ORDINANCE 961 W 4 ► ORDINANCE 10. 96 . AS ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE N0, 12 OF SAID CITY, ENTITLED "AS ORDINANCE OF THE CITY OF EL SEGUNDO, LICENSING AND REGULATING CERTAIN KINDS OF BUSINESS TRANSACTED AN: CARRIED ON IN SAID CITY AND FIRING A PENALTY FOR VIOLATIONS THEREOF", PASSED AND ADOPTED ON THE 14TH DAY OF MARCH, 19179 BY ADDING A NEW SECTION THERETO TO BE KNOWN AS 39 -1/2. The Board of Trustees of the City of El Segundo do ordain as follows: SECTION 1. That Ordinance Ito. 12 of the City of El Segundo, California, passed and adopted on the 14th day of March, 1917, entitled: AN ORDINANCE OF THE CITY OF EL SSGUNDO LICENSING AND REGULATING CERTAIN KINDS OF BUSINESS TRANSACTED AND CARRIED ON IN SAID CITY AND FIXING A PENALTY FOR VIOLATIONS THEREOF ", be and the same is hereby amended by the addition of a new section thereto, to be designated and known as Section 39*9 which said Section 39* shall read as follows: "SECTION39*. For every person, firm or corporation engaged in, conducting, managing or carrying on the business of an itinerant food vendor, or a transient • food vendor, whether from a booth or stand of any kind, or otherwise, and whether by public outcry of his wares, or otherwise, the sum of $25.00 per day, payable daily in advance. For the purposes of this ordinance any "itinerant food Tpador" is defined to be any person, firm or corporation who or which engages in the sale to the public of such articles as are commonly known or referred to as "hot dogs ", "red hots*,`Coney Island red hots", "Soft Drinks", and other foodstuffs anddarinks prepared for, or intended for, immediate consumption on or near the - premises where so vended or_soli. Provided, however, that no such itinerant food vendor, or transient food vendor shall engage in any such business without first having obtained a permit so to do from the Board of Trustees of said city. Such permit shall be issued only upon application to the said Board in writing and by a hearing before said Board upon such application, after which hearing the Board may, or may not, in its discretion issue such permit. If grantedsor permitted to issuessuch permit shall be in writing, shall speoi- fically state the term for which the stAt is issued, the name of the person, firm or corporation licensed and the location at Which such business is to be carried on, conducted, or transacted. This section shall not be L_—_ t "7'74 8onli0able to any person, firm or corporation who shall have been conducting any such b*sinese within said city for a period of thirty days or more immediately preceding the taking effect hereof, nor to any person,firm or corporation conducting, or proposing to conduct any business which may be found by the said Board of Trustees to be without the purview of this ordinance at the hearing on the application for license hereunder as hereinabove provided." SECTION 2. This ordinance is an ordinance for the immediate preservation of the public peace, health and safety of said city and the facts constituting its urgency are as follows: The Board of Trustees has knowledge that a great many itinerant food vendors and transient food vendors are about to invade the said city upon the occasion of certain holidays and celebrations to be held in said city beginning the latter part of August, 1923, to sell their wares, food- stuffs and drinks to the public therein generally; and said Board believes that unless the said vendors are regulated as hereinabove provided, the public of said city will not be properly safeguarded against contaminated and unhealthful foodstuffs and beverages; therefore, this ordinance shall take effect and be in full force and virtue immediately upon the final passage and adoption thereof. SECTION 3. The City Clark shall certify to the passage and adoption of this Ordinance by a vote of four - fifths of the members of this Board, and shall cause the same to be published once in the E1 Segundo Herald, a weekly newspaper of general circulation, printed, published and circulated within the said City and hereby designated for the purpose.
