ORDINANCE 259`f1 ORDINANCE NO. 259. AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, MAKING CERTAIN REGULATIONS RELATING TO PUBLIC PARKS AND THE USE THEREOF WITHIN SAID CITY. The City Council of the City of E1 Segundo, California, does ordain as follows: SECTION 1. That the following rules and regu- lations relating to public parks and the use of public parks within the City of El Segundo, California, are hereby established, to -wit: RULE NO. 1: No company, society, organization, gathering ' or group of more than twenty -five persons shall hold i or conduct any picnio, celebration, service, exercise, gathering, assembly or meeting in any public park within the City of E1 Segundo without first obtaining a written permit so to do from the City Council of said City, and no person shall attend, take part in, or be a participant in any such picnic, celebration, service, exercise, gathering, assembly or meeting in any such public park, unless such permission shall have been first obtained. RULE N0, 2: No company, society, organization, gathering or group of less than twenty -five persons, desiring the use of picnic tables, stoves, cooking facilities or grounds, located in that certain public park, commonly designated and known as "Grand Avenue Park" within said City, shall make any such use, without first making application therefor to the Police Department of said City, at 205 West Franklin Avenue 1- Council held after the filing of the same, but applicants are cautioned that such applications should be made at least twenty -four hours before the regular meeting of the City Council, at which the same is to be presented. RULE N0. 6: Any person, company, society, organization, gathering or group desiring any permit required under the provisions of Rule No. 2 above set forth, shall make application therefor in writing to said Police Department at least twenty -four hours prior to the time the use requested in the application is to be made. Each such application shall state, in addition to any other information which may be requested: (a) The purpose for which such permit is requested: (b) The day and the hours between which the use for which permit is sought, will be made; and (e) A truthful estimate of the number of persons anticipated to be present,. and the name of the person, company, society, organization, gathering or group to whom such permit is to be issued, if granted. The Police Department shall promptly consider each such application and may issue or refuse to issue any such permit, as the circumstances and other re- servations, or pending reservations for similar use or uses, may indicate or justify. SECTION 2. It is provided, however, that the provisions of this ordinance and the rules and regulations therein set forth, shall not apply to the officers and ems ployees of said City lawfully in any such public park who at the time are actually engaged in the discharge of their official duties, or to members of the armed forces of the 3- ___j j United States of America. SECTION 3. That, except as hereinabove provided, any person, company, society, organization, gathering or group violating any of the provisions of this ordinance, or any of the provisions of the rules or regulations here- inabove set forth in Section 1 of this ordinance, shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not to exceed three hundred dollars ($300.00) or by imprisonment in the City Jail of said City of El Segundo, California, or in the County Jail of Los Angeles County, California, as the committing magistrate may direct, for a period of not to exceed three months, or by both such fine and imprisonment in the discretion of the Court. SECTION 4. That this ordinance is an emergency ordinance, affecting the public peace, health, safety, comfort, convenience and general Welfare of said City, and the same shall therefore take effect immediately upon the final passage and adoption thereof. The facts constituting its urgency are as follows: The United States of America is now engaged in a war with the so- called "Axis Powers", and it is essential and necessary in order to preserve and protect the public peace, health, safety, comfort, convenience and general welfare of said City, that the rules and regulations hereinabove es- tablished should take effect immediately, in view of the location of the public parks within said City, and their proximity to essential municipal properties and facilities. SECTION 5. That the City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the E1 Segundo 4, Herald, a weekly newspaper of general circulation printed, published and circulated within the said City and hereby designated for that purpose. RULE N0, 3: No person shall remain, stay in, loiter or be in any public park within said City of El Segundo during the period commencing one hour after sundown on any day, and ending one hour before sunrise of the following day. RULE N0. 4: That the cooking or preparation of food, the holding of picnio parties, box luncheon parties, or similar assemblies or gatherings in that certain public park generally designated and commonly known and referred to as "Library Park" within said City, are, and each of such acts is, hereby prohibited. RULE N0. 5: Any person, company, society, organization, gathering or group desiring any permit required under the provisions of Rule No. 1 above set forth shall make application therefor in writing to be filed with the City Clerk of said City, which said application shall state, in addition to any other Information which may be required: (a) The purpose for which such permit is requested; (b) The day and the hours between which the use for which permit is sought, will be made; and (c) A truthful estimate of the number of persons anticipated to be present and the name of the person, company, society, organization, gathering or group to whom such permit is to be issued, if granted. The City Clerk shall present any such application to the City Council at the next regular meeting of said 2.. __
