ORDINANCE NO. 188 .
AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA,
CREATING THE OFFICE OF POUND MASTER IN AND FOR
SAID CITY AND PRESCRIBING THE DUTIES OF S U5H POMgD
MASTER; CREATING A PUBLIC POUND FOR SAID CITr AHD
REGULATING THE MA]UGEMENT THEREOF; REGULATING THE
SEEPING, RUNNING AT LARGE AHD IMPOUNDING OF DOCKS
AND OTHER ANNALS AHD OF FOWLS WITEIN SAID CITY;
PROVIDING FOR THE LICENSING OF DOGS THEREIN AND
REPEALING ORDINAMMS IN CONFLICT THEREWITH.

The City Council of the City of El Segundo,
_
California, do ordain as follows:
SECTION 1. That a public pound for the City
Of E1 Segundo, California, for the impounding of animals
shall be and the same is hereby authorized and such public
pound is hereby created and established. Said public pound
shall be maintained at such place or places as the City
Council of said city may from time to time hereafter by
resolution of such Council determine.
SECTION E. That the office of pound master of the
City of BI Segundo, California, shall be and the was is
hereby created, The pound master shall be appointed by and
hold his office during the pleasure of the City Council of
said city. It shall be the duty of the pound master to make
investigations concerning, take up, receive into said pound,
maintain therein and release, discharge or dispose of, there.

street,

lane,
alley,
park, square,
sidewalk
or any
other public
place

said city, or which
shall be staked out or fastened in such a manner that they

can go or enter into or upon any such public highway,
- street, avenue, way, lane, alley, park, square, sidewalk
or other public place within said city, or which may be
delivered to such pound master by any person under the
provisions of this ordinance, or which may be on private
premises within said city, but which are nevertheless
subject to impoundment or disposal under the provisions
of this ordinance; provided however, that the provisions
of this section shall not apply to dogs which are properly
licensed and wearing current license tags under the
ordinances of said city relating thereto, excepting in
quarantined areas during periods of quarantine for rabies
declared under arty law of the state of California, or
ordinance or resolution of the said City of El 3egando,
or order of the health officer or health department of
said city or department or officer performing health
functions for said city, nor shall the provisions of
this section apply to animals lawfully upon any such
public highway, street, roadway, road, avenue, way, lane,
alley, park, square, sidewalk or other public place and
which are temporarily hitohed to hitching weights, devices
or posts at the curb or side of any such public highway,
avenue, way, 1 arse , park, square, sidewalk, road, roadway,
street, alley or place.

person owning or having possession, charge, custody or
control of any animal to cause or permit or allow the
same to stray, or rrm, or in any other manner to be, at
large, in or upon any public highway, street, avenue,
roadway,
road,
way, lane,
alley, park,
square, sidewalk
or other
public
place in
the City of E1
3egmndo, California,
or in or upon any uninolosed lot, land or premises, aer to

stake out, or herd, or graze, any animal upon any un-
inolosed lot, land or premises in such manner that the
rope or other attachment by which same is tethered may
permit it to be or to go beyond the boundary of such
lot, land or premises, providing that the provisions
of this section shall not apply in the case of licensed
dogs, except as in this ordinance o the rwise provided.
Tor shall such provisions apply in the case of animals
lawfully upon any suah public highway, street, road,
roadway, avenue, way, lane, alley, park, square, sidewalk
or other public place and which are temporarily hitched
to hitching weights, devices or posts at the curb or
side of the highway, road, roadway, street, lane, park,
square, sidewalk, way, avenue, alley or place, or which
are o*erwise located therein and provided for the purpose.
SECTION 4. That any animal bund trespassing
upon any private ground or premises within said city,
may be taken up by the party owning, controlling or
having possession of such ground or promises, or by the
agent or representative of such person, and committed to
-, the pound master to be dealt with as provided in this
o rdinanoe; and likewise the pound master may enter upon
any private property, ground or premises within said city
in actual pursuit of ashy animal which said pound master
may be pursuing at the time under any of the provisions
of this ordinance. Any person taking up any such astray
animal found running at large or trespassing upon any
property, ground or premises owned, controlled or in
possession of such person, shall promptly notify the
pound master of such taking up and it shall be unlawful
for any such person to fail or refuse to surrender such

animal to ad d pound master or his duly authorized
representative upon demand therefor.
SECTION 5. That the pound master shall keep
a fall, true sad correct record of all animals taken,
received and impounded, the date of such impounding,
and the date and manner of their release, discharge or
disposal, and shall keep conspicuously posted, at the
entrance to the pound, a list of all animals therein
contained, together with a brief description of each of
.� such animals at all times during which such animals
remain in such pound. The pound master shall also provide
the necessary subsistence and shall properly care for all
animals while in his oustody, and the costs of such
subsistence and /or care shall be a charge against and
paid by said city, unless otherwise specified in any
contract which may be awarded for such pound service
as hereinafter contemplated, in which case the costs
thereof sha11 be paid and discharged as contemplated
in such contract.
SECTION 6. That when any animal or animals
are 'so impounded, the pound master shall at once advertise
the same by posting, or causing to be posted, notices in
three public places in the City of El Segundo, which said
no tioes shall contain a description of the animal or ani-
male so impounded and if the animal cLesoribed in much
notice be any animal other than a horse, mare, oolt, goat,
sheep, cow, mule, jack, jenny, ass, bull, ox, steer or
calf, shall not forth that unless the same are reclaimed
within three days from the date of said notice (which
said elate shall be the date of posting thereof) said,
animal or animals will be sold to the highest bidder at ,

public auction at a time and place in said notice
specified. A copy of said notice shall be posted at
the entrance to said pound; the second copy thereof
shall be posted on the bulletin board at the City Hall;
and a third copy thereof in some conspicuous public
place to be selected by the pound master; and a fourth
copy thereof shall be delivered to the owner or omers
if known. When any animal or animals, excepting horses,
mares, colts, goats, sheep, cove, mules, jacks, jennies,
asses, bulls, oxen, steers or calves, so impounded and

advertised are not reclaimed within the three days time
specified in said notices, the pound master shall proceed
to offer the sore for wale at the time and in the place
and in the manner a peoi Pied in said notices. In the
event that there should be no bidder or bidders at such
sale, then and at any time prior to actual disposal of
such animal or animals otherwise, the pound master may
sell or dispose of such animal to such person or persons
as may apply therefor at such price or for such considers -
s tion as to said pound master shall seem proper affi in
the absence of any such sale or disposition it shall be
the duty of said pound master to cause such animal or
animals to be killed or disposed of in some humane manner;
provided however, that nothing herein contained shall

be construed as rendering said city liable for the care
o r of maintenance of any snob animal or animals beyond said
three days impoundment nor shall anything herein con-
tained be construed as prohibiting the redemption of
any such animal o r animals pri o r t o the ac teal se's a or
other di spo ,sal thereof. In case the animal impounded
be a horse, mare, colt, goat, sheep, cow, mule, jack,
jenny, ass, bull, ox, steer o r calf, then and in all

such cases the pound master shall add four days time
to the three days period of impoundment above provided
for in the case of other animals. In the event the re
are no redemptione;q purohasers or bidders for any such
impounded animal, the pound master shall cause such
' animal to be humanely disposed of in such humane ma=r
as under the oircumstanoes at the time shall appear to
be best.
SECTION 7. That the owner or any person en•-
... titled to the control of any animal or animals impounded
shall have the right to reclaim the some at any time
prior to the sale or other actual disposal thereof upon
payment to the pound master of the costs and charges
hereinafter provided for.
SECTION 8. That the pound master shall collect
from the o -mer or ovne rs of all animals impounded the
following fees for impounding and keeping the same, to -wit:
For every horse, mare, colt, goat, sheep, oow,
mule, jack, jenny, ass, bull, ox, steer or calf impounded
by him,, the sum of $1.00 as an impounding fee and the fur-
__ ther sum of 501 per day for each day such animal is
necessarily held in saoh pound.
For every dog impounded by him, the sum of $1.00
and a farther charge of 250 per dw for each day any dog
so impounded is necessarily held in said pound. For all
L other animals, not hereinabove specifically mentioned,
impounded in such pound, said pound master shall collect
the sum of 504 as an impounding fee and ' in addi ti on
thereto the sum of 154 per day for each der such animal
is necessarily held in said pound.
SECTION 9. That whenever any animal is sold
as provided in and under the provisions of this ordinance,

the proceeds of such sale shall, unless otherwise provided
in any contract made as hereinafter provided for, be paid
into the City Treasury Of said city aid the owner of
such animal or animals so sold may at any time within
three months after sale, bring suit against the person,
firm or corporation who or which received the same in
any Court of proper jurisdiction to recover any surplus
there may be from the sale of said animal or animals
after deducting all costs and charges occasioned by
reason of the impounding and keeping of said animal or
animals.
. _ SECTION 10. That all money receiTed by said
pound master as fees and charges of every kind in conneo-
tion with the licensing, impounding, sale and /or keeping
of any animal or animals, unless otherwise provided in
the contract hereinafter provided for, shall be paid by
him into the City Treasury before noon on the Saturday
neat sucoseding the collection thereof.
SECTION 11. That the salary, compensation or
fees of the pound master shall be fixed by resolution of
the City Council of said city from time to time as oeoasion
may require and all expense of keeping, maintaining and
establishing said pound, unless otherwise provided for in
the contraot hereinafter referred to, shall be paid by
said city; and all claims therefor, unless provided
otherwise in such contract, shall be presented, allowed
mmd paid as other claims against said city are presented,
allowed and paid; provided, however, that as an alterna-
tive the City Council of said city may at its discretion
at any time hereafter, and from time ttr time hereafter,
and for such period as to said Council may seem proper,

appoint such person as said Council may designate as
pound master on a fi3s& monthly salary, or may advertise.
for bids for furnishing said city with such public pound
hersinabove referred to and for the performance of all
the duties of pound master in connection therewith in
the manner set forth in and contemplated by this ordinance,
including, if said Council shell so desire, the collec-
tion and issuance, by such pound master, of any license
or licenses hereunder. In the event that said Council
should acoept the bid of any bidder bidding thereon and
award the contract therefor to such bidder, then and in
that event the person so named in such bid and the con-
tract made pursuant thereto, shall be named and known,
for the period designated in such contraot am.d subject
to the provisions thereof, as the pound master of said
city end shall receive the compensation (for the furnish-
ing of such pound and the perf.ormanos of the other duties
of such pound master contemplated herein and referred to-
in such contract) therein set forth at the times and in
the manner therein oontemplated, and the public pound of
said City shall in such case be maintained at the place
or places indicated in such contract and in the resolution
awarding the same, or at such place cc places thereafter
as the parties to said contract may mutually agree upon.
Should said Council advertise for arch bids, the notioe
oalling therefor msy permit the bidders to state in their
respective bide either a definite sum ps r month f or the
furnishing of said pound and the pe rfo mnance of such
duties, services sad functions of such pound master as
contemplated by this ordinance, or the percentage of the
fees collected for dog licenses which such bidders will
charge said city in lien of a fixed sum per month for the

diligent and faithful performance of all sunk duties,
services and functions and the famishing of such pound.
In
cases contract be
awarded however, and
regardless
of
the basis of award,
all moneys collected
on dog
licenses must be turned in to the Treasury of said city
and proper demands for such proportion thereof as may be
specified in each contract mast be presented, audited axes
allowed as in all other cases of demands against said
city regardless of whether the award is based upon a
,...._ fixed compensation per month or upon a percentage basis
aae above indicated.
SECTION 12. That the word "dog" as used in
this ordinance shall include male and female.
SECTION 13. That except as in this o rdinanoe
provided, it shall be unlawful for any person to have,
keep, maintain or harbor, vd thin. said City of El Segundo,
any dog, without first having obtained from said city an
annual license so to do upon the payment of the fee here -
inafter meat coned.
SECTION 14. That the license fee for keeping
and maintaining a dog in the said City of $1 Segundo is
hereby fixed as follows:
For every male dog the sun of $1.00 par year,-
and for every female dog the sum of $2.00 per year;
provided however, that, except as hereinafter pro-
vided, it shall not be necessary to procure a
license or pay a license fee hereunder for any
dog under the age of six months whether the same
be male or female. Each such license shall be
payable annually in advance on the first day of
April of each year, and shall expire at midnight

on the 31st day of March of the emoseding year;
and the fail amount of such license tax shall be
payable for any frao t ion of any such year. The
above fees shall also apply to spayed or unsexed
dogs, male or female.
It is further provided, however, that the above
license tax shall not apply to any dogs kept or maintained
exclusively in any dog kennel in said city, and not per-
mitted to run at large, but any person conducting, managing
or maintaining a dog kennel, as hereinafter defined, shall
pay to said city for the privilege of conducting or main-
taining such dog kennel, a fee of $6.00 per annum for
e ach kennel.
For the purpose of this ordinazoe a kennel shall
be deemed to be and is hereby defined as any lot, building,
structure, enclosure or promises whereon or wherein four
or more dogs are kept or maintained for anq purpose;
provided, that no kennel license shall be issued runless a
written permit to have, maintain or operate amh kennel
is first obtained from the City Council of said city go-

SECTION 15. That the City Clerk shall each
year, at the expense of said city, prooure a suffioient
number of suitable metallic tags to meet the requirements
Of tiis ordinance, numbered from one (1) upward eonesou-
tively, on vhich tags shall be stamped the year of their
issue, and shall isera the .same to the pound master in
consecutive order as may be required, keeping an account
thereof. Said licerme tags shall be so marked that the
tag for a male dog is readily distinguishable from that
for a female dog by having the letter "M" for a male dog
