ORDINANCE 423ORDINANCE NO. 423. AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE NO. 306 (THE LAND USE PLAN - ZONING ORDINANCE) OF SAID CITY BY ADDING A NEW SECTION TO BE KNOWN AS "SECTION 17.10" TO SAID OR- DINANCE NO. 3060 AS AMENDED; AND BY AMENDING THE ZONING MAP LAND USE PLAN THEREIN REFERRED TO, PURSUANT TO PRO- CEEDINGS HAD ON THE APPLICATION OF WILLIAM E. D ORAN . WHEREAS, under the provisions of Ordinance No. 306 (the Land Use Plan - Zoning Ordinance) of the City of E1 Segun- do, hereinafter referred to, an application was filed by William E. Doran for a reclassification of the real property hereinafter described, in the City of E1 Segundo, California, from a dis- trict of Zone R -1 to a district of Zone C -2 under the provisions of said Ordinance No. 306, as amended; and WHEREAS, the City Planning Commission of said City did, as required by law, duly and regularly process the said application and hold public hearings thereon, and did duly and regularly report to and file with the City Council of said City (by Resolution No. 110 of said Commission adopted on the 30th day of March, 1953) the findings, determinations and recommenda- tions of said Planning Commission with reference to said appli- cation; and WHEREAS, said Commission in its said Resolution No. 140 did recommend that the requested change from Zone R -1 to Zone C -2 be denied, but that a zone change from R -1 to R -3 be granted; and - 1 - WHEREAS, the City Council of said City, on its own part, has, as required by law, duly and regularly processed and held a public hearing upon the said application, and has con- sidered the said application and all of the files and records of said Commission relating thereto, and has also duly consid- ered all evidence, both oral and documentary, submitted, both to said Commission and to said City Council, with reference to said application and the matter of said proposed reclassifica- tion; and WHEREAS, said City Council has reached its determina- tion and decision with reference to said matter as hereinafter set forth; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Said City Council does hereby find and determine that the facts and circumstances relating to the ap- plication and to the subject property in the matter, herein - above referred to in the preamble of this ordinance, are such as to amply justify the recommendations of the City Planning Commission of said City in said matter and said City Council does hereby approve and concur in the recommendations of said City Planning Commission in the matter of said application, all as set forth in said Resolution No. 140 of said Commission, save and except that the City Council believes, and therefore finds, that the change from Zone R -1 to Zone R -3 should only ap- ply to that certain portion of the real property referred to in said Resolution No. 140 of said Commission which is herein- after described in new "Section 17.10" added to said Ordinance No. 306 and which is hereinafter quoted in Section 2 of this Ordinance. SECTION 2. That Ordinance No. 306 of the City of E1 Segundo, entitled: "AN ORDINANCE ESTABLISHING ZONES WITHIN THE CITY OF EL SEGUNDO AND ESTABLISHING CLASSIFICATION OF LAND USES AND REGULATING SUCH LAND USES IN SUCH ZONES; REGULATING THE HEIGHT OF BUILDINGS, AND OPEN SPACES FOR LIGHT AND VENTILATION; ADOPTING A MAP OF SAID ZONES; DEFINING THE TERMS USED IN SAID ORDINANCE; PROVIDING FOR THE ADJUSTMENT, AMENDMENT AND ENFORCEMENT THEREOF; PRESCRIBING PENALTIES FOR ITS VIOLATION.", passed and adopted on the 22nd day of January, 1947, shall be - 2 - and the same is hereby amended by adding a new section thereto to be known and designated as "Section 17.10", and which said new Section 17.10 shall read as follows, to wit: "SECTION 17.10. That pursuant to zone change application of William E. Doran, as duly processed and heard by the Planning Commission and by the City Coun- cil of said City, the following described real property located within the City of E1 Segundo, County of Los Angeles, State of California, to wit: That portion of Lot 1 of J. H. Fisherts Sub- division, in Section 12 of the Sausal.Redon- d© Rancho, in the City of E1 Segundo, as per map recorded in Book 22, Page $7 of Miscel- laneous Records, on file in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at a point South $90 5$t 50" East $$ feet and South 00 It 0$" West_ 150 feet from the intersection of the West line of J. H. Fisherts Subdivision with the South line of Imperial High- way, 60 feet wide; thence South 00 It 08" West 100 feet; thence South $90 5$1 50" East $$ feet; thence North 00 It 0$" East 100 feet; thence North 890 5$1,50" - West $$ feet to the Point of beginning, shall be and the same is hereby changed, reclassified and redistricted from a district of Zone R -1 to a dis- trict of Zone R -3 under the provisions of this ordi- nance." SECTION 3. That said City Council has caused to be prepared a small area map of the area or district affected by the zone change hereinabove ordered to be made, which said small area map is hereunto attached, designated as "Exhibit A ", and is hereby referred to and by this reference incorporated herein and made a part hereof. Said small area map (Exhibit A) is hereby adopted as, and shall be an amendment to the extent of the area - 3 - shown thereon and affected thereby, of the zoning map of the said City of E1 Segundo, referred to in, and which is adopted by, the provisions of Section 3 of said Ordinance No. 306 of said City, as amended. SECTION 4. That said Ordinance No. 306, as amended, and said Zoning Map of said City, as amended, shall be and the same are hereby amended as hereinabove in Sections 2 and 3 of this ordinance set forth. SECTION 5. That this ordinance shall become effec- tive at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. SECTION 6. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the meeting at which the same is passed and adopted; and shall, within fifteen days after the passage and adoption thereof, cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City of E1 Segundo and which is here- by designated for that purpose.
