ORDINANCE 432"6 J ORDINANCE NO. 432 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELEC- TION TO BE HELD IN THE CITY OF EL SEGUNDO ON THE 13TH DAY OF APRIL, 1954, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY TWO PROPOSITIONS TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR CERTAIN MUNICIPAL IMPROVEMENTS, AND CON- SOLIDATING SAID ELECTION WITH THE GENERAL MUNICIPAL ELECTION TO BE HELD ON SAID DATE. WHEREAS, the City Council of the City of El Segundo, California, did on the 24th day of February, 1954, by a vote of more than two - thirds of the members of said City Council, adopt Resolution No. 1389 entitled ttResolution of the City Council of the City of El Segundo, California, determining that the public interest and necessity demand the acquisition and construction of certain municipal improvements, and making findings relating theretott, which said resolution was duly signed and approved by the Mayor of said city and attested and certified by the City Clerk of said city; NOW, THEREFORE, the City Council of the City of E1 Segundo DOES ORDAIN as follows: SECTION 1. That a special election be held, and the same is hereby called to be held, in the City of E1 Segundo, California, on the 13th day of April, 1954, for the purpose of submitting to the qualified voters of said city two propositions of incurring indebtedness and issuing bonds of said city there- for, in the amounts hereinafter set forth, and for the objects and purposes set forth in said resolution and hereinafter stated. - 1 - SECTION 2. That the object and purpose for which each of said indebtedness is to be incurred and bonds issued therefor are as follows: Bond Proposition No. 1: The acquisition and construction by the City of El Segundo of a certain municipal improvement, to wit: a city hall, including the improvement of the city hall grounds with landscaping and vehicle parking facilities, and including the acquisition of all furniture, furnish- ings, equipment and other property necessary for any of the foregoing. Bond Proposition No. 2: The acquisition and construction by the City of El Segundo of a certain municipal improvement, to wit: a building to provide quarters for the police department and city jail, including an indoor pistol range and quarters for civil defense, and including all furniture, furnishings, equipment and other property necessary for any of the foregoing. SECTION 3. That the estimated cost of the municipal improvement described in Bond Proposition No. 1 in Section 2 hereof is the sum of two hundred seventy thousand dollars ($270,000) and that the amount of the principal of the indebted- ness to be incurred therefor is the sum of two hundred seventy thousand dollars ($270,000). That the estimated cost of the municipal improvement described in Bond Proposition No. 2 in Section 2 hereof is the sum of one hundred twenty thousand dollars ($120,000) and that the amount of the principal of the indebtedness to be incurred therefor is the sum of one hundred twenty thousand dollars (4120,000). - 2 - 1 _J a .1 That the maximum rate of interest to be paid on any indebtedness incurred for any of the purposes stated in this ordinance shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually for the first year and semiannually thereafter, the actual rate or rates of interest on said bonds to be determined at the time of the sale or sales thereof. That if any proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit, two - thirds of the votes of the qualified electors voting on said proposition, bonds of said city, in not exceed- ing the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth in said proposition. SECTION 4. That the polls for said election shall be opened at seven otclock, A.M., of the day of said election and shall remain open continuously from said time until seven otclock, P.M., of the same day, when said polls shall be closed, except as provided in Section 573. of the Elections Code of the State of California. That on the ballots to be used at said special elec- tion, in addition to any other matters required by law, there shall be printed substantially the following: MARK CROSSES (.+..)ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL. INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+)in the voting square after the word "YES" or after the word "NO't. All marks, except.-the-cross ( +) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. - 3 - If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. SECTION 5. A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of a proposition. A cross (+) placed in the voting square after the word "NO" in the man- ner hereinbefore provided shall be counted against the adoption of a proposition. SECTION 6. That the special election hereby called shall be and is hereby ordered consolidated with the general municipal election to be held in said city on Tuesday, April 13, - 4 - Au 1954, and such elections shall be held in all respects as if there were only one election, and only one form of ballot shall be used thereat. The precincts, polling places and officers of election for this special election shall be the same as those provided for said general municipal election, and said pre- cincts, polling places and officers of election are set forth in the resolution providing for said general municipal election; to wit, Resolution No. 13$6, adopted February 10, 1954, by this City Council. SECTION 7. That except as otherwise provided in this ordinance, the election called hereby shall be conducted as provided by law for other municipal elections in said city. SECTION 8. That the City Council of said city shall meet at its usual place of meeting in the City Hall on Tuesday, the 20th day of April, 1954, at 7:00 otclock, P.M., of said day, and proceed to canvass the election returns and declare the re- sult of said election. SECTION 9. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two - thirds of all of the members of the City Council of said city and shall cause said ordinance to be published once a week for two successive weeks prior to the date of said election in the EL SEGUNDO HERALD, a newspaper of general circulation printed, published and circulated in the City of El Segundo once a week. No other notice of such election need be given. SECTION 10. This ordinance shall take effect upon its passage.
