ORDINANCE 276ORDINANCE NO. 276 . AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, GIVING AND GRANTING THE CONSENT OF SAID CITY TO THE INSTALLATION AND MAIN- TENANCE OF CERTAIN WATER SERVICE CONNECTIONS WITHIN SAID CITY OF EL SEGUNDO, BY THE DEPARTMENT OF WATER AND POWER OF THE CITY OF LOS ANGELES, IN AND ACROSS CERTAIN OF THE PUBLIC STREETS WITHIN SAID CITY OF EL SEGUNDO. WHEREAS, North American Aviation, Inc., a Corporation, engaged in the filling of defense orders for the Government of the United States of America, has certain facilities within the City of El Segundo which are located upon the real property hereinafter described, and which require water service; AND, WHEREAS, the City of El Segundo does not at this particular time have the necessary facilities adjacent or near said real property to furnish the water service required; AND, WHEREAS, North American Aviation, Inc. has i made application to the City of Los Angeles, through its Department of Water and Power, to supply it with the water service required and to install and maintain the service connections, mains and facilities necessary to enable it to do so, and has requested the City Council of the City of E1 Segundo to consent thereto, and by such consent to authorize the City of Los Angeles through its said Depart- ment of Water and Power to install the necessary connections, mains and facilities and to supply the said corporation with the required water service; 1•• NOW, THEREFORE, the City Council of the City of El Segundo, California, does ordain as follows: SECTION 1. That the City of Los Angeles, through the Department of 'dater and Power of said City of Los Angeles, is hereby granted permission, right and authority to install water service mains and connections, together with their necessary and convenient appurtenances from the facilities of said City of Los Angeles (as such facilities now exist or may hereafter be installed) to the facilities of said North American Aviation, Inc., on the real property hereinafter described in the City of E1 Segundo, requiring such service, and to thereafter maintain, repair, replace and remove said water service mains, connections and their appurtenances, and furnish water service through the same. The facilities of said North American Aviation, Inc., here- in referred to, are located on that certain real property situated in the City of E1 Segundo, County of Los Angeles, State of California, and are described as follows, to -wit: The South 1000.00 Feet of the North 1040.00 Feet of the West 1300.00 Feet of the East 1350.00 Feet of the North West Quarter of Section 7, Township 3 South, Range 14 West, in the Rancho Sausal Redondo, as recorded in Book 1, page 507 of Patents, Records of the County of Los Angeles, State of California. SECTION 2. That the City Council of the City of El Segundo, on behalf of said City of E1 Segundo, by the adoption of this ordinance, does hereby consent to such installation, maintenance, repair, replacement, removal and use of such water service mains and connections, and their said appurtenances, and to the service of water through the same to said premises within said City, for all purposes. The authority herein granted is granted as to all portions of all the public streets of said City of E1 Segundo, 2- which may be necessary or convenient to be used in install- ing and maintaining such water service mains, connections and appurtenances, and in providing the water service to said premises and property as hereinabove contemplated. SECTION 3. That the consent, permission and authority granted by this ordinance is granted upon and subject to each and all of the following terms and conditions: First: That the permittee shall give twenty - four hours notice of intention to excavate in any of said public streets to the Street Superintendent of the City of E1 Segundo, stating the location and extent of the proposed excavation and the installa- tions to be made therein. Second: That all work shall be properly and adequately protected by barriers and lights during the progress thereof, so as to protect persons and property from injury so far as reasonably possible. Third: That all work shall be performed with due diligence, to the end that the public may be inconvenienced as little as reasonably possible in the use of such streets. Fourth: That all street surfaces disturbed must be replaced with surfacing of like type and character as that disturbed, and to the satisfaction of the Street Superintendent of the City of E1 Segundo, and the permittee shall promptly report any damage to any such street or streets which may be occasioned thereto by reason of the exercise by permittee of any of the rights or authority herein granted. Fifth: That the authority and permission herein granted and the consent herein given may be revoked at any time by the City Council of the City of 3- El Segundo, upon one year's written notice to the City of Los Angeles, through the Department of Water and Power of said City of Los Angeles, and to said North American Aviation, Inc.. SECTION 4. That this ordinance is an ordinance affecting the public peace, health and safety of said City and the same shall therefore take effect and be in full force and virtue immediately upon the final passage and adoption thereof. The facts constituting its urgency are as follows: That said North American Aviation, Inc. has a large airplane manufacturing plant in the City of E1 Segundo. Under existing war conditions it is essential that such facilities be provided with water service for all purposes at the earliest possible moment, in order that the defense efforts of the Federal Government of the United States of America may not be interfered with, and this ordinance is therefore accordingly adopted, to take effect immediately. SECTION 5. That the City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and circulated within the said City of El Segundo, and which is hereby designated for that purpose.
