ORDINANCE 179ORDINANCE NO. 179 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORffLA CALLING A SPECIAL ELECTION TO BE HELD bCTOBER 29, 1931, WITHIN THE BOUNDARIES OF "ACT OF 1927 MUNICIPAL IMPROVMWT DISTRICT NO. 1 OF THE CITY OF EL SEGUND07 OF SAID CITY AS DESCRIBED HEREIN AND PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF SAID DISTRICT OF THE PROPOSITION OF ISSUING BONDS � OF SUCH DISTRICT IN THE AMOUNT OF $146,,816.00 TO PAY A PART OF THE COSTS AND EXPENSES OF ACQUIRING LANDS, RIGHTS OF MAY AND EASEMENTS NECESSARY IN ORDER TO WIDEN AND EXTEND THAT CERTAIN PUBLIC STREET COMMONLY KNOWN AS ARIZONA DRIVE BETWEEN COLLINGWOOD AVENUE. ( ALSO KNOWN AS IMPERIAL HIGHWAY) AND ROSECRANS AVENUE WITHIN SAID MUNICIPAL IMPROVEMENT DISTRICT, AND THE IM- PROVEMENT OF SAID S TREE T BY THE CONSTRUCTION AND COMPLETION UPON SAID STREET AS THE SAME MAY EXIST AFTER IT IS WIDENED AND EXTENDED OF CEMENT CONCRETE CURBS AND GUTTERS AND OF ASPHALTIC PAVEMENT FORTY FEET IN WIDTH ON A PORTION OF SAID STREET AMID THE IMPROVE3=T WITH OIL OR OIL MACADAM OF OTHER PORTIONS OF THE ROADWAY OF SAID STREET AND THE CONSTRUC- TION OF APPURTENANCES NECESSARY AND/OR CONVENIENT TO SAID IMPROVEMENT. VUEREAS, a petition was filed,in the office of the City Clerk of the City of El Segundo on June 5, 1931, request- ing that proceedings be taken in pursuance of an act of the legislature of the State of California, entitled "An Act to provide for the formation of districts within municipalities for the acquisition.or construction of public improvements,, works and public utilities; for the issuance, sale and pay- ment of bonds, of such districts to meet the costs of such improvements,- and for the acquisition or construction of such impro vemento "., approved May 24, 1927, as amended, for the purpose of creating an indebtedness, to be represented by bonds of said district to pay a part of the costs and expenses of acquiring lands, rights of way and easements necessary in order to widen and extend that certain public street commonly 4 c 1199 known as Arizona Drive between Collingwood Avenue (also knov+m as Imperial Highway) and Roseorans Avenues within said municipal improvement district,, and the improvement of said street by the construction and completion upon said street as the same may exist after it is widened and extended of cement concrete curbs and gutters and of asphaltic pave- ment forty feet in width on a portion of said street and the improvement with oil or oil macadam of other portions of the roadway of said street and the construction of appurtenances, necessary and /or convenient to said improvement _as therein and hereinafter more fully set forth, and said petition was signed by not less than 10% of the qualified electors residing within the territory proposed by said petition to be formed into a municipal improvement district under said act as shown by the certificate of the City Clerk; and TMREAS, in pursuance of said petition and of said act the City Council of said city on the 12th day of August, 1931 passed and adopted an ordinance designated as Ordinance No- 178,containing the matters prescribed by said act and declaring the intention of the City Council of said city to call an election in that part of the City of El Segundo, e:on- twined within the boundaries . o f said "Act of 1927 Municipal Improvement District No- 1, of the City of El Segundo" for the purpose of submitting to the qualified voters. of said district the proposition of authorizing the issuance and sale of bonds of said district in the manner provided for in said got and thereafter said ordinance was duly published =d posted as provided by law. and by the order of this City Council; and I VMPMAS, the hearing provided for in said Ordinance 2 -- 1201 No. 178 has been duly and regularly held and all protests and objections made have been overruled and said City Council at the time and place fixed for said hearing took evidence that all the property in the district would be benefited by the proposed improvement described in said C Ordinance No. 178, and took evidence regarding the publishing and posting of said ordinance and regarding the allegations of the petition and the genuineness of the signatures thereof, and upon all other matters upon which evidence is necessary, atmd the City Council of said city has, therefore, acquired jurisdiction to proceed further in accordance with the provisions of said act: NOW$ THEREFORE, the City Council of the City of El ' Segundo dp ordain as follows: Section 1. That a special election be held and the same is hereby called to be held on Thursday, the 29th day of October, 1931 within "Act of 1927 Municipal Improve- ment District No. 1. of the City of El Segundo ". The exterior boundaries of said diatriot are in said ordinance of intention and hereinafter described for the purpose of submitting to the qualified voters of said district the proposition of in- ourring an indebtedness by the issuame of the bonds of such district for the purposes set forth in said ordinance of in- tention and hereinafter stated. The exterior boundaries are particularly described as follows: Beginning at the northwest corner of the Northeast 1 /4.of Section 12, Tounehip 3 South, Range 15 West, San Bernardino Base and Meridian, 3. 9 said comer also being the point of inter- _____ section of the center line of Center Street with the northerly boundary line of the City of El Segundo .as said street is shown upon that map of C. C. Hunt's Subdivision recorded in Book 36, page 36 of Miscellaneous Records, Records of Los Angeles County and on file in the office of the County Recorder of said county; thence easterly along, the .northerly boundary line of the City of E1 Segundo to, the northeast corner of the Northwest 1/4 of Section 7, Township 3 South, Range 14 Test, San Bernardino Base and Meridian; thence southerly in a straight line across Section 7.and Section 18, Township 3 South, flange 14 West,, San Bernardino Base and Meridian and across intervening streets and avenues .to the southeast corner of the South- west 1/4.0f Section 18, Township 3 South, Range 14 West, San Bernardino Base and Meridian, said point being on the southerly boundary line of the City of E1 Segundo as the same now exists; thence westerly along the southerly .boundary line of said city to the southwest corner o f . the Southeast 1/4 of Section 13, Township 3 South, .- Range 15 Nest, San Bernardino Base and Meridian, said point also being on the; southerly line, of Lot 3, Tract 1314, recorded in Book 20, page 161 of Maps, records of Los Angeles County and on file in the office of the County Recorder of said County; thence northerly in a straight line across Section 13 to the northwest corner of the Northeast 1/.4 of said Section 13, Township 3 South, Range 15 nest, San Bernardino Base and Meridian, said point also being on the center line of Center Street as said street is shown upon, that map of E1 Segundo Sheet S. recorded in Book 22,, pages 106 aril 107 . o f Maps, Records of Los Angeles County and on file as afore- said; thence northerly along the center line of. Center Street, to the point of beginning. Section 2. That the objects and purposes for which the proposed indebtedness is to be incurred and the nature of the improvement work or public utility contemplated thereby are the acquiring of lands, rights of way and easements necessary in order to widen and extend that certain public street commonly known as Arizona Drive between Collingwood Avenue (also known as Imperial Highway) and RosecrmLe Avenue within said municipal improvement district, and the improvement of said street by the construction and completion upon said street as the same 4. 1203 may exist after it is widened and extended of cement concrete curbs and gutters and of an asphaltic pavement forty feet in width on a portion of said street and the improvement with oil and oil macadam of other portions of the roadway of said street and the construction of appurtenances necessary and /or convenient, to said improve- ment (a portion of the cost of said improvement as herein- after stated is to be met with state and /or county funds) and to pay the incidental expenses in connection therewith. Section 5. That the total estimated cost of said improvement is $257,166.00 and the estimated amount of incidental expenses in connection with said improvement is $13,000.00. That a portion of the cost of said improvement, to -wit, the sum of $123,350-00 350.00 is to be paid with state amd /or county funds, that the estimated cost of said proposed improve- went to said municipal improvement district is,, therefore, $133, 816.00, and the estimated amount of incidental expenses in connection with said improvement is $13,000.00, and that the amount of the principal, of the indebtedness proposed to, be incurred is the am of $146, 816.00, , and the maximum rate of interest to be paid on said indebtedness shall be 6% per annum payable semi - annually:; that if the proposition for in- ourring said indebtedness, so submitted, receives the requisite number of votes, to -wit, two - thirds of the votes of the qualified voters voting at said election,, then the legislative body of the City of El Segundo, to -wilt, the City Council of said city, shall be authorized and empowered to issue bonds of said district in the amount of Q','146,816.00. Section 4. That the polls at said election shall be open at six o'clock a. m. on the day of said election and must 5. be and remain open continuously from said time until seven p. m.. of the same day when the polls shall be closed, except and provided, however,. that if at the said hour of closing there are any vo ters An the polling place or in line at the entrance thereof, who are qualified to vote, and who have been unable .to do so since appearing, the polls shall be kept open a sufficient .length of time to enable them to vote, but no one who shall arrive at the polling place after seven o'clock p. m. of said day shall be entitled to vote, although, the polls may be open when such person shall arrive. The ballots to be used at said election shall, in addition to the other matters required by law, be printed in substantially the following form: Mark a c ro ss (X) on ballot ONLY WITH RUBBER STAMP: never with pen or pencil. All marks except the cross (g) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. Mhat for the purpose of holding said election said "Act of 1927 Municipal Improvement District No. 1 of the City of El Segundo" shall constitute one a lecti on precinct; that the polling place for said precinct shall be in the front room of the dwelling house at No. 645 California Street on the southwest corner of California Street and Palm Avenue within said district; that the following named parsons, being competent and qualified, electors of said district and said precinct, are hereby appointed to act as election officers at said election and shall hold and conduct said election and make returns thereof in the manner provided by law, said officers are designated inspector, judge and clerks, respectively, as follows: 7. That in all particulars not recited in this ordinanas said election shall be held and o on- ducted as provided by law for holding general elections in said City of El Segundo. Section 7. That the City Council of said City of El Segundo shall most and canvass the returns of saL d election at the usual place of meeting of said City Council in the City Hall of said city on November 2, 193L9 at the hour of 7 :15 o'clock p. m. Section 8. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of at least three - fifths of all the members of the City Council of said city and to its approval by the Mayor, of said oity, and shall cause the same to be published once i a week fo r' two weeks in the El Segundo Herald, a weekly newspaper printed, published amid circulated within said City of El Segundo, California, which newspaper is hereby designated for that purpose.
