Definitions. "Within the meaning of this ordinance (a) "Explosives" means gun powder, blasting powder, dynamite, and every other exFlosive substance having a power greater than or equal to ordinary black nowder. (b) "�:eapons" mes.ns revolver, pistol, dagger, dirk, slug, high - power -ed air rifle, or billy. (c) "Alias" means any name other than the true name of a Berson which such person uses or has used or which he or she is known by or has been kno,vn bv. (d) "11.ember" means any person who is recognized by "! an organization as such or who is formally associated or affili- ated with any organization or who accepts the policies or programs of any organization and who is active in its behalf. SECTICIT 2. The City Council of the City of El Segundo, California, finds that: (a) There exist in Los Angeles County active organi- zations which are organized to reach ends and use methods which are incompatible with our present constitutional system of govern- ment in the United States, the State of California, and the County of Los �'.ngele s . - 1 - Y (b) The goal of these active organizations is to seize powers of government by and for a minority rather than to acquire power through the vote of a free electorate. They seek not merely a change of admi--_A stration or reform legislation with- in the constitutional framework. Their program only begins oath the seizure of government which then beco!ies a means to impose upon society an organization on principle fundamentally opposed to those presupposed by the Constitution of the United States. Their purpose is to forcibly recast our whole social and politi- cal structure after the :uscovite model of police -state dictator- ship. These organizations reject the entire religious and cultu- ral heritage of 7'.'estern civilization as well as American economic and political systems. Their program is a belated counter-revo- lution to the American Revolution designed to undo the Declaration of Independence, the Constitution, the Bill of Rights, and over- turn our system of free representative self- government. (c) These organizations are dominated and controlled by a foreign government. To the threat of civil disorder they add the threat of betrayal into alien hands. These organizations are not native to this country, and their beginnings here are not an effort of Americans to answer American problems. (d) Violent and forceful means are the calculated and indispensible methods to attain the goal of these organizations. The international police state has crept over .Eastern Europe by deception, coercion, coup dtetat, terrorism, and assassination. Not only has this international police state overpowered its critics and opponents, it has actually liquidated them. These or- ganizations in the United States which are active in the County of Los hngeles have copied the organizational structure and their leaders have been schooled in the same techniques and from the same tutors which established the international police state in Europe. These organizations in the United States which are - 2 - 2-448 active in Los Angeles County have imported international police- state disciplines and techniques notwithstanding the fact that this country offers them a way to peaceful revolution by-the bal- lot; but instead of resting their case upon persuasion and any appeal inherent in their ideas and principles, these organiza- tions adopt the techniques of a secret cabal, false names, forged passports, code messages, and clandestine meetings. To these techniques they add occasional terroristic and threatening methods, such as, picketing courts and juries, political strikes, sabotage, and des ruction of real and personal property. (e) That there exists within the perimeter of the Coun- ty of Los Angeles a substantial and serious specific danger of use of force or violence by these organizations against the present constitutional form of governments of Los Angeles County, the State of California, and the United States. The City Council further finds that this danger is extremely serious in Los t *geles Coun- ty. The City Council further finds that the degree of imminence of this danger is extremely high. It is further found that vd th- in the perimeter of the County of Los Angeles the continued ac- tivities of the members of these organizations will immediately bring about the substantial and serious specific evil of the use of force or violence by these organizations against the present form of governments of the City of L1 Segundo, the County of Los Angeles, the State of California, and the United States. There is a clear and present danger which is very great and imminent that the techniques, strategy, and methods recently employed so successfully in other countries, including acts of sabotage, coup d'etat, armed insurrection, assassination, terrorism, interrup- tion of utility services, and organized insubordination of govern- mental employees, will be employed by members of these organiza- tions in the County of Los Angeles. - 3 - 2449 (f) Because of the strategic location of Los Lngeles County, its great population, its use as an important embarkEtion point for military operation, the presence in the County -of num- erous large manufacturing plants devoted to the production of ma- • terial and supplies for use of the United States armed forces, the presence in the County of numerous large manufacturing plants de- voted to the production of materials and supplies necessary for the civilian defense of the citizens of the United States, and its importance as a center of co,rmunication and transportation, all Dossible measures under the law must be immediately taken to safe- guard and prevent within the County any use of violence or force- ful means for impairing the legal authority of the constitutional government or interfering with the military and civil defense of the state,ration, or county. (g) The City Council further specifically finds that: (1) Registration of members of these organizations who reside in, areenployed in, have their business in, or en- ter the County; (2) The prevention of their possession of concealed weapons, explosives ,:vhether concealed or unconcealed; and (3) Denial of employment in the City of E1 Segundo disaster relief authority or any other civilian defense or- ganization or agency in said City are reasonable measures by which to accomplish these ends. (h) That the City of El Segundo is located in the Coun- ty off' Los Angeles, State of California, above referred to, and be- ing located in said county and having within its own city limits various industries Droducine commodities and materials essential and vital to rilitary and civilian defense of the United States of America; therefore, the same findins, hereinabove made with reference to the County of Los I- ngeles, apply equally as well to the City of El Segundo. 2450 SECTION 3. Any person who resides in, does business in, is employed in, has a rezular place of business in, or who regular- ly enters or travels through any part of the City of Eli Segundo, California, must register with the Chief of Police of the City Of El Segundo if he or she is a member of any organization de- scribed in paragraphs (a) or (b) immediately below: (a) =_n organization that on or after the effective date of this ordinance advocates as a present objective by speech, writ- ing, or action the overthrow or destruction by force or violence of the present constitutional form's of government of the City of El Segundo, the County of Los = ngeles, State of California, or the United States. (b) r_n organization that on or after the effective date of this ordinance advocates as a present objective by speech, --rriting, or action the destruction, injury, ille -al interference, or tampering ,,with real or personal property in the City of El Segundo as a means of accomplishing a hindrance, delay, inter- ference, or obstruction of the production or manufacture of ma- terial or supplies for the United States military forces or for the Civilian Defense of citizens in the United States. S 'ECTION 4. Any person required to register under this ordinance shall within ten days after the effective date of this ordinance acknowledge under oath and file with the main office of the E1 Segundo Police Department a registration statement con - taiai ng the following information: (a) Name and any alias or aliases of registrant. (b) Address of registrant's place of residence. (c) Name and address of regi strap t' G PmnI near i is n ncr and the address and name under which registrant is conducting any business, if any. Vao days after any person who has registered pursuant to this ordinance chanSes his place of residence or his employment or his place of business or cormences to use or be- con.e knorn by a name other than a name which he has registered or becomes a rsember of an organization defined in Section 3, the name of which is not stated in his registration statement, he shall acknowledge under oath and file a new registration state - ment in the same form as provided for original registration statements. S-7CTIO^, 5. The Chief of Police of the City of El Se- gundo shall keep ant file all registration statements under this Ordinance at the =inn office of the Police Department, arranged alrhabetically according to the s_rna_me of the registrant. He shall also ccmpile and maintain from such registration statements an accurate alphabetically arranged file or list of all aliases listed thereon, to`et=_er with appropriate references indicating the registration statement upon which each of such aliases is listed; and an accurate alrhabetically arranged file or list of all co<rz--anist or�-anizations and their addresses, if any, listed thereon. SECTIO:T 6. my person required by this ordinance to red :ister who with knowledge or :ith reason to believe that he is required to register hereunder wilfglly fails or refuses to so register or any person who after registering wilfully violates any provision of this ordinance shall be guilty of a misdemeanor, and upon conviction of any such violation such person shall be punishable by a fine of not more than 6500.00 or by imprisonment in the City Jail of the City of El Segundo, California, or in the County Jail of Los nngeles County, California, as the com- mitting ma,,:7istrate may direct, °or a period of not to exceed six months, or by both such fine and imprisonment in the discretion of the Court. Each day of failure or refusal of such person to register shall constitute a separate offense. SECTINi? 7. Lny person who wilfully makes any false or misleEding statement in any registration statement or affidavit provided for in this ordinance shall be guilty of a misdemeanor, and upon conviction of any such violation such Person shall be punishable by a fine of not more than �t',520.00 or by imprisonment in the City Jail of the City of E1 Segundo, California, or in the County Jail of Los Angeles County, California, as th-e com- a fitting magistr°te may direct, for a period of not to exceed six months, or by both such fine and imprisonment in the dis- cretion of the Court. SECTION S. Any person who registers under this ordi- nance shall not be entitled: - 7 - 2453 (a) To ownership, possession or control of concealed weapons or explosives -�.,hether concealed or unconcealed unless he has a special permit from the Chief of Police of the City of El Segundo which may not be issued unless: (b) To be a_,pointed to any office or position in the City of El Segundo Civilian Defense Organization or any other civilian defense organization or agency in said city unless: such a person subsequent to registration shall file an affidavit with the Chief of roll ce of the Cit.7 of E1 Segundo that he is no longer a member of any of the organizations which membership he had previously indicated in his registration and that he does not presently advocate by speech, �rritinE, or action the overthrow or destruction by force or violence of the present constitutional fora_ of government of the United States or of the State of Cali- fornia or of the County of Los xngeles or of the City of E1 Se- gundo and that he does not Presently advocate by speech, writing, or action the-destruction, injury, illegal interference or tam- perir_a with real or personal property in the City of E1 Segundo as a means of accomplishing a hindrance, delay, interference, or obstruction of the production or manufacturing of material or supplies for the United States military forces or for the civilian defense of citizens of the United States. SECTION 9. If any provision of this ordinance or the application thereof to any person or circumstances is held in- valid, the remainder of the ordinance and the application of such provision to other persons or circumstances shall not be affected thereby. SECTI01T 10. This ordinance is an ordinance for the im- mediate preservation of the public paace, health, and safety and is hereinafter made to take effect immediately upon its adoption. The facts constituting its urgency are outlined, stated and de- clared in L`ection 2 of this ordinance. 245 SECTIO?' 11. This ordinance shall take effect immediate- ly upon adoption. SECTIOT7 12. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of at least four - fifths of all of the members of the City Council of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adopted; and within 15 days after the adoption thereof shall ii , me to be published once in the E1 Segundo :ierald, a Weekly newspaper of general circulation, published and circula- ted within said City, and :which is hereby designated for that purpose.
