ORDINANCE 1701148 OBDIbTANCF N0. 170 AN ORDINANCE tom' THE CITY OF EL SEGUNDO, CALIFORNIA, ESTABLISHING A PUBLIC LIBRARY -- IN AND FOR SAID MUNICIPALITY, AN'D PROVIDING FOR THE MANAGEMENT AND MAIN TENAYCE THEREOF. TMREAS, the City of E1 Segundo, Califomia,has heretofore been furnished with public library facilities by a branch of the Los Angeles County Free Library under the County Free Library System of said County; and, TMEiEAS, the City Council of said city has heretofore, and prior to the first day of July, 1930, notified the Board of Supervisors of said Bounty, as pro- vided by law, that said city no longer desires to be a part of said County Free Library System; and, WBEREAS, said City Council has in the manner provided by law, withdrawn said City of El Segundo from said County Free Library System as of the 30th day of June, A. D., 1930, at midnight; and, -- MHEREAS, the said El Segundo branch of said Los Angeles County Free Library has in fact been discontinued as of the 30th day of June, 1930 at midnight; and, WHEREAS, there is now no public library within said City of El Segundo; and, MWEAS, said City Council does elact to establish anal maintain in and for said city, a free library under, and pursuant to, the provisions of the act of the Legislature of the State of California, hereinafter referred to; NOW9 THEREFORE, the City Council of the City of El Segundo, California, do ordain as :bllovB V SECTION 1. That there be, and there is hereby, established in and for the City of El Segundo, California, 1- f a public library to be known as the "El Segundo Public Library. " ✓' SECTION 2. That the said public library harein and hereby established is so established, and shall be regulated and maintained, under the authority, and pur- suant to the provisions, of that certain act of the Legis- 1ature of the State of California, entitled, "An Act to Provide for the Establid mant and Maintenamce of Public Libraries within Municipalities" approved March 23, 1901, as amended. SECTION 3. Said public library shall be managed by a bo and which is and shall be designated as the "Board of Library Trustees of the City of El Segundo, Cali fo mia_. n Said board shall consist of five members to be appointed by the Mayor, by and with the consent of the City Council of said city. Such library trustees shall severally hold office for three years, serving as such trustees without compensation; provided, however, that the members of the first board appointed shall so classify themselves by lot that one of their number shall go out of office at the end of the current fiscal year, to -wait, June 30, 1931 at mid- night,, two at the end of one year thereafter, to -sit, June 30, 1932 at midnight, and the other two at the end of two years thereafter, to -wit, one 309 1933. Men and women shall be equally eligible to such an appointment, and vacancias shall be filled by appointment for the unexpired term (or new term, as the case may be) in the same manner. SECTION 4. Said board of library trustees shall meet at least once a month at such times and places as they may fix by resolution. Special meetings may be called at 2- IMAIR01 Ai5o any time by three trustees, by written notice served upon each member at least three hours before the time specified for the proposed meeting. A majority of the board shall constitute a quorum for the transaction of business. Said board shall appoint one of its number President, who shall serve for one year and until his successor is appointed, and in his absence shall select a Presida t pm tem. Said board shall eause a proper record of its proceedings to be ]opt. ✓SECTION 5. Said board of library trustees shall have power: First: To make and enforce all rules, regulations and by -laws necessary for the administration, government and protection of the library hereby established, and any branch thereof aril all property belonging thereto, which said library9 branches and property are hereby, as contem- plated by said act of the Legislature, placed under the management of said board of library trustees. Second: To administer any trust declared or created for said library, and receive by . gift, devise or bequest, and hold in trust or otherwise, property situated in this State or elsev&ere, sad where not otherwise provided, dispose of the same for the benefit of said library. Third: To prescribe the duties and povmrs of the librarian, secretary and other officers acrd employees of any s moh library; - to determine the number of aad appoint all such officers and employees, and to fix their oompensa- tion, which said officers and employees shall hold their offices or positions at the pleasure of said board of library trustees. Fourth: To purchase necessary books, journals, publications and other personal property. 3- Fifth: To purchase such real property, and erect or rent and equip such buildings or building, room or ro oma, as may be necessary, when in their judgment a suitable building, or portion thereof, has not been provided by the City Council of said city for said library. Sixth: To require the Secretary of State and other state officials to furnish said library with copies of any and all reports, laws and other publications of the State, not otherwise disposed of by law. -�-- Seventh: To borrow books from, lend books to, and exchange the same with other libraries, and to allow non- residents to borrow books upon such conditions as said board of library trustees may prescribe. Eighth: To do and perform any and all o the r acts and things necessary or proper to carry out the provisions of said act of the Legislature and of this ordinance. f SECTION 6. Said board of library trustees shall, on or before the last dqr of Jaly in each year, make a report to the legislative body of said city, giving the condition of the library on the 30th day of June preceding, together with a statement of the proceedings of said board for the year then ended, and shall forward a copy tlsreof to the State Librarian at Sacramento. ,'SECTION ?. That the City Council of said city shall, in making the aanua;. tax levy for said city and as a part thereof, if the maintenance of said library has not at said time been o the rwi se provided for, levy a tax for the purpose of maintaining such library and purchasing property necessary therefor, vhieh tax, as provided in 4- 1151 said act of the Legislature, shall be in addition to other taxes, the levy of v&ich is permitted in said municipality. Provided,, however, that after two. years from the establish- ment of said library, where a maintenance corresponding thereto has not been otherwise provided, such annual levy shall not exceed three mills on the dollar of assessed valuation. SECTION 8. The revenue derived from eai d tax each year, together with all money acquired by gift, devise, bequest or otherwise :ar the purposes of said library, shall be apportioned to a fund to be designated the 'Library Fund" and be applied to the purposes herein and in aeld act of the Legislature authorized. If such payment into the treasury of said city should be incon- sistent with the conditions or terms of any such gift, devise or bequest, the board shall provide for the safety and preservation of the saws and the application thereof to the use of the library, in accardacae with the terms and conditions of such gift, devise or bequest. Payments from this fund shall be made upon warrants issued after due audit by, and the order from, the library trustees, which warrants shall be signed by the President and Secre- tary of said board of library trustees. The Treasurer of said city shall pay such warrants without any further order or warrant from any other authority. f` SECTION 9. That said library and its branches, if air, shall be forever free to the inhabitants and non - resident tax payers of the said city, subject always to such rules, regalati on s and by -lawn as may be made by avid board of library trustees; and provided that for violations 5-- F�. of the same, a person may be fined or excluded from the privileges of said library. /SECTION 10. Said board of library trustees and the legislative bodies of neighboring municipalities, or the Board of Supervisors of Los Angeles County, Califo mia, may contract for lending the books of said library hereby established,, to residents of said county or neighboring municipalities, upon a reasonable com- pensation to be paid by such County or neighboring Muni cip81it ie S. SECTION 11. The title to all property acquired for the purposes of said library, when not inconsistent with the terms of its acquisition, or otherwise designated, shall vest in the City of E1 Segundo, California, and in the name of said city may be sued for and defended by action at law or otherwise. r SECT ION 12. The word "library" as used in this ordinance shall be construed to mean the library herein provided for, and any branch or branches thereof, when the context reasonably so implies. The public library hereby established in and for said city shall continue to exist and be regulated and maintained until such time as this ordinance may be repealed. SECTION 13. The City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be published once in the official paper of said city, to- wit: The El Segundo Herald, a weekly newspaper printed, published ani circulated within said 6•- ,jLJL53 city, amd which is hereby designated Jbr that purpose.
