(Sec."' 29.04) =,= The section in the lFir.e Prevention Code which makes reference to the publication." - 11 - SECTION 5. ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION. (1) A Bureau of Fire Prevention in the Fire Department of the City of E1 Segundo is hereby established which shall be oper- ated under the over -all supervision of the Chief of the Fire De- partment. (2) The Fire Marshal of the City of El Segundo shall be Chief of the Bureau of Fire Prevention. (3) The Chief of the Fire Department may detail such other members of the fire department as inspectors as in his opinion may from time to time be necessary. (4) It shall be the duty of the officers and members of the Bureau of Fire Prevention to enforce all laws and ordinances govern- ing or relating to the following: (a) The prevention of fires. (b) The storage and use of explosive inflammables. (c) The installation and maintenance of automatic and other private fire alarm systems and fire extin- guishing equipment. (d) The maintenance and regulation of fire escapes. (e) The maintenance of protection and the elimination of hazards in buildings and structures including those under construction. (f) The means and adequacy of exits in case of fire from factories, schools, hotels, lodging houses, asylums, hospitals, halls, churches, theatres, amphitheatres, and all other places in which num- bers of persons work, live or congregate from time to time for any purpose. (g) The investigation of the cause, origin and cir- cumstances of fire. (h) They shall have such other powers and perform such other duties as are set forth in other sec- tions of this and other ordinances and as may be conferred and imposed from time to time by law. SECTION 6. MODIFICATIONS. The Chief of the Fire De- partment shall have the power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner - 12 - i or lessee or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, pub- lic safety secured, and substantial justice done. The particulars of such modification when granted or allowed and the decision of the Chief of the Fire Department thereon shall be entered upon the records of the Department and a signed copy shall be furnished the applicant. SECTION 7. APPEALS. Whenever the Chief of the Fire De- partment shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the pro- visions of the code do not apply, or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief of the Fire Department to the City Council of the City of El Segundo within the thirty (30) day period following the date of the decision from which the appeal is taken. SECTION 8. NEW MATERIALS, PROCESSES OR OCCUPANCIES WHICH MAY REQUIRE PERMITS. The City Administrative Officer, Chief of the Fire Department, Fire Marshal of the Bureau of Fire Pre- vention, and Chief Building Inspector shall act as a committee to determine and specify after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits in addition to those now enumerated in said code. SECTION 9. NUISANCES. Any violation of the provisions hereof, or any use of property contrary to the provisions of this ordinance shall be and the same is hereby declared to be an un- lawful and a public nuisance, and the city may immediately com- mence action or actions for the abatement, removal and enjoinment thereof in a manner provided by law. If in the opinion of the - 13 - City Attorney, the said nuisance constitutes an immediate threat to the health, safety, morals or general welfare of the people, he may order the summary abatement of said nuisance and institute the proceedings for the recovery of costs incident therewith. Each day that a violation of this ordinance is continued or per- mitted to exist without compliance shall constitute a separate and distinct nuisance. SECTION 10. DEFINITIONS. Whenever the word "municipali- ty" or the word "city" is used in said Fire Prevention Code or in this ordinance, it shall mean and be held to mean the City of E1 Segundo, California. SECTION 11. PENALTIES. That any person, firm, associ- ationcr corporation violating any of the provisions of this ordi- nance or of the Fire Prevention Code adopted thereby shall be guilty of a misdemeanor, and upon conviction of any such violation such person, firm, association or corporation shall be punishable by a fine of not more than $500.00 or by imprisonment in the City Jail of the City of El Segundo, California, or in the County Jail of Los Angeles County, California, as the committing magistrate may direct, for a period of not to exceed six months, or by both such fine and imprisonment in the discretion of the court. Every such person, firm, association or corporation shall be deemed guilty of a separate offense for each and every day during which, or during any portion of which, any of the provisions of this ordinance is violated and shall be punishable therefor as herein provided. SECTION 12. REPEALS. That Ordinances Nos. 338 and 352 of said City and all ordinances amendatory of said Ordinances Nos. 338 and 352 shall be and the same are hereby repealed, as are also all other ordinances and parts of ordinances insofar as such other ordinance or ordinances conflict with the provisions hereof. - 14 - i 4-1�Fd b SECTION 13. EFFECTIVE DATE. That this ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 14. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said city; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
