Y - c 75 ORDINANCE N0. 94 ---- AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, AMENDING ORDINANCE N0. 92, OF SAID CITY, ENTITLED: "AN ORDINANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA, PROVIDING FOR THE ISSUANCE OF BONDS OF SAID CITY IN THE SUM OF $200,000.00 FOR THE ACQUISITION, CON- STRUCTION AND COMPLETION BY SAID CITY OF A CERTAIN REVENUE PRODUCING MUNICIPAL IMPROVEMENT, TO WIT: WATER WORKS FOR SUPPLYING SAID CITY AND ITS INHABITANTS WITH WATER, INCLUDING THE ACQUISITION OF LANDS NECESSARY THEREFOR.", PASSED AND ADOPTED ON THE 27TH DAY OF MARCH, 1923, BY AMENDING SECTION 1 THEREOF; DECLARING SAID ORDINANCE TO BE AN EMERGENCY MEASURE AFFECTING THE PUBLIC PFACE, HEALTH AND SAFETY OF SAID CITY, —( AND THAT THEREFORE THE SA34E SEALL GO ! INTO EFFECT IMMEDIATELY UPON THE FINAL PASSAGE AND ADOPTION THEREOF. The Board of Trustees of the City of El Segundo do ordain as follows: SECTION 1. That Section 1 of Ordinance No.92 of the City of El Segundo, California, entitled: "AS ORDI- NANCE OF THE CITY OF EL SEGUNDO, CALIFORNIA,-PROVIDING FOR f THE ISSUANCE OF BONDS OF SAID CITY IN THE SUM OF $2000000.00 FOR THE ACQUISITION, CONSTRUCTION AND COMPLETION BY SAID CITY OF A CERTAIN REVENUE PRODUCING MUNICIPAL IMPROVEMENT, 1 1 i� 758 TO WIT: WATER WORKS FOR SUPPLYING SAID CITY AND ITS INHABITANTS WITH WATER, INCLUDING THE ACQUISITION OF LANDS NECESSARY THEREFOR.*, passed and adopted on the 27th day of March, 1923, be, and the same is hereby amended so as to read as follows: *SECTION 1. On the second day of January (year of maturity) the City of El Segundo will pay to the bearer at the office of the City Treas- urer of the City of El Segundo, in the City of E1 Segundo, State of California, the sum of (denomination of bond) Dollars with interest thereon at the rate of ( ) per cent per annum, payable semi - annually, on the second day of July and the second day of January, of each year, at the office of the City Treasurer of the City of 31 Segundo, in El Segundo, State of California, upon the pre- sentation and surrender of the interest coupons hereto attached. Principal and interest pay- able in lawful money of the United States of America. This bond is issued in pursuance of the provisions of an Act of the Legislature of the State of California entitled "An Act authorizing the Incurring of Indebtedness by Cities, Towns and Municipal Corporations for Municipal Improvements, and Regulating the acquisition, Construction or Completion Thereof ", which became a law February 259 19019 and of all Acts, or parts of Acts amendatory thereof or supplementary thereto. It is further certified that all requirements of the Constitution and laws of 0 "761 A the State of California and of all ordinances Of the said City of BI Segundo, have been fully complied with by the proper officers in the issuing of this bond; that this issue of bonds has been authorized by the vote of two - thirds of the duly qualified electors of said City voting on the question of such issue at a epeoial election duly and regularly called and held in said City on the 21st day Of August, 192E, and that the total amount of this issue, together with all other in- debtedness of said City, does not exceed the limit prescribed by the Constitution and laws of the State of California;* that before or at the time of incurring the indebtedness ev- idenoed hereby, provision has been made for the collection of an annual tax sufficient to pay the interest on such indebtedness as it falls due and also provision to constitute a sinking fund for the payment of the principal thereof on or before maturity. " SECTION 2. That thin ordinance is an emergency measure for the immediate preservation of the public peace, health and safety of said oity, and the facts constituting its urgency are as follows: That said City of 31 Segundo is at the present time in dire need of an adequate and efficient water die - tributing system, with v&ioh to furnish the inhabitants of said city with water for domestic and irrigation use. That the summer season is approaching and that unless funds become available at the earliest practicable moment from the bonds hereinabove referred to, a shortage of water in the said city may ensue, to the great inconven- ience of the inhabitants thereof, and the possible injury to the public peace, health and safety of said city• Furthermore, said city is at the present time without adequate means of properly combatting with water, fires and conflagrations within the said city, and that the funds from the bonds above referred to are required by the public interest and necessity of said city, to pro- vide at the earliest possible moment an adequate supply of water in mains of ample size, to enable the use, 8 at the earliest practicable moment, of the fire fighting equipment recently contracted for by said oity, which said equipment necessitates the availability of adequate - mains and a plentiful supply of water, v&ioh the existing water distributing system within the said city does not possess, and without such additional water supply and increased size of mains, said new equipment would be valueless. That therefore, this ordinance shall take effect immediately upon the final passage and adoption thereof. SECTION 3. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published once in the 91 Segundo Herald, a weekly newspaper, printed, published and circulated in said City.
