ORDINANCE 116T ORDINANCE N0. 116 AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIrFORNIA, PROVIDING FOR THE ISSUANCE OF BONDS OF SAID CITY IN THE SUM OF 43759000.00, FOR THE ACQUISITION, CONSTRUC- TION AND COMPLETION BY SAID CITY OF A CERTAIN MUNICIPAL IMPROVEMENT, TO -WIT: A MUNICIPAL SEWER SYSTEM FOR THE COLLECTION, CARRYING OFF AND DISPOSAL OF SEWAGE IN AND AWAY FROM SAID CITY OF EL SEGUND09 CONSISTING OF THE ACQUISITION, CONSTRUCTION AND COMPLETION BY SAID CITY OF MAIN TRUNK LIME SEWERS, AND MAIN INTER- CEPTING SEWERS, AND CONSISTING OF THE ACQUISITION, CONSTRUCTION OR COMPLETION OF AN OUTFALL SEWER LINE OR LINES AND DISPOSAL PLANT OR PLANTS, OR THE RIGHT TO USE SUCH OUTFALL SEWER LINES AND DISPOSAL PLANTS, AND INCLUDING THE ACQUISITION, CONSTRUCTION AND COM- PLETION OF ALL NECESSARY LANDS, RIGHTS OF NAY, EASE - =ITS* PIPE, MACHINERY, APPARATUS AND EQUIPMENT NECESSARY FOR THE COLTLETION OF SUCH MUNICIPAL SEWER SYSTEM. WHEREAS, the Board of Trustees of the City of E1 Segundo, California, at a regular meeting of said Board held on the 27th day of March, 1925, by a vote of more than two - thirds of its members, duly passed and adopted a resolution de- termining that the public interest and public necessity of said City demanded the acquisition, construction and com- pletion by said City of a certain municipal improvement, to -wit: A municipal sewer system for the collection, carrying off and disposal of sewage in and away from said City of E1 Segundo, consisting of the acquisition, con- struction and completion by said City of main trunk line sewers and main intercepting sewers, and consisting of the acquisition, construction or completion of an outfall sewer line or lines, and disposal plant or plants, or the -1- yid i R; right to use such outfall sewer lines and disposal plants, and including the aoquisition, construction and Completion of all necessary lands, rights of way, ease- ments, pipe, machinery, apparatus and equipment necessary for the completion of such municipal sewer system; and 13, said resolution was approved by the executive of said City, to -wit, the President of the Board of Trustees of said City on the said 27th day of March, 1925, and thereafter entered in the Book of Resolutions of said City, and a minute of the passage and adoption thereof made on the minutes of the meeting at which the same was passed and adopted; and WHSIZFAS, on the 10th day of April, 1925, the Board of Trustees of said City, at a regular meeting of said Board held on said date, by A vote of more than two - thirds of its members, duly passed and adopted an ordinance calling a special election to be held in said City on Friday, the first day of May, 1925, for the purpose of submitting to the qualified electors of said City, among other things, the proposition of incurring a bonded indebtedness and issuing bonds of said City in the sum of $375,000.009 for the pur- pose of the acquisition, construction and completion by said City of a certain municipal improvement, to -wit: a municipal sewer system for the collection, carrying off and disposal of sewage in and away from said City of El Segundo, consist- ing of the acquisition, construction and completion by said City of main trunk line sewers and main intercepting sewers and consisting of the acquisition, oonstruotion or completion of an outfall sewer line or lines and disposal plant or plants, or the right to use such outfall sewer lines, and disposal plants, and including the acquisition, construction aril completion of all necessary lands; rights of way, ease- ments, pipe, machinery, apparatus and equipment necessary for the completion of such municipal sewer systems, which 2- said ordinance was approved by the executive of said City; t o -wit ; the President of the Board of Trustees thereof on the said 10th day of April, 1925, and was duly published in the Bl Segundo Herald, a weekly newspaper of general circulation priAted, published and circulated in said City on the 17th and 24th days of April, 1925; and WBERE09 said election was held on the said let day of May, 1925, as provided for by said ordinance calling said eleotion, and by law for holding municipal elections in said City; and MME S, the proposition of incurring the bonded debt hereinbefore mentioned received more than two - thirds of the votes of the qualified electors of said City voting at said election; and SAS, all and singular, the provisions of the Act of the Legislature of the State of California; entitled$ "An Act Authorizing the Incurring of Indebtedness by Cities; T owns , ani Municipal Corporations for Municipal Improvements and Regulating the Acquisition, Construction, or Completion thereof," which became a law Febraary 25, 19,019 and the acts amendatory thereof and supplementary thereto; and the general laws of the State of California relating to cities of the sixth olass, and the laws and ordinances of the City of El Segundo, have been fully complied with so as to author- ize the issuing of said bonds; and WAS, the public interest and public necessity of said City demand that provision should be made for the issuance of sadd bonds, so that the same may be sold in such amounts and at such times as the Board of Trustees of said City may determine; NOW. THMMFORE, the Board of Trustees of the City of El Segundo, California, do ordain as follows; SECTION 1. That bonds of the said City of Bl Segundo, California, in the sum of $375,000.00 be issued in 3- accordance with the provisions of that certain aot of the Legislature of the State of California, entitled: - "An Act Authorizing the Incurring of Indebtedness by Oities, Towns, and VbWolpal Corporations for Manioipal Improvements and Regulating the Aogaisition, Construction or Qompletion Thereof," which became a lea► February 25, 1901, and all sots or parts of acts, amendatory thereof or supplementary thereto, and in accordance with the laws of the State of California, and the ordinances and laws of said City of 21 Segundo for the purpose of the acquisition, construction and completion by said City of a certain municipal improveaent, to -wit% a municipal sewer system for the collection, oarrying off and disposal of sewage in and away from said City of Bl Segundo, consisting of the acquisition, construction and completion by said City of main trunk line sewers and main intercepting sewers and consisting of the acquisition, construction or completion of an outfall sewer line or lines and disposal plant or plants, or the right to use such outfall sewer lines and disposal plants, and including the aoquisition, construo- tion and completion of all neoessary lands, rights of way, easements, pipe, machinery, apparatus and equipment necessary for the completion of such municipal sewer system. That such bonds shall be 575 in number; shall be designated "Sewer Bonds, Election 1925 "; shall be issued in the denomination of $1000.00 each; and the principal and interest thereof shall be payable in lawful money of the United States of America; that they shall be dated the End day of July, 192b and bear interest at the rate of not to exceed six per oent (6%) per annum, payable semi- annually on the 2nd day of January and the 2nd day of Daly of every year. That for the purpose of paying the principal and interest of said bonds, the Board of Trustees of said City shall, at the time of fixing the general tax levy., and in the manner for such general tax levy provided, levy and collect annually each year until such bonds are paid, or until there shall be a sum in the Treasury of said City eat apart for that purpose suffic- ient to meet all sums coming due for principal and interest on such bonds, a tax sufficient to pay the annual interest cm such bonds, and also such part of the principal thereof as shall be- come due before the time for fixing the next general tax levy.
