ORDINANCE 695ORDINANCE NO. 695 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING WITH CERTAIN AMENDMENTS AND DELETIONS THAT CERTAIN CODE ENTITLED "INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS UNIFORM PLUMBING CODE, 1967 EDITION." THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. PLUMBING CODE ESTABLISHED. The "International Association of Plumbing and Mechanical Officials Uniform Plumbing Code, 1967 Edition," including Appendices A, B, C, E and F therein contained, promulgated and published by the International Association of Plumbing and Mechanical Officials; three (3) copies of which have been filed and are on file in the office of the City Clerk, for public inspection, hereby are adopted with the same force and effect as though set out herein in full. SECTION 2. CHANGES AND ADDITIONS TO THE UNIFORM PLUMBING CODE. Said Uniform Plumbing Code is amended by changing, adding and deleting the following designated chapters, sections and portions of sections. (A) Section 1.1 is amended to read as follows: "Sec. 1.1 - ADMINISTRATIVE AUTHORITY AND ASSISTANTS. Whenever the term 'administrative authority' is used in this code it shall be construed to mean the Director of Building Safety." (B) Section 1.2 is amended to read as follows: "Sec. 1.2 - ASSISTANTS. Whenever the term 'assistants' is used in this code it shall be construed to mean the assistants of said Director of Building Safety." 43-14 (C) Section 1.3 is amended to read as follows: "Sec. 1.3 - DEPARTMENT HAVING JURISDICTION. Unless otherwise provided for by law, the office of the Administrative Authority shall be a part of the Building Department." (D) Section 1.4 (10) is deleted. (E) Section 1.10 (a) is amended to read as follows: "(a) No permit shall be issued to any person, to do, or cause to be done any plumbing or drainage work regulated by this code except to a person holding a valid, unexpired and unrevoked State Contractor's License covering the work contemplated under the permit applied for and any license required by any Ordinance of this City, except when and as otherwise hereinafter provided in this Section." (F) Section 1.11.1 is added to read as follows: "Sec. 1.11.1 - COMPREHENSIVE PLUMBING PERMIT. Any person regularly employing a state licensed plumbing contractor who has been certified by the Administrative Authority as such, may apply for an Annual Comprehensive Permit for the purpose of installations, alterations, or repairs of plumbing systems or equipment on his own premises. "Application for Annual Comprehensive Plumbing Permits shall be made by completing City forms provided for such purpose. Each application shall recite all conditions under which such permit is granted and shall carry the name of each person who is a certified journeyman plumber. "Holders of Annual Comprehensive Permits are entitled to perform all plumbing work on the premises described in the permit." (G) Section 1.12 Schedule of Fees on Page 6a is amended by adding the following: "Annual Comprehensive Permit $20.00 For each extra inspection resulting from incomplete or defective workmanship or materials, each 5.00 For inspection of plumbing work for which no fee is herein set forth and for emergency inspection for the time con- sumed, per hour 10.00 With a minimum charge for 2 hour or less 5.00" -2- r Sy ►.� (H) Section 1.12 - COST OF PERMIT. The third paragraph is deleted and the following added: "Where work for which a permit is required by this code is started or proceeded with prior to obtaining said permit, a special investigation shall be made before a permit may be issued for such work. In addition to the permit fee, the investigation fee shall be collected. The investigation fee shall be as follows: Permit Fee $10.00 or less More than $10.00 Investigation Fee $ 5.00 $10.00 (I) Sections 2.2 through 2.11, both inclusive, are deleted. (J) Section 301.1 is added to read as follows: "Sec. 301.1 WATER. Swimming of only by means drainage system, obtained from th during the hours follows: - DISPOSAL OF SWIMMING POOL pool water shall be disposed of an approved plumbing and subject to permit first s Director of Public Works and designated in such permit." (K) Section 314 (b) is amended to read as "(b) Existing building sewers and build- ing drains may be used in connection with new buildings or new plumbing and drainage work only when they are found on examination and test to conform in all respects to the require- ments governing new work, except as provided in Table 4 -3, and the proper Administrative Authority shall notify the owner to make any changes necessary to conform to this code. No building or part thereof, shall be erected or placed over any part of a drainage system which is constructed of materials other than those approved elsewhere in this code for use inside of a building." (L) Section 405 (b) is amended to read as follows: "(b) Horizontal drainage lines, connecting with a vertical stack shall enter through forty - five (45) degree "Y" branches, sixty (60) degree -3- 431 "Y" branches, combination "Y" and one - eighth (1/8) bend branches, sanitary tee or sanitary tapped tee branches, or other approved fittings of equivalent sweep. No fitting having more than one (1) branch at the same level shall be used unless such fitting is constructed so that the discharge from any one (1) branch cannot readily enter any other branch." (M) Amend Table 4 -3 by adding to the first paragraph of the three asterisk footnote the following sentence: "Except that an additional six -unit fixture may be added to an existing three inch horizontal line in a single family dwelling." (N) Section 1101 (c) is amended by adding the following: "Such connections shall be made by extending a public sewer so that all buildings served thereby can connect without crossing intervening private property. The public sewer shall be installed at the expense of the benefited property and in accordance with plans and specifications approved by the City Engineer and shall lie in public easements. "EXCEPTION: The requirement for extending a public sewer may be waived if separate house connections to the public sewer are provided for each separate lot or parcel." SECTION 3. SEVERABILITY. If any section, sub- section, sentence, clause, or phrase of this Ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, sub- section, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional. E 43-17 SECTION 4. VIOLATIONS AND PENALTIES. Any person, firm or corporation violating any of the pro- visions of this code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punish- able by a fine of not to exceed $500 or by imprisonment in the City Jail of the City of El Segundo, California, or in the County Jail of the County of Los Angeles, California, for not to exceed six months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of this code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof, shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this code. No permit presuming to give authority to violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorizes is lawful. The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter requiring the correction of errors in said plans and specifications or from preventing construction operations being carried on thereunder when in violation of this code or of any other ordinance or from revoking any Certificate of Approval when issued in error. -5- 4a��4 SECTION 5. EXPIRATION OF PERMIT. Every permit issued by the Administrative Authority under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within sixty (60) days from the date of issuance of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of sixty (60) days. Before such work may be recommenced a new permit shall be first obtained to do so. SECTION 6. REPEALS. Ordinance No. 635 and Ordinance No. 667 and all ordinances amendatory thereto, and all ordinances or parts of ordinances in conflict with this Ordinance, are hereby repealed. SECTION 7. EFFECTIVE DATE. That this Ordinance shall become effective at midnight on the thirtieth day from and after the final passage and adoption thereof. SECTION 8. That the City Clerk shall certify to the passage and adoption of this Ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall within fifteen days after the passage and adoption thereof, cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, WM published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
