ORDINANCE 550ORDINANCE NO. 550 AN ORDINANCE OF THE CITY OF EL SEGUIJDO, CALIFORNIA, PROVIDING FOR THE PURCHASE OF SUPPLIES AND EQUIPIVIENT. THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DOES ORDAIN AS FOLLOWS: SECTION 1. That "Sec. 2.30" of "The Code of the City of El Segundo, California, 195811 shall be, and the same is here- by amended so as to read as follows: "SEC. 2.30. RESPONSIBILITY FOR PURCHASE OF ALL SUPPLIES AND EQUIPIENT. (A). ADOPTION OF PURCHASING SYSTEM. In order to establish efficient procedures for the purchase of supplies and equipment; to secure supplies and equipment for the City at the lowest possible cost commensurate with quality needed; to exer- cise positive financial control over purchases; to clearly de- fine authority for the purchasing function and to assure the quality of purchases; a purchasing system is hereby adopted. (B) PURCHASING OFFICER. Pursuant to the provisions of Sec. 2.30 of the El Segundo City Code, the City Manager shall purchase or cause to be purchased all supplies, equipment and contractural services requisitioned by all City Departments and agencies. Supplies and equipment for all City Departments shall be purchased in accordance with purchasing procedures pre- scribed by this Code, such administrative regulations as the Purchasing Officer shall adopt and such other rules and regu- lations as shall be prescribed by the City Council. (C) REQUISITIONS. All Departments shall submit requisitions for supplies and equipment to the Purchasing Officer. (D) PURCHASE ORDERS. Purchases of supplies and equipment shall be made by purchase order only. (E) EXEMPTIONS FROM CENTRALIZED PURCHASING. The Purchasing Officer with approval of the City Council, may author- ize, in writing, any City Department to purchase or contract for supplies and equipment independently of the Purchasing Officer; but the Purchasin; Officer shall require that such purchases or - 1 - , 7WJ contracts be made in conformity with the procedures established by this ordinance, and shall further require periodic reports from the City Department so authorized, on the purchases and contracts made under such written authorization. (F) CONTRACT PROCEDURE. Except as otherwise pro- vided herein, purchases and contracts for supplies and equip- ment of estimated value greater than 445000 shall be by Purchase Order or written contract with the lowest responsible bidder, pursuant to the procedure prescribed herein. 1. Notice Inviting Bids. Notices inviting bids shall include a general description of the articles to be purchased, shall state where bid blanks and specifications may be secured, the dead line time and place for receiving bids and the time and place for publicly openin bids. a. Circulation of Notice. Notice inviting bids shall be mailed or delivered to not less than three in- dividuals, firms or corporations dealing in the services, com- modities or supplies described in the notice. 2. Bidder's Security. When deemed necessary by the Purchasing Officer, bidder's Security may be prescribed in the notices inviting bids. 3. The Purchasing Officer shall not accept bids after the clsoing date and time set forth in the notice. 4. Bid Opening Procedure. Sealed bids shall be submitted to the Purchasing Officer and shall be identified as bids on the envelope. Bids shall be opened in public at the time and place stated in the notices. A tabulation of all bids received shall be open for public inspection during regular business hours for a period of not less than thirty (30) cal- endar days after the bid opening. 5. Rejection of Bids. In its discretion, the City Council may reject any and all bids presented, and after such rejection may at its discretion request new bids or pur- chase on the open market. - 2 - 3754 5. Performance Bonds. The City Council shall have authcrity to require a performance bond and labor and materials bond before entering into a contract in such amount as it shall find reasonably necessary to protect the best in- terests of the city. If the City Council requires bonds, the form and amount of the bonds shall be described in the notice inviting bids. (G) OPEN MARKET PROCEDURE. Purchases of supplies and equipment of an estimated value in the amount of 95000 or less may be made by the Purchasing Officer in the open market without observing the procedure prescribed by Section (F). 1. Minimum Number of Bids. Open market pur- chases shall, wherever possible, be based on at least three bids, and shall be awarded to the lowest responsible bidder.. 2. Notice Inviting Bids. The Purchasing Officer shall solicit bids by written requests to prospective vendors or by telephone if more expedient. 3. Written Bids. Sealed written bid; shall be submitted to the Purchasing Officer who shall keep a record of all open market orders and bids for a period of one year after the submission of bids or the placing of orders. This record, while so kept, shall be open to public inspection. (H) SUBMI33ION OF BIDS TO COUNCIL. All bids secured under the provisions of Sections (F) and (G) of this Ordinance shall be submitted to the City Council for final approval, rejection or further action. (I) PURCHASES UNDER X500. Purchases of supplies and equipment of an estimated value of Q500.00 or less, may be made by the Purchasing Officer in the open market and without observing the procedures described in Sections (F) and (G). (J) WAIVERS. In its discretion, the City Coun- cil may at any time, by a majority vote and without amending this Code, waive purchasing procedures or alter these proceedings to fit a specific purchase, when such waiver is not in violation of California State Law. - 3 - (I). PURCHASES UNDER x;500. Purchase of supplies and equipment of an estimated value of - ?500.00 or less, may be made by the Purchasing Officer in the open market and without observing the procedures described in Sections (F), (G) or (H). W. VAIVERS. In its discretion, the City Council may at any time, by a majority vote and without amending this Code, waive purchasing procedures or alter these pro- ceedings to fit a specific purchase, when such waiver is not in violation of California State Law. (K). INSPECTION AND TESTING. The Purchasing Officer shall inspect or cause to be inspected, supplies and equipment delivered to determine their conformance with the specifications set forth in the order or contract. SECTION 2. That this ordinance shall become effec- tive at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 3. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of El Segundo and which is hereby designated for the purpose.
