director may appeal to the
Planning Commission, in writing, setting forth the reason for the
appeal. The Planning Commission shall review the application,
map and decision of the Planning Director at its next regular meet-
ing, or at a special meeting called for that purpose.
"The Planning Commission may, after reviewing the applica-
tion, map and decision of the Planning Director, concur with the
Planning Director or it may approve the applicant's division of
lands map with or without imposing conditions of its own.
"The action of the Planning Commission on an application
for a division of lands map shall be by the majority vote of the
members present and shall be final and conclusive.
"The applicant shall pay to the City of E1 Segundo a sum of
twenty -five dollars ($25. 00) for each appeal to cover the cost of
examining and processing the appeal.
"19.40.090 ENFORCEMENT AND PERMITS. To assure
compliance with the regulations of a division of lands into four or
less lots or parcels and other provisions of this Chapter, the Build-
ing and Safety Director shall not issue a building permit on any lot
or parcel not filed and approved in accordance with this Chapter. "
SECTION 3. That this ordinance shall become effective at
midnight on the thirtieth day from and after the final passage and adoption
thereof.
SECTION 4. That the City Clerk shall certify to the passage
and adoption of this ordinance; shall cause the same to be entered in the

book of original ordinances of said city; shall make a minute of the pass-
age and adoption thereof in the records of the meeting at which the same
is passed and adopted; and shall within fifteen days after the passage and
adoption thereof, cause the same to be published once in the El Segundo
Herald, a weekly newspaper of general circulation, published and cir-
culated within said City of El Segundo and which is hereby designated for
that purpose.
