ORDINANCE NO. 87 AN ORDINANCE OF THE CITY OF IM SEGUNDO, CALIFORNIA* ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN SAID CITY ON MONDAY, THE 218t DAY OF AUGUST, 192E, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY THE PROPOSITION OF INCURRING A BONDED INDRBTEDNESS FOR THE ACQUISITION, CONSTRUCTION AND CO11PLZ- TION BY SAID CITY, OF A CERTAIN REYEDIUZ_ PRODUCING MUNICIPAL IMPROVMWT , TO WIT: WATER WORKS FOR SUPPLYING SAID CITY AND ITS INHABITANTS WITH WATER, INCLUDING THE ACQUISITION OF LANDS NECESSARY THEREFOR; PROVIDING FOR ELECTION PRECINCTS; MESIGNATING THE POLLING PLACEB; AND APPOINTING X=TION OFFICERS FOR SAID ELECTION; PROVIDING FOR THE ISSUANCE OF BONDS FOR SAID PURPOSE AND FOR THE LEVYING OF A TAX FOR THE PAYMENT OF SAID BONDS. WH-PAK - 3 the Board of Trustees of the City of El Segundo, in the County of , Los Angeles, State of California, by Resolution No. 43 passed and adopted by a vote of two - thirds of all of its members, at a regular meeting of said Board of Trustees held on Wednesday, the 5th day of July, 1922, at the City Hall in said city, being its regular place of meeting therein, did determine that the public ixXterest and necessity of said city demanded the acquisition, construction and 1 completion by said city of a certain revenue - produoing municipal improvement, to wit: water works for supply - ing said city and its inhabitants with water, including the acquisition of lands necessary therefor, and that the estimated cost of said improvement, to wit: the sum of Two hundredihousand dollars ($200,000.00) is and will be too great to be paid out of the ordinary annual income and revenue of said City of El Segundo, and WHEEW said resolution ess duly signed by the President of the Board of Trustees of said city and duly attested by the City Clerk pro tem thereof on the f said 5th day of July, 1922, and entered in the book of resolutions of said city and a Minute of the passage and adoption thereof made on the Minutes of the meeting at which the same me passed and adopted; NOW, T R I OBE, the Board of Trustees of the City of El Segundo do ordain as follows: Section 1. That a Special Municipal Election be and the same is hereby ordered and called to be held in said City of 31 Segundo on Monday, the 21st day of August, 1922, and that at said special election there shall be submitted to the qualified voters of said city the proposition of incurring a bonded indebtedness for the purpose set forth it said Resolution No. 43 passed and adopted on the 5th day of July, 1922, to wit: the acquisition, construction and completion by said City of E1 Segundo of a certain revenue - producing municipal improvement, to wit: water works for supplying said city and its inhabitants with inter, including the acquisition of lands necessary therefor. 2 71.8 T Section 2. That the object and purpose for i which said indebtedness is proposed to be incurred is as follows: the acquisition, construction and oomple- tion by said City of El Segundo of a certain revenue - producing municipal improvement, to wit: water works for supplying said city and its inhabitants with water, including the acquisition of lands necessary therefor. Section 8. That the total estimated cost of the acquisition, construction and completion of said revenue - producing municipal improvement is the sum of Two hundred thousand dollars ($2009000.00), and that J ' said sum is the amount of the principal of the indebt- edness to be incurred therefor and that the maximum rate of interest to be paid on said indebtedness is six per oentum (6%) per annum, payable semi - annually, Ybioh rate shall not'be exceeded in the issuance of bonds for such indebtedness; that if the proposition to incur the indebtedness for said purpose so submitted at such election receive the requisit6 number of votes, to wit: two- thirds of the votes of all the voters of said city voting at such election, bonds of said city in the amount of Two hundred thousand dollars ($2009000.00) shall be issued and sold for the purpose of acquiring, constructing and completing said revenue- produaing municipal improvement; said bonds shall bear interest at a rate not exceeding six per oentum (6 %) per annum, payable semi - annually, and the principal and interest thereof shall be payable in lawful money of the United States of America. That for the purpose of paying the principal a . �._ _ ..: _. and interest of said. bonds , the Board of Trustees of said city shall, at the time of fixing the general tax levy, and in the manner for such general tax levy provided, levy and collect annually each year until said bonds are paid, or until there shall be a sum in the treasury of said city set apart for that purpose, to meet all sums coming due for principal and interest on such bonds, a tax sufficient to pay the annual interest on such bonds, and also such part of the principal thereof as shall become due before the time for fixing the next general tax levy; provided, however, �- that if the maturity of the indebtedness created by any of the aforesaid proposed issues of bonds be made to begin more than one year after the date of the issuance of such bonds, then the tax for the purpose of paying the principal and interest of the bonds, the maturity of which is so deferred, shall be levied and oolleoted at the time and in the manner aforesaid annually each -� year, sufficient to pay the interest on such indebted- nano as it falls due, and also to constitute a sinking fund for the payment of the principal thereof on or before maturity; said tax shall be in addition to all other taxes levied for municipal purposes, and shall be collected at the time and in the same manner as other municipal taxes are oolleoted, and be used for no other - purpose than the payment of said bonds and accruing interest. Section 4. That the Special Election hereby called and ordered to be held shall be held and conducted and the votes thereat received and canvassed and the Ell returns made and the result thereof ascertained, determined and declared as herein provided, and in all particulars not recited herein, according to the laws of the State of California providing for and governing Special Elections in the City of B1 Segundo. There shall be printed on the ballots * be used at such special municipal election, in addition to the other matters required by law, the following proposition to be voted upon, to wit: "Shall the City of El Segundo, California, incur a bonded indebtedness of Two hundred thousand dollars ($2009000.00) for the purpose of acquiring, constructing and completing a certain revenue - producing municipal improve- ment, to wit: water works for supplying said city and its inhabitants with water, including the acquisition of lands necessary therefor ?" And opposite said above proposition to be voted upon, and to the right thereof, shall be printed i the words "Yes" and "Bo" on separate lines with a voting square opposite and to the right of each of said words. Section 5. At said special municipal election, the polls shall be opened at six o'clock A.M. of the day of such election and be kept open until seven o'clock P.M. of the same day, when the polls shall be closed except as provided in Section 1164 of the Political Code of the State of California. The City Clerk is hereby directed to procure all supplies that may be necessary to properly and lawfully conduct said special election. 0 2 721 Section 6. That for the purpose of holding said special municipal election there shall be two voting precincts within the said city, consisting of a consolidation of the regular voting precincts established for holding general state and county elections, as follows: Voting Precinct "A" shall be know as such and shall include all of the territory in the City of El Segundo, California, within the exterior boundaries of El Segundo Precinct No. 19 as the same were fixed by the Board of Supervisors of the County of Los Angeles, California, on the 29th day of December, 1921, and now being of record in Book 78-A of the minutes of the said Board of Supervisors, reference to the same being hereby expressly made for a more particular description of said preoinot, and the said exterior boundaries forming the exterior boundaries of the territory included within said B1 Segundo Precinct No. 1 shall be and constitute, and the same are hereby designated as the exterior boundaries of said Voting Precinct "A ". That the polling place in said Voting Precinct "A" shall be in the basement of the Methodist Church, on the northeast corner of Mariposa Avenue and Main Street, within the said city, and the Board of Election to conduct the said election in said Voting Precinct "A" shall be, and the same is hereby appointed as follows: Inspector: Thomas Levi Tuck Judges: Frederick M. Duley and George Mclauchlin Clerks: Mrs Julia M. Stanton, Mrs Norma N. Stephens and Mrs Violet Thurston 11 N 722 Consolidated Voting Preoinot "B* shall be known as such and shall include all of the territory in the City of E1 Segundo, California, within the exterior boundaries of El Segundo City Preoinot No. 2 and El Segundo City Precinct No. 3, as the same were fixed by the Board of Supervisors of the County of Los Angeles, California, on the 29th day of December, 19219 and now being of record in Book 78 -A of the minutes of the said Board of Supervisors, reference to the same being here - by expressly made for a more particular description of said pceoinots, and the said exterior boundaries forming the exterior boundaries of the territory in- cluded within said Bl Segundo City Precincts Nos. 2 and 3 shall be and constitute, and the same are hereby designated as the exterior boundaries of said donsolid- ated Voting Precinct 'B", said E1 Segundo City Pre- cincts Nos. 2 and 3 being hereby consolidated for the purpose of holding said election. That the polling place in said lonsolidated Voting Precinct "B" shall be in the Council Ohamber of the City Hall of the City of B1 Segundo* Galifo rnia, at the northwest corner of Franklin Avenue and Rich- mond Street, within said 8ity, and the Board of Bleotion to conduct the election in said Consolidated Voting Precinct "B" shall be, and the same is hereby appointed as follows: Inspector: Milford L. Tracy Judges: Claud A. Manson and -- John 0. Fitzgerald, Clerks: William C. Grimes, Mrs. Bffis R. Magee, Mrs. Mary - - B. Rogers. 7 M F, All of the psrsons hereinabove named are hereby appointed as such officers respectively, and their compensation is hereby fixed at the sum of bight Dollars (48.00) , each for said election. Section 76 The ©ity ®lark shall certify to the passage and adoption of this ordinance by a two- thirds vote of all the mewbers of the Board of Trustees of said Oity of BI Segundo* and this ordin- anoe shall be published at least once a week for two (2) weeks prior to the time appointed for the hold- ing of said election, in the 'Bl Segundo Herald ", a weekly n apaper of general circulation, printeds, pub- lished and circulated in said city lose than six days per week, and which is hereby designated for that purpose. Section 8: No other notice of said else- Lion than the aforesaid publication shall be deemed necessary and said publication of this Ordinance shall be sufficient for all purposes. Section 9: This ordinance shall take effect immediately upon its passage and adoption.
