AN ORDINANCE OF THE CITY OF EL SEGUNDO,
CALIFORNIA, REGULATING FIRES ON OR IMMEDIATELY
ADJACENT TO THE OCEAN BEACH WITHIN SAID CITY.
The City Council of the City of 31 Segundo,
California, does ordain as follows:
SECTION 1. That it shall be unlawful for any
person to light, ignite or start or maintain, or permit to
be lighted, ignited, started or maintained, any open fire,
or any fire the light of which is visible, in, upon or about
any public or private beach within said city, or immediately
adjacent to any such beach, without first having procured a
permit in writing from the Chief of Police of said City so
to do.
Any person desiring any such permit shall make
written application to the Chief of Police of said City
therefor, stating the location and character of such pro-
posed fire and the purpose or reason for the same. The
Chief of Police may grant such permit subject to such terms
and conditions as in his opinion may be necessary in order
to preserve and protect the public peace, health and safety
of said City, and may refuse to grant the same in the event
that the granting of any such permit in his opinion would
adversely affect such public peace, health and safety. It
is provided, however, that the Chief of Police shall not
issue any such permit during any time or period that the
United States of America is at war with any foreign power,
unless by further written consent of the City Council of
said City first had and obtained.
SECTION 2. Any person, firm or corporation
violating any of the provisions of this ordinance, shall be
deemed guilty of a misdemeanor, and upon conviction thereof

shall be punished by a fine not exceeding $300.00, or
by imprisonment in the County Jail of Los Angeles County,
California, or in the City Jail of said City of E1 Segundo,
California, as the committing magistrate may direct, for a
period of not to exceed three months, or by both such fine
and imprisonment in the discretion of the Court.
SECTION 3. That this ordinance is an emergency
ordinance affecting the public peace, health and safety
and general welfare of said City, and the same shall there-
fore take effect immediately upon the final passage and
adoption thereof. The facts constituting its urgency are
as follows:
The Government of the United States of America
is now at war with the so- called Axis Powers, and the
lighting or maintaining of fires upon the public or private
beaches within said City, or the lighting or maintaining of
fires which are visible in or upon such public or private
beaches would be a distinct menace to the said City and
the inhabitants thereof, and to the Government of the
United States of America in its war effort, and it is
therefore essential that any and all such fires be regu-
lated and controlled in order to combat and avoid such
menace.
SECTION 4. That the City Clerk shall certify
to the passage and adoption of this ordinance and shall
cause the same to be published by one insertion in the
El Segundo Herald, a weekly newspaper of general oireu-
lation, published and circulated within the said City
and hereby designated for that purpose.
