ORDINANCE NO. 449.
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING ORDINANCE NO. 90
(REGULATING THE COLLECTION AND DISPOSAL
OF GARBAGE AND RUBBISH AND THE ACCUMULA-
TION OF MANURE) OF SAID CITY, BY AMENDING
PARAGRAPH "(4)" OF SECTION 6 OF SAID
ORDINANCE NO. 90, AS AMENDED.
THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1. That paragraph 11(4)" of Section 6 of Ordi-
nance No. 90 of the City of E1 Segundo, California, entitled:
"AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, REGULATING THE COLLECTION AND
DISPOSAL OF GARBAGE AND RUBBISH AND THE
ACCUMULATION OF MANURE WITHIN SAID CITY;
PRESCRIBING PENALTIES FOR THE VIOLATION
THEREOF, AND REPEALING ALL ORDINANCES AND
PARTS OF ORDINANCES IN CONFLICT THEREWITH.",
passed and adopted on the 2nd day of January, 1923, shall be and
the same is hereby amended so as to read as follows, to wit:
"(4) No person, firm, association or corporation shall
burn any combustible rubbish, semi- combustible
rubbish or other combustible materials in any
open fire or in any incinerator within said City
of E1 Segundo, except between the hours of three
o'clock P. M. and six o'clock P. M. of any day,
and no permit (except as hereinafter provided)
issued under the provisions of thisordinance
shall authorize or permit such burning outside
of said hours; provided, however, that the Chief
of the Fire Department or his authorized repre-
sentative may in the exercise of his sound

discretion issue written permits for the burning
outside of the hours hereinabove limited for the
burning of any combustible materials, subject
to such conditions as said Chief or his authorized
representative may impose. It shall be unlawful
for any person to violate any condition or condi-
tions of any such permit."
SECTION 2. That paragraph "(4)" of Section 6 of said
Ordinance No. 90 is hereby amended as hereinabove in Section 1
of this ordinance set forth.
SECTION 3. That this ordinance is an emergency ordi-
nance affecting the public peace, health, safety, comfort, con-
venience and general welfare and the same shall, therefore, take
effect and be in full force and virtue immediately upon the final
adoption thereof.
The facts constituting its urgency are that atmospheric
conditions in the general metropolitan area of Los Angeles County,
in which the City of El Segundo is located, have recently become
such with reference to the retention of air pollutants or smog
as to require the immediate regulation provided for in the amend-
ment of paragraph "(4)tt of Section 6 of Ordinance No. 90 adopted
hereby in an attempt to minimize the deleterious effects arising
from the fire burning features of air pollution. This regulation
will also evidence the cooperation of the City of E1 Segundo with
other governmental agencies in such metropolitan area in seeking
to find a method of successfully combating the so- called smog
nuisance.
SECTION 4. That the City Clerk shall certify to the
passage and adoption of this ordinance by a vote of at least
four - fifths of all of the members of the City Council of said
City; shall make a minute of the passage and adoption thereof in

the records of the proceedings of the City Council of said City
in the minutes of the meeting at which the same is passed and
adopted; and shall cause the same to be published once in the
El Segundo Herald, a weekly newspaper of general circulation
published and circulated within said City, and which is hereby
designated for that purpose.
