ORDINANCE 95'76'7 ORDINANCE NO. 850 AN ORDINANCE OF SHE CITY OF EL SEGUNDO, CALIFORNIA, REGULATING THE EMPING OF DOGS AND THEIR RUNNING AT LARGE IITHI11 THE SAID CITY. The Board of Trustees of the City of El Segundo do ordain as follows: SECTION 19 'Whenever any case or cases, of rabies, or other disease, dangerous to the health of human beings, shall be reported as existing in any portion of the City of E1 Segundo, California, the Health Officer of said City, or the County Health Officer of Los Angeles County, California, shall 4take or cause to be made a pre- liminary investigation as to whether any such disease does exist and as to the probable area of the City in which the people or animals therein are thereby endangered. If, upon such examination, either the said City Health Officer or the said County Health Officer shall find that any of the said diseases does exist, a quarantine shall be declared by him against all dogs designated in the quarantine order and living within or coming into the area specified in said order. Said quarantine order shall continue for such period, not exceeding six (6) months from date thereof, as may be designated therein. SEC TION 2. The term "unenclosed lot, or premises," as used in this ordinance, is hereby de- fined to mean any lot, land or premises not enclosed in such manner as to prevent any dog confined therein from escaping therefrom. SECTION 4. The said City Health Officer and his deputies, the said County Health Officer and his deputies, the Sheriff of Los Angeles County and his deputies, the City Marshal and his deputies, every constable and his deputies, and every pound keeper of said City, are hereby authorized and empowered to cap- ture every dog not muzzled, as required by this ordi- nance, and found going free or running at large in or upon any public road, or highway, or any other place, or in or upon any unenclosed lot or premises within the area specified in the quarantine order; or in case such officer or person shall upon reasonable pur- suit be unable to capture such dog, such officer or person shall be authorized and empowered to kill such dog. All dogs so captured by any officer or person L hereinabove referred to shall be examined by either the said City Health Officer or his deputy, or the said County Health Officer or his deputy, and it shall be the duty of said City Health Officer and of said County Health Officer, so far as said County Health Officer will cooperate in said matter, when called upon 2. {.; . ti . 769 to examine, or have his deputy examine, any such dog, to ascertain whether or not such dog is afflicted with rabies. Any dog found by either of said officers upon examination as above stated to be so afflicted shall be at once killed by the person having possession thereof, and any dog found not to be so afflicted after sufficient time for proper examination thereof, shall be returned to the owner thereof upon the payment to said City of E1 Segundo (through the officer or pound keeper having charge of such dog) of the current license fee for such dog (if the same be not already paid), to- gether with a redemption fee of Two Dollars and fifty cents ($2.50), which shall be paid to said City, and all of the expenses incurred in impounding such dog, which shall not exceed fifty cents (.50) per day. The said City Health Officer and said County Health Officer are hereby authorized to provide for the care of the dogs captured and held pursuant to the pro- visions of this ordinance, and the expenses incurred thereby shall, in cases where such dogs are not re- claimed, be paid by the City of E1 Segundo, California, not exceeding, however, fifty cents (.50) per day for each such dog. Every person who kills any dog as herein provided shall bury or destroy the same. If any dog is found not to be afflicted With rabies and is not reclaimed by the owner thereof within five (5) days after the capture thereof, such dog shall be killed by the person capturing the same, or given to such person as will pay the expenses incurred in im- pounding such dog, as hereinabove provided. All dogs killed under the provisions of this ordinance shall be 3. _� "7"70 killed in some humane manner. Rf i. SECTION 5. All dogs shall be exempted from quarantine or muzzling which hare been immunized or vaccinated with anti -rabic virus approved by the State Board of Health, within one year, and the owners of such dogs have filed with the Health Officer a certifi- cate of vaccination or immunization made out by a duly licensed veterinarian or ph37sician. The Health Offieer may issue to owners of immunized dogs, upon receipt of the aforesaid certifi- cate, a numbered tag bearing a legend giving the year issued, and giving the information that the dog wearing same has been immunized. This tag shall be firmly at- tached to the collar, and said collar shall be worn by said immunized or vaccinated dog at all times except when in strict confinement. SECTION 6. If at any time the Board of Trustees of said City shall deem the expense of the col- lection and care of dogs by said County Health Officer or his deputies as herein provided for to be excessive, said Board of Trustees may notify said County Health Officer to that effect, and thereupon said County Health Officer shall not, nor shall any of his deputies, incur or create any further charge of any kind against the said City. SECTION 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not less than Five Dollars 05.00) nor more than Fifty Dollars (350.00), or by imprison- meat is the County Jail of Los Angeles County, California, 4. . A report shall be rendered to the Board of Trustees of said City at each regular meeting of said Board of all dogs impounded and redeemed or destroyed under the provisions of this ordinance, and of all expenses incurred with reference to the capturing, impounding and keeping of the same. SECTION 9. 111 parts of existing ordinances in conflict herewith are hereby repealed. SECTION 10. The pound master or any other person impounding any dog under the provisions of this ordinance shall at the time of impounding the same leave with the City Marshal of said City a description of such dog, sufficient to identify the same, the name of the owner, if known, and the date of impounding such dog. SECTION 11. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the E1 Segundo Herald, a weekly newspaper of general cir- culation, printed, published and circulated within the said City and hereby designated for that purpose. This ordinance shall take effect and be in full force and virtue thirty (30) days from and after the final passage and adoption thereof. Passed, approved and adopted, this r7th day of August, A.
