ORDINANCE 317V ORDINANCE NO. 317. AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, RELATING TO AND REGULATING THE PRESENTING, AUDITING AND PAYMENT OF DEMANDS AGAINST SAID CITY, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES (INCLUDING ORDINANCE NO. 145 OF SAID CITY) AND ALL RESOLUTIONS AND PARTS OF RESOLU'T'IONS IN CONFLICT THEREWITH. The City Council of the City of El Segundo, California, does ordain as follows: SECTION 1. That all claims or demands against the City of E1 Segundo, California, shall be made in writing and should set forth in reasonable detail for what such claim or demand is presented, and in case of materials or supplies should be accompanied by a written statement or voucher sign- ed by the person ordering the material or supplies for which the claim or demand is made, or have thereon the requisition number, if any, pursuant to which such claim or demand is made. SECTION 2. That all claims or demands against said city shall be filed with the City Clerk and shall be promptly presented by him to the City Council at a regular or adjourn- ed regular meeting thereof after the filing of such claims or demands. Claims or demands should be filed with or presented to the City Clerk at least forty.-eight hours prior to the regular or adjourned regular meeting of the City Council, at which the same are to be presented, and the City Clerk in his discretion may withhold the presenting of any claim or demand which is not filed prior to such forty -eight hour period, until the second regular or adjourned regular meeting of the Council held after such filing. 1- SECTION 3. When any claim or demand is allowed by the City Council and ordered paid by resolution adopted by said Council, the City Clerk of said city (or in case of his absence or inability to act, then his authorized deputy) shall draw a warrant upon the city treasury of said city for the same as allowed, which warrant shall be signed by the Mayor or Mayor pro tempore and be countersigned by the City Clerk, or his or her authorized deputy, and by the City Treasurer or his or her authorized deputy, and shall specify for what purpose the same is drawn, and also out of what fund it is to be paid. Upon the presentation of said warrant properly executed and endorsed, the City Treasurer shall pay the same out of the funds in the city treasury properly applicable to that purpose. It is provided, however, that in the case of demands covering pay rolls incurred for or on behalf of said city, only one demand for each payroll period need be pre.. pared and presented, which said demand shall clearly indicate thereon the total amount thereof and the respective items thereof to be charged against the various funds affected thereby, and in such case only one warrant, payable to the City Treasurer of said city, need be drawn, which said warrant, so payable, when allowed as hereinabove set forth, shall be delivered to said Treasurer and the proceeds thereof shall be utilized by said Treasurer in the payment (by treasurer's checks or warrants) of the respective items to the respective persons indicated as respectively entitled thereto in the pay roll demand pursuant to which the same was issued. The reference to one demand and warrant above made shall not be construed to prevent the City Clerk from preparing more than one demand and warrant in those cases where the division of a pay roll may be desirable or indicated from an accounting or administrative standpoint, it being the intention ?_ i herein to simplify rather than complicate pay roll procedure and payment in accordance with good accounting practice. In dispensing or disbursing the proceeds ar such pay roll warrants, the Treasurer shall take from each of the respective persons named in the respective pay roll demands to which such respective pay roll warrants relate, written receipts or vouchers for the disbursements or payments made by such Treasurer to such respective persons thereunder. The Treasurer's check properly endorsed by the payee thereof shall be a sufficient receipt or voucher for the disbursement or payment represented by such check. SECTION 4. That all claims and demands against said city, before final action thereon by the City Council, shall be examined by the Finance Committee of said Council. SECTION 5. That all ordinances and parts of ordi- Dances (including Ordinance No. 145 of said city) in conflict herewith and all resolutions and parts of resolutions in con.. fliot herewith, are hereby repealed; provided, however, that nothing herein contained shall be construed to interfere with or affect the validity of any warrants, claims or demands pre. sented, audited, approved and /or paid prior to the effective date of this ordinance, as all such warrants, claims and demands and the payment of same respectively are hereby approved, ratified and confirmed as of their respective dates of allowance and payment. SECTION 6. That this ordinance shall take effect and be in full force on and after the lot day of January, 1948. SECTION 7. That the City Clerk shall certify to the passage and adoption of this ordinance, and shall cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and 3- jI circulated within said city, and which is hereby designated for that purpose.
