CC RESOLUTION 4649RESOLUTION NO. 4649 A RESOLUTION DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD APRIL 13, 2010. The City Council of the city of El Segundo does resolve as follows: SECTION 1: The City Council finds and declares as follows: A. A General Municipal Election was held in the City of El Segundo on Tuesday, April 13, 2010, as required by law; B. Notice of the election was given in the manner provided by law; C. Voting precincts were properly established, election officers were appointed, votes were cast, votes were received and canvassed and the returns made and declared in the time and manner required by the Elections Code for holding elections in general law cities; D. The City Clerk canvassed the returns of the election and certified the results to the City Council. These results are attached as Exhibit "A," and incorporated by reference. SECTION 2: The whole number of ballots cast in the precincts, except provisional ballots, was 907. The number of provisional ballots cast in the City was 172, The number of vote by mail ballots cast in the City was 1311, making a total of 2390 ballots cast in the City. SECTION 3: The names of persons voted for at the election for Members of the City Council are as follows: CITY COUNCIL Scott Houston Suzanne Fuentes Bill Fisher SECTION 4: The number of votes given at each precinct and the number of votes given in the City to each of the persons named above for the respective offices for which the persons were candidates are as listed in attached Exhibit A. SECTION 5: The City Council declares and determines that Bill Fisher was re- elected and Suzanne Fuentes was elected as Members of the City Council for full terms of four years. -1- SECTION 6: That the measure voted upon at the election (Measure M) is as follows: SHALL THE ORDINANCE AMENDING EL SEGUNDO MUNICIPAL CODE Yes ❑ CHAPTER 3 -7 THAT IMPOSES A UTILITY USER TAX ON NON- RESIDENTIAL USERS IN THE CITY BY UPDATING AND REPLACING No ❑ THE TELEPHONE TAX REGULATIONS WITH MODERN COMMUNICATION SERVICES TAX REGULATIONS BE ADOPTED? SECTION 7: That the measure voted upon at the election (Measure N) is as follows: SHALL THE ORDINANCE AMENDING EL SEGUNDO MUNICIPAL CODE Yes ❑ §§ 4 -2 -1, 4 -2 -3, AND 4 -2-4 AND ADDING A NEW § 4 -2-44 TO ALLOW ANNUAL INCREASES TO THE BUSINESS LICENSE TAX TO FUND No ❑ GENERAL MUNICIPAL SERVICES INCLUDING, WITHOUT LIMITATION, POLICE PROTECTION AND CRIME SUPPRESSION SERVICES, FIRE PREVENTION AND SUPPRESSION SERVICES, AND PARK AND RECREATION FACILITIES AND SERVICES BE ADOPTED? SECTION 8: That the number of votes given at each precinct and the number of votes given in the City for and against these measures are as listed in Exhibit A. SECTION 9: The City Council declares and determines that as a result of the election, Measure M received a majority vote accordingly, Ordinance No. 1438 is adopted. Pursuant to Elections Code § 9217, Ordinance No. 1438 will become effective ten (10) days after the adoption of this Resolution. SECTION 10: The City Council declares and determines that as a result of the election, Measure N received a majority vote in favor accordingly, Ordinance No. 1439 is adopted. Pursuant to Elections Code § 9217, Ordinance No. 1439 will become effective ten (10) days after the adoption of this Resolution. SECTION 11: The City Clerk is directed to enter in the City's records a statement of the result of the election, showing: (1) the whole number of ballots cast in the City; (2) the -2- names of the persons voted for; (3) the number of votes given at each precinct to each person; and (4) the total number of votes given to each person. SECTION 12: The City Clerk will immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; the City Clerk will also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and will have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected will then be inducted into the respective office to which they have been elected. SECTION 13: The City Clerk will certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
