ORDINANCE N0. 116
AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIrFORNIA,
PROVIDING FOR THE ISSUANCE OF BONDS OF SAID CITY IN
THE SUM OF 43759000.00, FOR THE ACQUISITION, CONSTRUC-
TION AND COMPLETION BY SAID CITY OF A CERTAIN MUNICIPAL
IMPROVEMENT, TO -WIT: A MUNICIPAL SEWER SYSTEM FOR
THE COLLECTION, CARRYING OFF AND DISPOSAL OF SEWAGE
IN AND AWAY FROM SAID CITY OF EL SEGUND09 CONSISTING
OF THE ACQUISITION, CONSTRUCTION AND COMPLETION BY
SAID CITY OF MAIN TRUNK LIME SEWERS, AND MAIN INTER-
CEPTING SEWERS, AND CONSISTING OF THE ACQUISITION,
CONSTRUCTION OR COMPLETION OF AN OUTFALL SEWER LINE
OR LINES AND DISPOSAL PLANT OR PLANTS, OR THE RIGHT
TO USE SUCH OUTFALL SEWER LINES AND DISPOSAL PLANTS,
AND INCLUDING THE ACQUISITION, CONSTRUCTION AND COM-
PLETION OF ALL NECESSARY LANDS, RIGHTS OF NAY, EASE -
=ITS* PIPE, MACHINERY, APPARATUS AND EQUIPMENT NECESSARY
FOR THE COLTLETION OF SUCH MUNICIPAL SEWER SYSTEM.
WHEREAS, the Board of Trustees of the City of E1 Segundo,
California, at a regular meeting of said Board held on the
27th day of March, 1925, by a vote of more than two - thirds
of its members, duly passed and adopted a resolution de-
termining that the public interest and public necessity of
said City demanded the acquisition, construction and com-
pletion by said City of a certain municipal improvement,
to -wit: A municipal sewer system for the collection,
carrying off and disposal of sewage in and away from said
City of E1 Segundo, consisting of the acquisition, con-
struction and completion by said City of main trunk line
sewers and main intercepting sewers, and consisting of
the acquisition, construction or completion of an outfall
sewer line or lines, and disposal plant or plants, or the

right to use such outfall sewer lines and disposal
plants, and including the aoquisition, construction and
Completion of all necessary lands, rights of way, ease-
ments, pipe, machinery, apparatus and equipment necessary
for the completion of such municipal sewer system; and
13, said resolution was approved by the
executive of said City, to -wit, the President of the Board
of Trustees of said City on the said 27th day of March,
1925, and thereafter entered in the Book of Resolutions
of said City, and a minute of the passage and adoption
thereof made on the minutes of the meeting at which the
same was passed and adopted; and
WHSIZFAS, on the 10th day of April, 1925, the Board
of Trustees of said City, at a regular meeting of said Board
held on said date, by A vote of more than two - thirds of its
members, duly passed and adopted an ordinance calling a
special election to be held in said City on Friday, the first
day of May, 1925, for the purpose of submitting to the
qualified electors of said City, among other things, the
proposition of incurring a bonded indebtedness and issuing
bonds of said City in the sum of $375,000.009 for the pur-
pose of the acquisition, construction and completion by said
City of a certain municipal improvement, to -wit: a municipal
sewer system for the collection, carrying off and disposal
of sewage in and away from said City of El Segundo, consist-
ing of the acquisition, construction and completion by said
City of main trunk line sewers and main intercepting sewers
and consisting of the acquisition, oonstruotion or completion
of an outfall sewer line or lines and disposal plant or
plants, or the right to use such outfall sewer lines, and
disposal plants, and including the acquisition, construction
aril completion of all necessary lands; rights of way, ease-
ments, pipe, machinery, apparatus and equipment necessary
for the completion of such municipal sewer systems, which

said ordinance was approved by the executive of said City;
t o -wit ; the President of the Board of Trustees thereof on
the said 10th day of April, 1925, and was duly published
in the Bl Segundo Herald, a weekly newspaper of general
circulation priAted, published and circulated in said City
on the 17th and 24th days of April, 1925; and
WBERE09 said election was held on the said let
day of May, 1925, as provided for by said ordinance calling
said eleotion, and by law for holding municipal elections
in said City; and
MME S, the proposition of incurring the bonded
debt hereinbefore mentioned received more than two - thirds
of the votes of the qualified electors of said City voting
at said election; and
SAS, all and singular, the provisions of the
Act of the Legislature of the State of California; entitled$
"An Act Authorizing the Incurring of Indebtedness by Cities;
T owns , ani Municipal Corporations for Municipal Improvements
and Regulating the Acquisition, Construction, or Completion
thereof," which became a law Febraary 25, 19,019 and the
acts amendatory thereof and supplementary thereto; and the
general laws of the State of California relating to cities
of the sixth olass, and the laws and ordinances of the City
of El Segundo, have been fully complied with so as to author-
ize the issuing of said bonds; and
WAS, the public interest and public necessity
of said City demand that provision should be made for the
issuance of sadd bonds, so that the same may be sold in
such amounts and at such times as the Board of Trustees of
said City may determine;
NOW. THMMFORE, the Board of Trustees of the City
of El Segundo, California, do ordain as follows;
SECTION 1. That bonds of the said City of Bl
Segundo, California, in the sum of $375,000.00 be issued in

accordance with the provisions of that certain aot of
the Legislature of the State of California, entitled:
- "An Act Authorizing the Incurring of Indebtedness by Oities,
Towns, and VbWolpal Corporations for Manioipal Improvements
and Regulating the Aogaisition, Construction or Qompletion
Thereof," which became a lea► February 25, 1901, and all sots
or parts of acts, amendatory thereof or supplementary thereto,
and in accordance with the laws of the State of California,
and the ordinances and laws of said City of 21 Segundo for
the purpose of the acquisition, construction and completion
by said City of a certain municipal improveaent, to -wit% a
municipal sewer system for the collection, oarrying off and
disposal of sewage in and away from said City of Bl Segundo,
consisting of the acquisition, construction and completion
by said City of main trunk line sewers and main intercepting
sewers and consisting of the acquisition, construction or
completion of an outfall sewer line or lines and disposal
plant or plants, or the right to use such outfall sewer lines
and disposal plants, and including the aoquisition, construo-
tion and completion of all neoessary lands, rights of way,
easements, pipe, machinery, apparatus and equipment necessary
for the completion of such municipal sewer system.
That such bonds shall be 575 in number; shall be
designated "Sewer Bonds, Election 1925 "; shall be issued in
the denomination of $1000.00 each; and the principal and
interest thereof shall be payable in lawful money of the
United States of America; that they shall be dated the End
day of July, 192b and bear interest at the rate of not to
exceed six per oent (6%) per annum, payable semi- annually
on the 2nd day of January and the 2nd day of Daly of every
year. Said bonds shall be numbered from 1 to 3751, both in-
olusive, and shall be payable in the following mamer:

of the Constitution and laws of the State of Califtrnia
and of all ordinances of the said City of El Segundo;
have been fully oomplied with by the proper officers in
the issuing of this bond; that this isms of bonds has
been authorized, by the vote of two--thirds of the duly
qualified electors of said City voting on the question
of such loans at a special election duly and regularly
called and held in said City on the let day' of May, 1955,
and that the total amount of this issue, together with
all other indebtedness of said City, does not exceed the
limit prescribed by the Constitution and laws of the State
of Colilbrnia; that before or at the time of incurring the
indebtedness evidemed hereby, provision has been made for
the collection of an amanal tax sufficient to pay the in-
terest on such indebtedness as it falls due and also prod•
sion to constitute a sinking fond for the payment of the
principal the reo f on or before maturity.

SECTION 2. That the President of the Board of
Trustees of said City and the Treasurer of the said City
are hereby authorised and directed to sign all of said
bonds, and the City Clerk. of said City is hereby authorised
and directed to countersign said bonds and to affix the
corporate seal of said City thereto, and the Treasurer
of said City is hereby sathorised amd df sroted to sign
the interest coupons of said bonds and said bonds shall
be delivered by said City Clerk to the said City Treasmrer
in each amounts as the Board of Trustees of said City may
from time to time determine; and said City Treasurer is
hereby authorised and directed to sign all the interest
coupons of said bonds by his lithographed or engraved
signature.
SBCTICN S. That the prooieds of the sale of
said bonds shall be placed in the TYeasury of said City
to the credit of a fund to be known as "Sewer Bonds,
Election 1926, ii'and ", and shall be applied erolusively
to the purpose mentioned in this Ordinance, to -wit: to
the purpose of the acquisition, construction and comple-
tion by said City of a certain =nioipal improvesoat,
to-wit: a municipal sewer system for the oollectlon,
carrying off and disposal of sewage in and away from said
City of El Segundo, consisting of the acquisition, con -
struotion and completion by said City of main trunk line
sewers and main intercepting sewers, and *onsitting of
the aogmisition,construotion or completion of an oatfall
sewer line or lines and disposal plant or plants, or the
right to use such outfall sewer lines and disposal plants,
and including the sogsi si tion, construction and oomplet ion
of all necessary lands, rights of way, easements, pipe,
machinery, apparatus and equipment necessary for the oom-
ple tion of such munioipal sewer system.

SECTION 4, That for the purpose of securing and
providing for the payment of the principal and interest of
said bonds, there is hereby created a fund to be known as
"Sewer Bonds, Election 19250 Interest and Sinking Fund ";
that all the money which, from time to time, shall be placed
in said fund shall be and is hereby set apart exclusively
for the purpose of meeting all sums coming due for principal
and interest on all the aforesaid bonds which may be issued
under the proceedings hereinbefore recited. That for the
purpose of paying the principal and interest of said bonds,
the Board of Trustees of said City shall, at the time of
fixing the general tax levy., and in the manner for such
general tax levy provided, levy and collect annually each
year until such bonds are paid, or until there shall be a sum
in the Treasury of said City eat apart for that purpose suffic-
ient to meet all sums coming due for principal and interest on
such bonds, a tax sufficient to pay the annual interest cm such
bonds, and also such part of the principal thereof as shall be-
come due before the time for fixing the next general tax levy.
Said taxes herein required to be levied and collected shall be
in addition U all other taxes levied for municipal purposes,
and shall be collected at the same time and in the same manner
as other municipal taxes are collected, and forthwith, eA collect-
ed, shall be turned over to and paid into said "Sewer Bonds,
Election 1926, Interest and Sinking Fund's and be used for no
other purpose than the payment of said bonds and accruing interest*
SECTION 5. The City Clerk shall certify to the passage
and adoption of this ordinance and shall cause the same to be
published by one insertion in the "E1 Segundo Herald ", a weekly
newspaper, of general circulation, printed, published and cir-
culated in said City and hereby designated for that purpose,
and thirty days after the passage and adoption thereof the same
shall take effect and be in full force and effect.
