ORDINANCE 446ORDINANCE NO. 446 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, RECLASSIFYING CERTAIN REAL PROPERTY, WITHIN SAID CITY, UNDER THE PRO- VISIONS OF ORDINANCE NO. 434 (THE COMPRE- HENSIVE ZONING ORDINANCE) OF SAID CITY, AS AMENDED, BY ADDING A NEW SECTION, DESIGNATED AS "310 ", TO ARTICLE 3 OF SAID ORDINANCE NO. 434; AND AMENDING THE ZONING MAP OF THE CITY OF EL SEGUNDO, ACCORDINGLY. WHEREAS, under the provisions of Ordinance No. 434 (The Comprehensive Zoning Ordinance) of the City of E1 Segundo, California, hereinafter referred to, North American Aviation, Inc., as prospective owner of the real property hereinafter described, made application for the reclassification of said property from Zones R -3, R -1 and P to Zone C -2, which said application was ap- proved, confirmed, ratified and joined in by Harry Geohegan, Inc., a corporation, the owner of said property; and WHEREAS, said application was thereupon and thereafter duly, regularly and lawfully processed and heard by said City Planning Commission, all as contemplated in and under the provi- sions of said Ordinance No. 434; and WHEREAS, after such processing and hearing said City Planning Commission did duly and regularly at a meeting of said Commission held on the 12th day of July, 1954, adopt its Resolu- tion No. 192, entitled; "A RESOLUTION OF THE CITY PLANNING COM- MISSION OF THE CITY OF EL SEGUNDO, CALI- FORNIA, DENYING THE APPLICATION OF NORTH AMERICAN AVIATION, INC., FOR CHANGE OF ZONE FROM R -3, R -1 AND P. TO ZONE C -2"; - 1 - wherein said Commission recommended to the City Council of said City that said application be denied; and WHEREAS, thereafter and within the time permitted under the provisions of said Ordinance No. 434, an appeal in writing from the decision and action of said City Planning Commission as made in its said Resolution No. 192 was duly and regularly filed with the City Council of said City; and WHEREAS, said City Council did thereafter duly, regu- larly and lawfully process and hear the matter of said applica- tion, the action and recommendation of said City Planning Com- mission recommending that the application to rezone said property to a district of Zone C -2 be denied, and the said appeal from said decision and action of said City Planning Commission as ex- pressed in said Resolution No. 192 of said Commission; and WHEREAS, after such processing and hearing, said City Council did at the regular meeting of said City Council held on the 1st day of September, 1954, duly and regularly adopt,by a majority vote of the entire membership of said City Councilp a resolution in words and figures as follows: and "RESOLVED, that it is the intention of this Coun- cil to make a- decision in favor of the appeal of North American Aviation, Inc., and to grant said companyts re- quest for a rezoning of the Westerly 700 feet of Lot 1, C. C. Hunt's Subdivision, for a change of zone from Zones R- 3,•R -1, and P to Zone C -2; and "BE IT FURTHER RESOLVED, that this Council does hereby request a further report on the matter from the Planning Commission before it makes its decision final; all in accordance with the provisions of Section 1$13 of Ordinance No. 434 (Zoning Ordinance) of said City. "; WHEREAS, a certified copy of said resolution was there- after duly and regularly delivered to and filed with the said City Planning Commission; and WHEREAS, thereafter and responsive to the request of said City Council and the provisions of Section 1813 of said IW-40 ' Ordinance No. 434, said City Planning Commission did duly and regu- larly adopt its Resolution No. 195, entitled: "A RESOLUTION OF THE CITY PLANNING COM- MISSION OF THE CITY OF EL SEGUNDO, CALI- FORNIA, DISSENTING FROM THE CITY COUNCIL IN REQUESTED CHANGE OF ZONE FROM R -1, R -3 AND P TO C -2 FOR NORTH AMERICAN AVIATION, INC., AND MAKING CERTAIN RECOMMENDATIONS. ", in which said resolution said City Planning Commission made to said City Council the report of said Commission with reference to said matters, all as contemplated under the provisions of said Section 1813 of said Ordinance No. 434; and WHEREAS, said City Council and the respective members thereof have reviewed said last mentioned report of said City Planning Commission as set forth in its said Resolution No. 195 and has further reviewed all of the proceedings had and taken in said matters by and before said City Planning Commission and by and before said City Council and has considered all of the testi- mony and all of the evidence, both oral and documentary, presented and adduced at all of the public hearings held by said Planning Commission and by said City Council with reference to said mat- ters and has now acquired jurisdiction to make its final decision in said matters; now, therefore, - THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Said City Council does hereby refer to the complete file of said City Planning Commission with reference to said matters which is on file in the office of the Secretary of the said City Planning Commission in the City Hall of said City and which is open to public inspection, and by this reference does hereby incorporate the same in this ordinance as fully and for all intents and purposes as though the same were herein set forth at length. - 3 - ' 3 JZJ.JL SECTION 2. Said City Council does hereby refer to the complete file of said City Council with reference to said matters which is on file in the office of the City Clerk of the said City in the City Hall of said City and which is open to public inspec- tion, and by this reference does hereby incorporate the same in this ordinance as fully and for all intents and purposes as though the same were herein set forth at length. SECTION 3. Said City Council does hereby find and de- termine that each and all of the facts recited in the preamble of this ordinance are true. SECTION 4. Said City Council does hereby further find that the public necessity and convenience and general welfare re- quire that the boundaries of the zones established by said Ordi- nance No. 434, the classification of property uses therein, and said Ordinance No. 434 be amended in the manner, to the extent, and with reference to the property, all as hereinafter provided and set forth in the new "Section 310" which is hereinafter added to said Ordinance No. 434 and which is set forth and quoted in Section 5 of this ordinance, and in the small area map which is hereinafter referred to in Section 6 of this ordinance and which is attached hereto, made a part hereof, and designated at "Exhib- it A ". SECTION 5. That a new section to be known and desig- nated as "Section 310" shall be and the same is hereby added to Article 3 of said Ordinance No. 434 (The Comprehensive Zoning Ordinance) of the City of E1 Segundo, California, passed and adopted on the 14th day of April, 1954, as amended, and which said new Section 310 shall read as follows, to wit: "SECTION 310. That pursuant to Zone Change Applica- tion of North American Aviation, Inc., as duly and regularly processed and publicly heard by the said Commission and the -4- 3 9,92! City Council of the City of E1 Segundo, California, the fol- lowing described real property located within the City of El Segundo, County of Los Angeles, State of California, to wit: The Westerly 700 feet of Lot 1, C. C. Huntfs Subdivision, as recorded in Book 36, Page 36 of Miscellaneous Records in the Office of the Recorder of Los Angeles County, Cali- fornia, shall be and the same is hereby changed, reclassified and rezoned from Zones R -1, R -3 and P to Zone C -2 under the provisions of this ordinance." SECTION 6. That said City Council has caused to be pre- pared a small area map of the area or district affected by the zone changes hereinabove ordered to be made, which said small area map is hereunto attached, designated as "Exhibit A", and is hereby referred to and by this reference incorporated herein and made a part hereof. Said small area map (Exhibit A) is hereby adopted as, and shall be an amendment to, the extent of the area shown thereon and affected thereby, of the "Zoning Map of the City of E1 Segundo ", referred to in, and which is adopted by, the provisions of Section 302 of Article 3 of said Ordinance No. 434 of said City. SECTION 7. That said Ordinance No. 434 and said Zoning Map of said City shall be and the same are hereby amended as here- inabove in Sections 5 and 6 of this ordinance set forth. SECTION 8. That this ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 9. That the City Clerk shall certify to the passage and adoption of this ordinance; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; shall cause the same to be - 5 - entered in the book of original ordinances of said City; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is hereby designated for that purpose.
