ORDINANCE NO. 385
AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, AMENDING ORDINANCE NO. 382
(THE BUSINESS LICENSE ORDINANCE) OF SAID
CITY, BY ADDING A NEW SECTION TAO,
TO BE KNOWN AND DESIGNATED AS SECTION
NO. 115.1 RELATING TO PERSONAL AND SNAU
INCOME BUSINESSES; AND BY AMENDING SEC -
TIONS NOS. 560 579 58;AND 59 OF SAID
ORDINANCE NO. 382.
SECTION 1. That a new section to be known and designated
as Section No. 115.1, shall be and the same is hereby added to Ordi-
nanee No. 382 of said City, entitled,
"AN ORDINANCE OF THE CITY OF EL SEGUND09 CALIFORNIA,
PROVIDING FOR LICENSING AND ..REGULATING_ CERTAIN_KINDS
OF BUSINESSES, TRADES, CALLINGS,. VOCATIONS,,PROFES
SIONS,. EXHIBITIONS, SHOWS,.Ei RISES.AND OCCUPA-
TIONS COXTCED, CONDUCTED OR CARRIED ON WITHIN.SAID
CITY;. FIXING THE AMOUNTS OF_THE.RESPECTIPE.LICENSE..
FEES THEREFOR; PROVIDING FOR. THE COLLECTION_. OF SUCH
LICENSE.,FEFS; AND REPEALING ALL ORDINANCES AND PARTS
OF ORDINAN= IN.CONFLICT TWITH.%
passed and adopted on the 28th day of February, 1951, and which said
new Section 115.1 shall read as follows, to wit:
"SECTION 115.1. PERSONAL AND SMALL INCOME BUSINESSES.
The City Council realizes that from time to time applicants for
licenses under this ordinance will bring to the attention of
the City Clerk various types of small businesses and personally
conducted ventures or undertakings where the activities in-
volved are quite limited and where the gross income received
from the operation of the same will be comparatively small.
The City Council is, therefore, in this section, providing a
means whereby licenses for such limited and small income busi-
nesses may be obtained (if authorized by the Council) under
the provisions of this section, at the reduced license fee here-
inafter specified.

"Where such cases are presented to the City Clerk, the
City Clerk may advise the applicant of his right to file an
affidavit under the provisions of this section setting forth
the true facts with reference to the business which the appli-
cant feels may fall within the types of businesses referred to
in this section. Such affidavit shall in all cases state the
nature of the business proposed to be licensed; the estimated
amount of the maximum gross income which it is anticipated
will be received from such business during the period of one
year from date of issuance of license; and a further state-
ment that if a license is issued under the provisions of this
section and the gross income of the business covered by such
license exceeds that mentioned in the affidavit, that such
applicant or licensee will immediately notify the City Clerk
of such fact and will immediately thereupon pay to said City
Clerk for said City the balance of the regular license fee
applicable to such business as prescribed by this ordinance.
"Upon receipt of such affidavit, the City Clerk shall
present the same to the City Council at its next regular meet-
ing after the filing thereof. The City Council shall there-
upon, at said meeting or at any meeting to which said matter
may be continued, consider the said affidavit, the facts there-
in stated and such further supporting testimony or evidence,
if any, as the applicant may desire to offer. Said Council may
thereupon determine whether or not, from the facts and evidence
presented, the business, undertaking or activity referred to in
such affidavit is entitled to receive the limited license con-
templated by this section or not. If the Council determines
that the license should be issued under the provisions of this
section, then, and in that event, the license fee for such
business hereunder shall be the sum of $12.00 per year, subject,
however, to the payment of the higher license prescribed by

this ordinance in the event any of the statements made in
such affidavit are found to be untrue or if the gross revenue
received from said business during the period of one year
covered by such license exceeds the estimated amount of gross
revenue as stated in such affidavit. The City Council hereby
reserves the right to make the determination on its part as
contemplated in this section and its decision with reference
to any such business or matter shall be final and conclusive."
SECTION 2. That Section 56 of said Ordinance No. 382,
shall be and the same is hereby amended so as to read as follovq
to wit:
"SECTION 56. GENERAL MERCHANDISE STORES, where three
or more persons are regularly employed, $50.00 per year."
SECTION 3. That Section 57 of said Ordinance No. 382,
shall be and the same is hereby amended so as to read as follows,
to wit:
"SECT-ION 57. GENERAL MERCHANDISE STORES, where less
than three persons are regularly employed, $25.00 per year."
SECTION 4. That Section 58 of said Ordinance No. 382,
shall be and the same is hereby amended so as to read as follows,
to wit:
"SECTION 58. GROCERY STORES, where three or more
persons are regularly employed, $50.00 per year."
SECTION 5. That Section 59 of said Ordinance No. 382,
shall be and the same is hereby amended so as to read as follows,
to wit:
"SECTION 59. GROCERY STORES, where less than three
persons are regularly employed, $25.00 per year."
SECTION 6. That said Ordinance No. 382 is hereby amended
as hereinabove in Sections 1, 22 39 4 and 5 of this ordinance set
forth.

SECTION 7. That this ordinance shall become effective at
midnight on the thirtieth day from and after the date of the final
passage and adoption thereof.
SEC`1'ION 8. That the City Clerk shall certify to the pas-
sage and adoption of this ordinance; shall make a minute of the
passage and adoption thereof in the records of the proceedings of
the City Council of said City in the minutes of the meeting at which
the same is passed and adopted; and within 15 days after the adoption
thereof shall cause the same to be published once in the E1 Segundo
Herald, a weekly newspaper of general circulation, published and
circulated within said City, and which is hereby designated for that
purpose.
