ORDINANCE 236ORDINANCE NO. 236. AN ORDINJ4NCL OF THE CITY OF EL SEGUNDO, CAT MRNIA, REGULATING TIC ESTABLISBUENT AND OPERATION OF REST HOMES, BOARDING HOMES, HOSPITALS, SANITARIUMS OR SANITORIUMS IN SAID CITY, AND FIXING A PENALTY FOR THE VIOLATION THEREOF. The City Council of the City of E1 Segundo, California, does ordain as follows: SECTION 1. That for the purposes of this ordinance a rest home, boarding home, hospital, sanitarium or sanitorium is hereby defined to be any institution, place or premise used for the reception or care, temporary or continuous,of one or more sick, injured, aged, feeble, helpless or dependent persons, or used or maintained for the treatment and care of one or more persons suffering or afflicted with any mental or physical disease or bodily injury, not including, however, any private home or private residence used for the care of any member of the family occu- pying such private home or residence. SECTION 2. That it shall be unlawful for any person, firm, association or corporation to establish, maintain or conduct, keep open or manage any rest home, boarding home, hospital, sanitarium or sanitorium, as defined in this ordinance, within the corporate limits of the City of El Segundo, California, without first having obtained a permit in writing from the City Council of said City so to do as hereinafter provided. SECTION 3. Any person, firm, association or cor- poration desiring a permit under the provisions of Section 1 1- <551 :J 1 552 of this ordinance, shall make written application there- for and shall file such application with the City Clerk of said City. Such application shall set forth the correct name and address of the applicant; the exact location, giving street number, if any, and the legal description, of the premises upon which the rest home, boarding home, hospital, sanitarium or sanitorium is pro- posed to be established and maintained; the maximum number of persons who will be cared for, boarded, treated or main- tained in such rest home, boarding home, hospital, sanitarium, sanitorium or institution; the purpose for which it is to be conducted or maintained; the accommodations for the inmates thereof, including a particular statement with re- ference to the sanitary facilities to be provided; the nature and kind of treatments to be given or proposed to be given therein; the name and address of the person who shall actually conduct and manage such rest home, boarding home, hospital, sanitarium, or sanitoriur.; and such further information or details as the City Council may require, Any such application shall be presented by the City Clerk to the City Council at the next regular meet- ing of such Council following the filing thereof. The City Council may thereupon make such investigation as such Council in its discretion may deem necessary or advisable, and may grant any such permit subject to such terms and conditions as said Council may prescribe, or may refuse to grant any such permit. The City Council may hold a hearing or hearings on any application hereunder and the decision of said Council upon any such application after hearing shall be final and conclusive. SECTION 4. Every rest home, boarding home, hos- pital, sanitarium or sanitorium, conducted, maintained 2- a53 or managed by any person, firm, association or cor- poration, under the provisions of this ordinance, shall at all reasonable times be open to the inspection of the health officer of said City, or by any person duly appointed by said City Council to make such inspection; and said City Council is empowered hereby to inspect the same, or cause inspection to be made, whenever and as often as they may deem proper. If upon any such in- spection said Council shall find any such rest home, boarding home, hospital, sanitarium or sanitorium to be conducted or maintained in violation of the terms of the application hereinbefore referred to, or in violation of any of the provisions of this ordinance, or of the permit granted hereunder, or in violation of any of the provisions of any of the laws of the State of California, or of the City of E1 Segundo, then such City Council shall revoke such permit issued to such person, firm, association or corporation for the conducting, managing and maintaining of such rest home, boarding home, hospital, sanitarium or sanitorium, or said City Council may revoke said permit for any other good and sufficient cause which in its discretion may seem necessary for the protection of the public peace, health, safety and comfort. SECTION 5. Isolation Doom. Every such rest home, boarding home, hospital, sanitarium or sanitorium wherein ten (10) or more patients are housed shall be equipped with a separate room or space for isolation purposes, which shall be equipped with a separate toilet and bath. SECTION 6. Sleeping Quarters. No person shall be kept, cared for, or maintained as a patient in any room or ward in any rest home, boarding home, hospital, sanitar- ium or sanitorium which provides less than five hundred 3- a weekly newspaper of general circulation, printed, pub- lished and circulated within the said City of E1 Segundo, and which is hereby designated for that purpose. SECTION 19. That this ordinance shall become effective at midnight on the thirtieth day from and after the date of the final passage and adoption thereof. Beds shall be maintained at least three (3) feet apart. SECTION 7. Patients' utensils. All bedpans, urinals, and other utensils used for patients and inmates shall be free from cracks or chips. They shall be properly cleansed and sterilized immediately after use. SECTION 8. Toilets. Toilet and utility rooms shall be provided for all bed patients. Where ten (10) or more ambulatory patients or inmates are cared for or housed there shall be provided at least one (1) toilet, two (2) lavatories, and two (2) baths or showers for each ten (10), or fractional part thereof, patients of each sex. All toilet rooms, lavatories, baths and showers shall be main- tained free from any accumulation of dirt, filth, or corrosion. SECTION 9. Sanitation of Rooms. All walls, floors, ceilings, woodwork, curtains and furnishing shall be main- tained in a good, clean, sanitary condition, free from the accumulation of dirt and filth, and every room shall be provided with adequate ventilation, lighting and heat. SECTION 10. Protection of Heaters. A barrier or other protection shall be placed around each stove or fire- place, and gas space heaters must be connected to the supply line with a continuous metal pipe. SECTION 11. Screens. All windows and doors shall be screened and maintained in good condition so as to ex- elude flies and other insects. SECTION 12. Linen and Bedding. There shall be maintained an adequate amount of bedding, linen, hand and 4- t555 bath towels, in good, clean condition, and each bed shall be supplied with good springs and a clean, comfortable mattress; and all beds and mattresses shall be kept in a sanitary condition and shall be thoroughly cleaned before being used by another person. SECTION 13. Kitchen and Food. Every kitchen shall be adequately lighted, provided with suitable plumb- ing, and ventilated, and conducted with strict regard to the influence of such conditions upon the health of the operators, employees, or other persons therein employed, and the purity and wholesomeness of the food therein pre- pared, served, kept, handled or stored. The term "food" shall include all articles used for food and drink, and all substances and ingredients used for the preparation thereof. All dishes, glasses and implements used in the preparation or serving of food shall be thoroughly cleaned and sterilized after each use. All such utensils shall be free from cracks or chips of any kind. The floors, side walls, ceilings, fixtures, receptacles, utensils, sink drainboards, implements, dishes and machinery in every kitchen or place where food is prepares, served, kept, handled or stored shall be kept in a healthful and sanitary condition. Unhealthful or unsanitary conditions shall be deemed to exist if food in process of preparation, handling, or storing is not securely protected from flies, dirt, dust and other poisonous or contaminating influences. The sine walls and ceilings of every kitchen shall be well plastered and painted, and kept clean with soap and water, or otherwise kept in a sanitary condition. Every kitchen shall have an impermeable floor which can be flushed or washed with water. 5- 1 -556 SECTION 14. Drugs in Kitchen. No drugs, medicines, or poisonous insecticides shall be kept in the kitchen. SECTION 15. Kitchen Workers. No owner or employer shall require, permit or suffer any person to work, nor shall any person work, in a kitchen where food is prepared, served, kept, handled or stored, who is afflicted with any infectious or contagious disease. SECTION 16. Garbage. All garbage and kitchen wastes must be kept in a tight, flyproof, metal container, and removed from the premises and disposed of in a sani- tary manner at reasonably frequent intervals. SECTION 17. That any person, firm or corpora- tion violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed $300.00, or by imprisonment in the City Jail of the City of El Segundo, California, or in the County Sail of Los Angeles County, California, as the committing magistrate may direct, for a period of not to exceed three months, or by both such fine and imprisonment in the discretion of the Court. Each such person shall be deemed guilty of a separate offense for every day during any portion of which any violation of any provision of this ordinance is com- mitted, continued or permitted by such person, and shall be punishable therefor as provided by this ordinance.
