ORDINANCE 400ORDINANCE N0. 400 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE NO. 306 (THE LAND USE PLAN - ZONING ORDINANCE) OF SAID CITY BY ADDING A NEW SUBPARAGRAPH TO BE DESIGNATED AS "d" TO PARAGRAPH "C. AREA. GENERAL" OF SECTION 12 OF SAID ORDINANCE NO. 306; BY AMENDING SUBPARAGRAPH IICrt OF SECTION 4 OF SAID ORDINANCE NO. 306; BY AMENDING SUB- PARAGRAPH "NOTICES "OF SECTION 15 OF SAID ORDI- NANCE NO. 306; BY ADDING A NEW SECTION TO BE DESIGNATED AS "SECTION' - 1;7.4" TO SAID ORDINANCE NO. 306; AND BY AMENDING THE ZONING MAP LAND USE PLAN, WHICH IS A PART OF SAID ORDINANCE NO. 306. WHEREAS, the City Planning Commission and the City Council of the City of El Segundo, California, have duly and regularly processed and held public hearings upon each and all of the amendments hereinafter made to Ordinance No. 306 of the City of El Segundo, California, entitled: "AN ORDINANCE ESTABLISHING ZONES WITHIN THE CITY OF EL SEGUNDO AND ESTABLISHING CLASSI- FICATION OF LAND USES AND REGULATING SUCH LAND USES IN SUCH ZONES; REGULATING THE HEIGHT OF BUILDINGS AND OPEN SPACES FOR LIGHT AND VENTILATION; ADOPTING A MAP OF SAID ZONES; DEFINING THE TERMS USED IN SAID ORDI- NANCE; PROVIDING FOR THE ADJUSTMENT, AMEND- MENT AND ENFORCEMENT THEREOF; PRESCRIBING PENALTIES FOR ITS VIOLATION. ", passed and adopted on the 22nd day of January, 1947, as amended, pursuant to proceedingsinstituted by said City Planning Com- mission; and WHEREAS, said City Council has now acquired jurisdic- tion to adopt this ordinance; - 1 - 2650 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. That said Council does hereby refer to Resolution No. 10$ of the City Planning Commission of the City of E1 Segundo, California, adopted on the 24th day of September, 1951, a full, true and correct copy of which is on file in the office of the City Clerk of said City, open to public inspec- tion, and so on file is hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 2. That said City Council does hereby make the same findings and determinations with reference to the amendments, hereinafter set forth, as are made by said City Planning Commission with reference thereto in its said Resolu- tion No. 108. SECTION 3. That a new subparagraph to be known and designated as subparagraph "d" shall be and the same is hereby added to Paragraph 11C. AREA. General." of Section 12 of said Ordinance No. 306, and which new subparagraph shall read as follows, to wit: "d. The Planning Commission may, by resolution, adopt a formula or establish standard practices by which to determine an appropriate and practical modification of required front, side and rear yard depths in all residen- tial zones where geometric shape and dimensions and topog- raphy are such as to make the literal application of such required yard depths impractical. After the adoption of such formula or standard practices and the approval there- of by the City Council, they shall be applied as an admin- istrative act." SECTION 4. That subparagraph IICII of Section 4 of said Ordinance No. 306, shall be and the same is hereby amended so as to read as follows, to wit: - 2 - J 2651 "C. FRONT YARD. There shall be a front yard of not less than twenty -five percent (25%) of the depth of the lot, pro- vided such front yard need not exceed twenty (20) feet for lots having a depth of one hundred and thirty -five (135) feet or less and a width of not less than fifty (50) feet. For lots having a depth greater than one hundred and thirty -five (135) feet or a width less than fifty (50) feet, a front yard twenty -five (25) feet in depth shall be provided, except where lots comprising forty percent (40%) or more of the frontage on one side of a street between intersecting streets are developed with buildings having an average front yard with a variation of not more than six (6) feet, no building hereafter erected or structurally altered shall project beyond the average front yard line so established." SECTION 5. That subparagraph "NOTICES" of Section 15 of said Ordinance No. 306, shall be and the same is hereby amended so as to read as follows, to wit: "NOTICES. All proposals for amending zone boundaries or classification of property uses within such zones as are defined by this ordinance, or for the granting of variances as provided in Section 13 hereof, shall be set for public hearing by the Secretary of the Planning Com- mission, notice of which shall be given in the manner set forth in Paragraphs 1, 2 and 3 hereof, the date of the first of which hearings shall be not less than ten (10) days nor more than thirty -five (35) days from the time of filing of such verified petition or of the adoption of such resolution, or the making of such motion; provided, however, that not more than one hearing shall be required for the purpose of considering the granting of a variance. - 3 - 2652 111. In the case of an amendment to zoning boundaries or classification or reclassification of property uses, notice of such hearings shall be published once in a newspaper of general circulation in the City not less than ten (10) days prior to the date of the proposed hearing, and such notice shall set forth a description of the property under consideration, the nature of the proposed change and the time and place at which a public hearing or hearings on the matter will be held, and by mailing a notice not less than ten (10) days prior to the date of the first of such hearings to the owners of property within a radius of three hundred (300) feet of the exterior boundaries of the property to be changed, using for this purpose the last known name and address of such owners as shown upon the assessment roll of this County. Such notice shall contain the same information as is required for published notices as above described. 112. In the case of an amendment to the text of this ordinance, notice of hearings shall be published once in a newspaper of general circulation in the City, not less than ten (10) days prior to the date of the proposed hearing, and such notice shall set forth the nature of the proposed change and the time and place at which such hear- ings will be held on the matter. 113. In the case of an application for a variance, no- tice of the hearing on such application shall be made by mailing a notice not less than ten days prior to the date of the hearing to the owners of property within a radius of three hundred (300) feet of the exterior boundaries of the property for which the variance is asked, using for this purpose the last known name and address of such owners as shown upon the assessment roll of this County. Such - 4 - 2653 notice shall set forth a description of the property under consideration, the nature of the proposed change, and the time and place at which a public hearing on the matter will be held." SECTION 6. The City Council hereby approves, ratifies and confirms its meeting action of January 30, 1952, in which said Council disapproved the change of zone as recommended in Section 4 of said Resolution No. 10$ of said Planning Commission, and said City Council does hereby accordingly deny the proposed zone change as recommended in said Section 4 of said Resolution No. 108. SECTION 7. That a new section to be known and desig- nated as "SECTION 17.4" shall be and the same is hereby added to said Ordinance No. 306, and which new section shall read as follows, to wit: "SECTION 17.4. That pursuant to proceedings instituted by the Planning Commission of said City on its own motion, duly processed and heard by said Planning Commission and by the City Council of said City, the fol- lowing described real property situated within the City of E1 Segundo, County of Los Angeles, State of California, and shown on Part I of the official Zoning Map of said City, which constitutes a part of this Ordinance No. 306, to wit: "The frontage on both sides of Bungalow Drive, lying north of Franklin Avenue and south of the alley at the rear of the frontages on Grand Avenue; shall be and the same is hereby rezoned and reclassified from a district or districts of Zone tR -3t to a district or districts of Zone tM -11 under the provisions of this Ordinance No. 306, as amended." - 5 - 26 4 SECTION 8. That the said City Council has caused to be prepared a small area map of the area, district, or terri- tory affected by the zone change hereinabove ordered to be made in Section 7 of this ordinance, which said small area map is hereunto attached, designated as "Exhibit All, is hereby referred to and by this reference incorporated herein and made a part hereof. Said small area map ( "Exhibit A") is hereby adopted as and shall be an amendment to the extent of the area shown there- on of the said Part I of the Zoning Map, Land Use Plan, being a part of Ordinance No. 306, City of El Segundo, California, adopt- ed by said Ordinance No. 306, as amended. SECTION 9. That said Ordinance No. 306, as amended, and said Part I of the Zoning Map, Land Use Plan, being a part of Ordinance No. 30619 City of E1 Segundo, California, shall be and the same are hereby amended as hereinabove in Sections 3, 4, 5, 7 and 8 of this ordinance set forth. SECTION 10. That this ordinance shall take effect and be in full force and virtue 30 days from and after the final passage and adoption thereof. SECTION 11. That the City Clerk shall certify to the passage and adoption of this ordinance; shall make a minute of the passage and adoption thereof in the records of the proceed- ings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted; and within 15 days after adoption thereof shall cause the same to be published once in the El Segundo Herald, a weekly newspaper of general circulation, published and circulated within said City, and which is hereby designated for that purpose.
