ORDINANCE 457ORDINANCE NO. 457
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, PROVIDING FOR THE REGISTRA-
TION OF BICYCLES WITHIN SAID CITY AND
PROVIDING PENALTIES FOR VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DOES ORDAIN AS FOLLOWS;
SECTION 1. The term "bicycle" shall mean and include
every device propelled by human power upon which any person may
ride having two (2) or more tandem wheels, any one of which is
twenty (20) inches or over in diameter.
SECTION 2. That it shall be unlawful for any person
to operate or use a bicycle propelled wholly or in part by mus-
cular power upon any of the public streets, alleys or public
highways within the City of E1 Segundo, California, without first
obtaining from the Registrar of Bicycles of the City, a license
therefor.
SECTION 3. That the Chief of Police of said City of
E1 Segundo, shall be, and he is hereby designated and appointed
as the Registrar of Bicycles of, in and for the City of E1 Se-
gundo.
SECTION 4. That the Registrar of Bicycles is hereby
authorized and directed to issue, or cause to be issued, upon
written application, bicycle licenses which shall be effective
for one (1) calendar year, or unexpired portion thereof, but all
such licenses shall be dated January lst of the year of issue,
which license when issued shall entitle the licensee to operate
such bicycle for which such license shall have been issued, upon
all the public streets, alleys, and public highways, exclusive
of the sidewalks thereof, in the said City of E1 Segundo, for the

period covered by such license. A registration fee of fifty cents
(50¢) shall be paid to the Registrar of Bicycles for the regis-
tration or renewal of registration of every bicycle. Every bi-
cycle registration card and license plate issued prior to January
1, 1956, for a period commencing on or after January 1, 1955,
shall expire December 31, 1955• Thereafter, cards and plates
shall be issued for, and shall expire on December 31st of each
year. A registration card and license plate may be renewed upon
expiration. A penalty of fifty cents (50¢) shall be added upon
any application for renewal of registration and license made on
and after March 1, 1956, and March 1st of every year thereafter.
SECTION 5. That the City of E1 Segundo shall provide
for each calendar year metallic (or other suitable material) li-
cense plates and seals, together with registration cards. Siid
metallic license plates and registration cards shall have numbers
stamped thereon in numerical order, beginning with the number "1"
and indicating the year for which the same was issued and the let-
ters WE S" stamped thereon; said plates shall be suitable for at-
tachment upon the frames of bicycles, and it shall be the duty of
the Registrar of Bicycles to attach, or cause to be attached, one
such metallic license plate to the frame of each bicycle and to
issue a corresponding registration card to the licensee upon the
payment of the license fee herein provided for. Such metallic
license plate shall remain attached during the period covered by
such license. Every license plate shall at all times be secure-
ly fastened to the bicycle for which it is issued during the
period for which it is valid and shall be maintained, free from
foreign material, and in a condition to be clearly legible. The
Registrar of Bicycles shall also keep a record of the date of
issue of each license, to whom issued and the number thereon.

SECTI ©N 6. That all persons engaged in the business
of buying second -hand bicycles within said City, are hereby re-
quired to make a daily report to said Registrar of Bicyles on re-
port forms approved by such Registrar, giving the name and address
of the person from whom such bicycle was purchased, the descrip-
tion of such bicycle, the frame number thereof and the number and
symbols of the metallic license plate found thereon, if any. All
persons engaged in the business of selling new and second -hand
bicycles, within said City, are hereby required to make monthly
reports to the Registrar of Bicycles on report forms approved by
such Registrar, giving a list of all sales made by said dealers,
which list shall include the name and address of each person to
whom sold, together with a description of the frame number there-
of, the kind of bicycle sold and the number and symbols of the
metallic plate attached thereto, if any.
SECTI ©N 7. It shall be the duty of every person who
sells or transfers ownership of any bicycle within said City to
report said sale or transfer by returning to the Registrar of
Bicycles the registration card issued to such person as licensee
thereof, together with the name and address of the person to whom
said bicycle was sold or transferred, and such report shall be
made within five (5) days of said sale or transfer. It shall be
the duty of the purchaser or transferee of such bicycle to apply
for a transfer or registration thereof, within five (5) days of
said sale or transfer if such bicycle is purchased or trans-
ferred for use in the City of E1 Segundo.
SECTION 8. That it shall be unlawful for any person
to wilfully or maliciously remove, destroy, mutilate or alter
the number of any bicycle frame licensed pursuant to this ordi-
nance, or to wilfully remove, destroy, mutilate or alter any
license plate or registration card during the time such card is
operative; provided, however, that nothing in this ordinance shall

prohibit the Registrar of Bicycles from stamping numbers on the
frames of bicycles on which no serial number can be found, or on
which said number is illegible or insufficient for purposes of iden-
tification.
SECTION 9. That the annual license fee to be paid for
each bicycle shall be fifty cents (50¢) and shall be paid in ad-
vance, and pursuant to Section 7 of this ordinance, such license
may be transferred and a fee of twenty -five cents (25¢) shall be
paid for the registration of such transfer. All fees collected
under this ordinance shall be paid into the General Fund of the
said City of El Segundo.
SECTION 10. Every person riding a bicycle upon a public
street or highway within said City shall be granted all of the
rights and shall be subject to all of the duties applicable to
the driver of a vehicle as set forth in the California Vehicle
Code, except those provisions which by their very nature can have
no application. No person riding or operating a bicycle upon the
public streets or highways within said City shall carry a rider or
another person on such bicycle.
SECTION 11. It shall be unlawful for any person, or
persons, to ride or operate any bicycle between the hours of dark-
ness and dawn within the City of E1 Segundo, unless there shall
be attached to the rear of said bicycle, in such a position that
it shall clearly reflect lights approaching from the rear of said
bicycle, a red reflector of glass or other suitable red reflect-
ing substance which shall be clearly visible under normal atmos-
pheric conditions from a distance of at least 150 feet when viewed
from the rear of such bicycle, and unless there shall also be af-
fixed to the front of said bicycle a headlight which shall be
visible for at least 150 feet ahead of said bicycle.

SECTION 12. In the event any license plate is stolen,
lost, mutilated or illegible, the owner of the bicycle for which
the same was issued shall immediately make application to the
Registrar of Bicycles for a new license plate, and the said Reg-
istrar shall thereupon issue a new license plate and registra-
tion card bearing a new number and assign such new number to the
bicycle for which issued. A fee of fifty cents (50¢) shall be
charged for such new license plate.
In the event that any registration card is stolen,
lost, mutilated or illegible, the owner of the bicycle for which
the same was issued shall immediately make application to the
Registrar of Bicycles for a duplicate registration card. Upon
satisfactory proof that the original registration card was
stolen, lost, mutilated or illegible and upon the payment of a
fee of twenty -five cents (25¢), the Registrar of Bicycles shall
issue such duplicate registration card.
SECTION 13. The Registrar of Bicycles is hereby author-
ized to impound any bicycle which is being operated contrary to
the provisions of this ordinance and may continue to hold the
same so impounded until the proper license therefor has been ob-
tained or other lawful disposition is made thereof. In case any
bicycle is impounded, the Registrar of Bicycles shall make reason-
able effort to ascertain the owner thereof and if and when such
owner is ascertained, to notify such owner or in case such owner
is a minor then such minor and the parents or guardians of such
minor of the fact of such impounding.
SECTION 14. That any person, firm, association or cor-
poration violating any of the provisions of this ordinance shall
be guilty of a misdemeanor, and upon conviction of any such viola-
tion such person, firm, association or corporation shall be pun -
isable of a fine of not more than $500.00 or by imprisonment in

the City Jail of the City of E1 Segundo, California, or in the
County Jail of Los Angeles County, California, as the committing
magistrate may direct, for a period of not to exceed six months,
or by both such fine and imprisonment in the discretion of the
court.
Every such person, firm, association or corporation
shall be deemed guilty of a separate offense for each and every
day during which, or during any portion of which, any of the pro-
visions of this ordinance is violated and shall be punishable
therefor as herein provided.
SECTION 15. That this ordinance shall become effective
at midnight on the thirtieth day from and after the date of the
final passage and adoption thereof.
SECTION 16. That the City Clerk shall certify to the
passage and adoption of this ordinance; shall make a minute of
the passage and adoption thereof in the records of the proceed-
ings of the City Council of said City in the minutes of the meet-
ing at which the same is passed and adopted; and within 15 days
after the adoption thereof shall cause the same to be published
once in the E1 Segundo Herald, a weekly newspaper of general
circulation, published and circulated within said City, and which
is hereby designated for that purpose.
