ORDINANCE 156I .0 tU ORDINANCE NO. 156 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROHIBITING THE ESTABLISHMNT OR CARRYING ON WITHIN THE BOUNDARIES OF A CERTAIN PORTION OF SAID CITY, OF CERTAIN BUSIM SSES, INDUSTRIES, TRADES AND CALLINGS HEREIN DECLARED AND DETERMINZ) TO BE NUISANCES, OBNOXIOUS AM DANGEROUS TO HUMAN BE IN GS. ~� WHEREAS, the City Council (Board of Trustees) of the City of E1 Segundo, California, deems that the public peace, health, safety and welfare of said city could and would be greatly affected by the establishment, maintenance and operation of any of the trades, businesses, oallings,aetivities-, vocations or industries hereinafter referred to within the boundaries of that certain portion of said city hereinafter described, and might be subject to severe injury therefrom, and would be menaced thereby; -~ A10, WHEREAS, said C ounc i 1 deems that the action herein taken is for the best interests of the public of said city, and of the inhabitants thereof; NOW, THEREFORE, the City Council ( Board of Trustees) of the City of E1 Segundo, California, do ordain as follows: SECTION 1. That there is hereby established in the City of E1 Segundo, California, a certain residence district which shall b;e known and designated as "Residence District No. 2" and the said Residence District No. 2 shall consist of all that territory in the City of El Segando, California, included within the following described exterior boundary line, to -wit: 1- Jolt l Beginning at the southwest corner of Lot- 9, Block 16 as shom upon E1 Segundo Sheet No. 1, recorded in Book 18, Page 69 of Maps, Records of Los Angeles County, Cali fo mia, and on file in the office of the County Recorder of said county, said point being also on the northerly line of E1 Segundo Avenue and also being on the westerly boundary line of the City of El Segundo as the same now exists; thence easterly along the northerly line of El Segundo Avenue and its projection across intersecting streets and alleys to the easterly line of Main Street as shown upon E1 Segundo Sheet No. 1, recorded aid on file as aforesaid; thence northerly along the easterly line of-Main Street - to thesouthwesterly, corner of Lot 23; Tract 18269 recorded in Book 21, page 93 of Maps, Records of Los Angeles County, California and on file as aforesaid, said point being ;iso on the northerly line of Grand Avenue; thence easterly along the no rthe rly line of Grand Avenue and its projection across intersecting streets and alleys to its intersec- tion with the westerly line of Eucalyptus Drive; thence northerly along the westerly line of Buoalyptus Drive to its intersection with the westerly prolongation of the northerly line, line east, of Holly Avenge as shown upon that map of Tract 2111, recorded in Book 22 page 141 of Maps, Records of Los Angeles County, Callifomia and on file as aforesaid; thence easterly along the northerly line of Holly Avenue and its projection across intersecting streets and alleys to the intersection with the westerly line of Sheldon Street as shown upon El Segundo Sheet No. 7, recorded in Book 22, pages 54 and 55 of Maps, Records of Los Angeles County, California, and on file as aforesaid; thence northerly along the westerly line of Sheldon Street and its projection across intersecting streets and alleys to the south- easterly corner of Lot 33, Tract 2540, recorded in Book 25, page 30 of Maps, Records of Los Angeles - .__.._ County, California, and on file as aforesaid, said point being also on the northerly line of Pine Avenue; thence easterly along the northerly line of Pine Avenue and its projection across intersecting streets and alleys to the most southeasterly corner of Lot 19, Block 91, as ehown upon E1 Segundo Sheet No. 7, re- corded in Book 22, pages 54 and 55 of Maps Records of Los Angeles County, aalifo mia, and on file as aforesaid; thence northeasterly along the southerly line of Lots 19, 20, 21, 22 and 23, Block 91 to the southeasterly corner of Lot 23, recorded and on file an aforesaid, said point being also on the westerly line of Sierra Street; thence northerly along the westerly line of Sierra Street to the northeasterly comer of Lot 25, Block 91, recorded and on file as aforesaid; thence westerly along the northerly line of Lot 25 to its intersection with the westerly line of the J. H. Fisher Subdivision, recorded in Book 22, page 87 of Miscellaneous Records; Records of Los Angeles County, California, and on file as aforesaid; thence northerly along the westerly line of the J. H. Fisher Subdivision to its intersection with the southerly line of Collingw ood Street as shorn upon E1 Segundo Sheet No. 4, recorded in Book 20, page 24 of Maps, Records of Los Angeles County, California, and on file as aforesaid; thence westerly along jeation southerly line of Collingwood Street and its 2- a- across intersecting streets and alleys to its intersection with the westerly line of Hillcrest Avenue as shown upon that map of Tract 1685, recorded in Book 21, page 98 of ?daps, records of Los Angeles County, California, and on file as aforesaid; thence southerly along the westerly line of Hillcrest Avenue and its projections aerms intersecting streets and alleys to its intersection with the northerly line of Palm Avenue as shown upon that map of Tract 1685, recorded and on file as aforesaid; thence westerly along the northerly line of Palm Avenue to its intersection with the westerly boundary line of the City of El Segundo, California, as the same now exists; thence southerly and easterly along $he various courses of the boundary line of the City of El Segundo to the point of beginning. SECTICU 2. That it shall be unlawful . for any person, firm or corporation to establish, c onduct, operate or maintain at any place in said residence district No. 2, hereinabove in Section 1 of this ordinance described, any of the following specified trades, businesses, vocations, callings, activities or industries, to -wit: amonia, chlorine or bleaching powder manufacture; asphaltum manufacture or refining; brick, tile and terra -cotta manufacturing; boiler works, creosote treatment or manu- facture; distillation of coal, wood or bones; fat rendering; fertiliser manufacture; gas (illuminating or heating) maauf actare ; glue manufacture; gun powder, fire works or explosives manufacture or storage; incineration or reduc- tion of garbage, offal, dead animals or refuse; iron foundaries, lamp black manufacture; lime, cement or plaster of paris manufacture; oil or gas well drilling; petroleum or gas producing; petroleum refining; paint manufacture; pickle, sour - kraut, sausage or vinegar manufaoture, rail- road yard or round house; lumber yard, planing mill, or woodworking mill, raw hydes and skins, curing and tanning; rolling mill, sheet iron or sheet metal works, or mill or foundry, scrap iron, junk or rags storage or baling; slaughter of animals or fowls; smelting of iron; scrap 3- 0i manufacture; ornamental or o the r iron works; stock yards; stone mill or rock crusher; sulphureous nitric or hydro- chloric acid manufacture; tallow, grease and lard manu- facture; refining, tar roofing or tar water proofing manufacture; tobacco (chewing) manufacture; or similar obnoxious purposes or any other trade, industry, business, calling, vocation or activity producing noise, dust, smoke, gases or odors offensive to human beings; provided, however, that nothing herein contained shall be construed as applying to arq such trade, business, vocation, calling, activity or industry now actually established and existing within said district at the time of the adoption of this ordinance,, but such existing trade, business, vocation, calling, activity or industry shall not be enlarged beyond the physical space which it occupies at the time of the taking effect of this ordinance; and provided farther, that the City Council of said city shall have the right and does hereby reserve the right to grant written permits for the drilling, boring or otherwise sinking of an oil or gas well, or oil or gas wells, and /or the maintenance, pumping and /or operation of any such well or wells within the boundaries of said district, upon application therefor, all in the manner as contemplated in Ordinance No. 122 of the City i;ouncil of said city, entitled: "AN ORDINANCE OF TIM CITY OF EL SEGUIMO, CALIFORNIA, REGULATING THE DRILLING, MAINTENANCE AIM CONSTRUCTION OF OIL AND GAS WELLS THEREIPd; DECLARING OIL AND GAS WELLS WITHIN CERTAIN DISTRICTS WITHIN SAID CITY TO BE NUISANCES, AND MAKING IT UNLAWFUL TO DRILL, MAINTAIN OR OPERATE OIL OR GAS WELLS WITHIN SUCH SPECIFIED DISTRICTS; PROVIDING PENALTIES FOR THE VIOLATION (7 THE PROVISIONS THEREOF; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH." adopted on the 15th day of January, A. D., 1926, relating to such matters. SECTION 3, It shall be,and it is hereby declared to be, unlawful for any person, firm or corporation to 4- 1011 i..Y; j((L!I establish, conduct, operate or maintain any shah oil or gas well drilling, petroleum or gas producing and /or petroleum refining business,, or activity, within said residence district No. 2, without such written permit so to do from said City Council, first had and obtained. SECTION 4. Any trade, industry, business, calling, vocation or activity o&rried on, established, operated or maintained within said residence district No. 2 contrary to the provisions of this ordinance, shall be and is hereby declared to be a public nuisance, and may be abated as such. SECT1011 5. Any person, firm or corporation violat- ing any of the provisions of this ordinance, shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding Three Hundred Dollars ($300.00) or by impri s aalment of not more than six months in either the City Jail of the City of El Segundo, Cali- fornia, or the County Jail of the County of Los Angeles, California, as the committing magistrate may direct, or by both such fine and impr i s onme nt ; and each and every calendar day daring which any violation of this ordinance shall continue, shall be considered and deemed a new and separate offense. SECTION 6. This or dinaace shall take effect and be in full force and virtue thirty (30) days from and after the final passage and adoption thereof. SECTION 7. The City Clerk shall certify to the passage and adoption of this ordiname and shall cause the same to be published once in The El Segundo Herald, a weekly newspaper printed, published and circulated in the said City of El Segundo, and which is hereby designated for that purpose. 5- .- r Dated this 1st day of A.
