ORDINANCE 217A ORDINANCE NO. 217 . AN ORDINANCE OF THE CITY OF EL SEGUNDO.. CALIFORNIA, ESTABLISHING CERTAIN HEALTH AND SANITARY REGULATIONS WITHIN SAID CITY, AND PROVIDING FOR THE ENFORCEMENT THEREOF. The City Council of the City of E1 Segundo, California, does ordain as follows: ARTICLE I. DEFINITIONS, APPLICATIONS AND ENFORCEMENT. SECTION 1. DEFINITIONS: That for the purposes of this ordinance, the word "person" shall be construed to include an individual, firm, co- partnership, association or corporation, whether acting as principal or agent, clerk, employee or servant, either for or on behalf of himself or for any other person, firm, association, co- partnership or corporation, or otherwise. Words used in the singular include the plural and in the plural the singular. Words used in the present tense include the past and future tenses. That for the purposes of this ordinance, the term "Health Officer" shall be construed to include any of his assistants, deputies, inspectors or any other official re- presentatives or members of the Health Officer's staff. SECTION 2. APPLICATION: The provisions of this ordinance shall apply to all territory within the corporate limits of the City of E1 Segundo, California, hereinafter called the "City ". SECTION 3. ENFORCEMENT: It shall be the duty of the Health Officer to enforce all of the provisions of this 1- 1 /150 1/152 to the satisfaction of said Health Officer of any violation, by the holder of any such permit, of any law or ordinance, and any person who operates or conducts said business in the said City during the time when his permit shall have been suspended or revoked shall be guilty of a violation of the provisions hereof; HEARING Provided, further, that no such permit shall be suspended or revoked until a hearing shall have been held by said Health Officer in the matter of the suspension or revocation of such permit at which hearing such permittee may be present. Notice of such hearing shall be given by said Health Officer in writing and served upon the holder of such permit not less than five (5) days prior to the date of such hearing, which notice shall state the ground of complaint against such permittee and shall also state the time when and the place where such hearing will be had. Such notice shall be served on such permittee by delivering the same to such permittee or his manager or agent, or to any person in charge of or employed in such business, or by leaving such notice at the place of business or residence of such permittee with some person of suitable age and dis- cretion. If such notice for any reason shall not be served as hereinabove in this section provided, then a copy of such notice shall be mailed, postage prepaid, addressed to such permittee at such place of business or his last known residence, not less than five (5) days prior to the date of such hearing. SECTION 7. RENEWAL OF PERMITS: Such permit shall be valid from the date thereof, until revoked, unless the same is sooner revoked or suspended as herein provided, or unless the holder of such permit changes the location 3- 1/153 of his place of business, or sells, or otherwise disposes of such business, or ceases for a period of thirty (30) consecutive days to carry on such business, or materially changes the character of such business. Upon the expiration of any such permit and within seven (7) days thereafter, the person conducting or operating such business or vehicle shall, apply for and secure a renewal thereof in the same manner and upon the payment of such fee, if any, as may be required by this or any other ordinance of said City. Each permit shall at all times be kept posted and displayed in a conspicuous place in or about such place of business, premises or vehicles. SECTION 8. OTHER LICENSES: No license under any license ordinance of the City shall be issued to any person owning or operating any business which is required to have a permit under Section 9 hereof, unless such permit shall have first been granted by said Health Officer. It shall be the duty of said Health Officer, immediately upon the granting of such permit, to forward the same to the person making application therefor and to file with the City Clerk a duplicate copy thereof. SECTION 9. PERMITS REQUIRED& Permits shall be required of the following businesses or occupations: (a) All establishments or persons selling or offering for sale, serving or preparing, or manu- facturing food in any form. (b) Poultry markets and poultry slaughtering establishments. (c) Vendors of meat, fish and other food products. (d) Dairies, wholesale and retail milk distri- butors, milk plants, ice cream factories, cheese fac- tories, and any other establishments handling milk or dairy products. 4- 1/,154 (e) Drug distributors, vendors or salesmen; provided, however,that this section shall not apply to established drug stores, or pharmacies, operating from a permanent location, nor to salesmen dealing directly with physicians, surgeons, dentists or druggists. (f) Persons cleaning and sterilizing or dealing in second -hand bottles, glassware and crockery. (g), Public swimming pools. (h) Public dumps. (i) Operators of wells, springs, reservoirs, tanks, or piping from which any water is being pumped or drawn or in which water is being stored, which is being used or intended to be used for public domestic consumption. (j) Hospitals, sanitoriums, sanitariums, rest homes, convalescent homes, maternity hospitals, lying - in asylums. (k) Dag nurseries, boarding houses, boarding schools, or other places for the reception and care of children. (1) Beer coil cleaners. (m) Cesspool cleaners. (n) Hotels, rooming houses or lodging houses, or anyone renting out for sleeping purposes any rooms, lodging or sleeping places; provided, however, that such permit shall not be required unless two or more rooms are so rented in a given building or dwelling, except where three or more persons are accommodated in any one room. (o) Operators of camp grounds, trailer camps, auto camps, or tent camp courts or spaces. 5- SECTION 10. That this ordinance shall take effect and be in full force and virtue thirty days from and after the date of the final passage and adoption thereof. SECTION 11. That any person, firm, association or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine not exceed- Ing Three Hundred Dollars ($300.00) or by imprisonment for not more than three months in either the City Jail of the City of E1 Segundo, California, or the County Jail of the County of Los Angeles, California, as the committing magis- trate may direct, or by both such fine and imprisonment in the discretion of the court, and each and every calendar day during which any violation of this ordinance shall con- tinue, shall be considered and deemed a new and separate offense. SECTION 12. That the City Clerk shall certify to the passage and adoption of this ordinance, and shall cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and circulated within the said City and which is hereby designated for that purpose.
