ORDINANCE 144ORDINANCE NO. 144 . AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, PRESCRIBING THE MANNER OF DISPOSITION OF ANY DELINQUENT ASSESSAONT LIEN OR ANY PROPERTY ACyUIRED BY SAID CITY OF EL SEGUNDO, UNMR AND PURSUANT TO THAT CERTAIN ACT OF THE IE GISLATURE OF THE STATE OF CALIFORNIA, ENTITLED, "AN ACT AUTHORIZING ANY CITY, UITY aND COUNTY, COUNTY, TOWN, MUNICIPALITY -OR OTHER POLITICAL SUBDIVISION. TO ACQUIRE CERTAIN LIENS OR PROPERTY OFFERED FOR SALE FOR THE NON- PAYMENT OF CERTAIN ASSESSWNTS ", APPROVED JUNE 4TH, 1915. The City Council (formerly Board of Trustees) of the City of El Segundo, California, does hereby ordain and determine as followw: SECTION 1. That any delinquent assessment lien or any property now owned or hereafter acquired by the City of El Segundo, California, under and pursuant to the pro- visions of that certain aot of the Legislature, of the State of California, entitled, "An act authorizing any city, city and county, county, town, municipality or other political subdivision to acquire certain liens or property offered for sale ,for the non - payment of *ertain assessments", approved June 4th, 1915, shall be released, assigned, sold or other- wise disposed of by the said City of E1 Segundo, in the manner prescribed by this ordinance, bnd not otherwise. SECTION 2. Any person, firm or corporation de- siring the release of any such delinquent assessment lien, or any suoh property now owned. or hereafter soquired by said City of E1 Segundo, pursuant to the provisions of the above entitled act of the Legislature of the State of low IUD iii 1 ■ California, shall make application therefor in writing to the Superintendent of Streets.of the City of El Segundo, stating therein his name, address, number and de- scription of assessment,desoript ion of property against which the said assessment is a lien and his interest or title in or to the said real property,lf any there be. The Superintendent of Streets shall thereupon compute the total amount due upon said delinquent, assessment lien or said property,. including therein the original amount of the assessment, together with the cost of sale and all accrued penalties and delinquencies provided for by the particular act under which said assessment was levied.. and interest on the total- amount at the rate of two per cent (2;�O) per month from the sate of the acquisition of 8udh lien or property by the City of El Segundo. Upon receipt of the total amount, as computed by the Superin- tendent of Streets, the said Superintendent of Streets shall issue a release of said assessment in the manor provided by the particular act. under which said assessment was levied, or if no such form is therein - prescribed, then in such form as said Superintendent of Streets shall determine, and shall mark said assessment "paid" on the assessment roll, and thereafter said assessment shall be released, . and shall be no longer a lien upon the real property involved. SECTION 3. Any person, firm or corporation desiring the assignment or sale of any delinquent assessment lien, or any property purchased by the said Dity of El Segundo .under and pursuant to the provisions of the above entitled act of the Legislature of the State of - alifornia, to such person, firm or corporation, shall make application therefor in writing to the City Council of the City of E1 Segundo, California,. stating in such application the name and address of said person, firm or corporation., the 2•- 02JL number and description of the particular assessment of whiah assignment, or sale is desired, a description of the real property against which the same is a lien, the interest or title of such person, firm or corporation in said real property, if any there be, and the reasons of such person, Yirm or corporation for seeking an assign- ment or sale thereof, instead of a release. Upon receipt of such application said City Council shall consider the same and may, if it deems desirable, require the said person, firm or corporation to appear beforethe City Council for a hearing on such application. And such hearing tay be continued from time to time until The City Council shall reach a des ision thereon. If after due consideration of said application, said City Council shall determine that such application oe granted,, then and in that event said City Council shall, by motion, direct the Superintendent of Streets to execute and deliver to such person, firm or corporation, a proper asst gnment, bill of sale, transfer, or oonveyance, of said delinquent assessment lien or any property acquired as hereinbefore set forth, 'upon payment of the original amount of said S ' �! assessment, together with costs of sale and all accrued penalties and delinquencies as provided by the act under which such assessment was originally levied„ plus interest on the Total of said sums. at the rate of two per cent (2o) per month, from the date of the acquisition of such lien or property.by the City of El Segundo. The Street Superintend- ent shall thereupon compute the total amount of said sums.. and upon payment thereof by such person, firm or corporation, said Superintendent of Streets , shall issue, properly exe- outed,, to smch person, firm or corporation, an assignment, bill of sale, transfer or oonveyanoe of said lien or property involved. From and after the date of payment of said sum, end delivery of said assignment, bill of sale, 3- transfer or conveyance, such assessment lien or property shall be the absolute property of such person, firm or corporation, and the said City of El Segundo shall there- after have no further interest in, or claim upon, the same. SECTION 4. All sums of money received by the Superintendent of Streets under the provisions of this ordinance, shall be by him deposited with the City Treasurer of zhe City of E1 Segundo, California, and shall be credited by said City Treasurer to the proper find or fun do . SECTION 5. The City Clerk shall Qertify to the passage azLd adoption of this ordinance; shall cause the .� same to be published once in the official paper of said city, to -wit: The E1 Segundo Herald, a weekly newspaper printed, published and circulated within aaid city and which is hereby designated for that purposes and thereupon the same shall become in full force and effect.
