4310.. JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, AND THE CITY COUNCIL OF THE CITY OF HAWTHORNE, APPROVING AND ACCEPTING THE NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUE RESULTING FROM REORGANIZATION OF TERRITORY (LOS ANGELES AIR FORCE BASE REORGANIZATION NO. 2003 -01) (Detachment from the City of El Segundo and Annexation to the City of Hawthorne and Consolidated Fire Protect District of Los Angeles County) WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, for specified jurisdictional changes, the governing bodies of the affected agencies shall negotiate and determine the amount of property tax revenue to be exchanged between the affected agencies; and WHEREAS, the Board of Supervisors of the County of Los Angeles as the governing body of the County of Los Angeles, the Consolidated Fire Protection District of Los Angeles County (herein referred to as CFPD), and the Los Angeles County Public Library (herein referred to as Public Library), the City Council of the City of El Segundo as the governing body of the City of El Segundo, the City Council of the City of Hawthorne as the governing body of the City of Hawthorne have determined that the amount of property tax revenue to be exchanged between their respective agencies as a result of the reorganization of territory entitled, "Los Angeles Air Force Base Reorganization No. 2003 -01," which includes detachment of said territory from the City of El Segundo, annexation to the City of Hawthorne, and annexation to the CFPD is as set forth below: NOW, THEREFORE, BE IT RESOLVED as follows: 1. The negotiated exchange of property tax revenues between the County of Los Angeles, the City of El Segundo, and the City of Hawthorne resulting from the reorganization proposal identified as "Los Angeles Air Force Base Reorganization No. 2003 -01," is approved and accepted. 2. For fiscal years commencing on or after July 1, 2004, or the July 1 after the effective date of this jurisdictional change, whichever is later, $1,856.13 in base property tax revenue shall be transferred from the City of El Segundo to the County of Los Angeles. In addition, for each fiscal year commencing on or after July 1, 2004, or the July 1 after the effective date of this jurisdictional change, whichever is later, the City of El Segundo annual tax increment attributable to the "Los Angeles Air Force Base Reorganization No. 2003 -01," shall be transferred from the City of El Segundo to the County of Los Angeles. annnex/aty /el segundo_hawthome_ tax transfer resolution 3. For fiscal years commencing on and after July 1, 2004 or the July 1 after the effective date of this jurisdictional change, whichever is later, $2,833.59 in base property tax revenue shall be transferred from the County of Los Angeles to the City of Hawthorne. In addition, for each fiscal year commencing on or after July 1, 2004, or the July 1 after the effective date of this jurisdictional change, whichever is later, 0.09646395 of the annual tax increment attributable to the "Los Angeles Air Force Base Reorganization No. 2003 -01" area shall be transferred from the County of Los Angeles to the City of Hawthorne. 4. For fiscal years commencing on and after July 1, 2004 or the July 1 after the effective date of this jurisdictional change, whichever is later, $0 in base property tax revenue shall be transferred to the CFPD from the County of Los Angeles. In addition, for each fiscal year commencing on or after July 1, 2004, or the July 1 after the effective date of this jurisdictional change, whichever is later, no portion of the annual tax increment attributable to the "Los Angeles Air Force Base Reorganization No. 2003 -01 " area shall be transferred from the County of Los Angeles to the CFPD. Funding provided to the CFPD to serve the annexed area shall be negotiated by CFPD directly with the City of Hawthorne under the terms of a separate and existing agreement entitled "AGREEMENT FOR SERVICES BY AND BETWEEN THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY AND THE CITY OF HAWTHORNE" made and entered on December 12, 1996. 5. For fiscal years commencing on and after July 1, 2004 or the July 1 after the effective date of this jurisdictional change, whichever is later, $743.91 in base property tax revenue shall be transferred from the County of Los Angeles to the Public Library. In addition, for each fiscal year commencing on or after July 1, 2004, or the July 1 after the effective date of this jurisdictional change, whichever is later, .025325101 of the annual tax increment attributable to the "Los Angeles Air Force Base Reorganization No. 2003-01" area shall be transferred from the County of Los Angeles to the Public Library. 6. For fiscal years commencing on or after July 1, 2004 or the July 1 after the effective date of this jurisdictional change, whichever is later, the County of Los Angeles General Fund share of the annual tax increment attributable to the "Los Angeles Air Force Base Reorganization No. 2003 -01 " shall be adjusted to account for the full one percent of ad valorem property tax after implementing the adjustments specified in paragraphs 2 through 5. 6. PELLMAN VIOLET VARONA- LUKENS, Executive Officer Clerk of the Board of Supervisors Of the County of Los Angeles _ +,, ' in -• (signed in counterparts) annnex/city /el segundo_hawthorne_ lax transfer resolution 5 RESOLUTION 2003 -13RD RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION FOR LOS ANGELES COUNTY MAKING DETERMINATIONS APPROVING AND ORDERING CITY OF El SEGUNDO REORGANIZATION NO. 2003 -01 AND AMENDING THE SPHERES OF INFLUENCE OF THE CITIES OF El SEGUNDO AND HAWTHORNE WHEREAS, the City of El Segundo adopted a resolution of application to initiate proceedings before the Local Agency Formation Commission for Los Angeles County (the "Commission ") pursuant to Part 3, Division 3, Title 5 of the California Government Code (commencing with section 56000, the Cortese -Knox- Hertzberg Local Government Reorganization Act of 2000), for the reorganization of territory, including the detachment of the territory herein described from the City of El Segundo and its annexation to the City of Hawthorne, and the Los Angles County Consolidated Fire Protection District; and WHEREAS, the principal reason for this reorganization is to retain Los Angeles Air Force Base in Southern California and prevent the loss of jobs critical to the economy of the South Bay area; and WHEREAS, a description of the boundaries and map of the proposal is set forth in Exhibits "A" and "B," attached hereto and by this reference incorporated herein; and WHEREAS, the subject territory is uninhabited and consists of 50 f acres; and WHEREAS, the short-form designation given this proposal is "City of El Segundo Reorganization No. 2003 -01;" and WHEREAS, on June 11, 2003, the Commission adopted a motion waiving the notification and public hearing requirements for this proposal, pursuant to Government Code sections 56662 and 56663(a), all owners of land within the territory and all affected agencies 4310 having consented to waiver of notice and public hearing; and WHEREAS, the Executive Officer has reviewed the proposal and submitted to the Commission a report, including his recommendation thereon; and WHEREAS, on August 13, 2003, this proposal came before the Commission at which time this Commission heard and received all oral and written testimony, objections and evidence which were made, presented or filed, and all persons present were given an opportunity to hear and be heard with respect to this proposal and the report of the Executive Officer. NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Commission, acting in its role as a responsible agency with respect to City of El Segundo Reorganization No. 2003 -01, pursuant to the California Environmental Quality Act ( "CEQA ") State Guidelines section 15096, hereby certifies that it has independently considered and reached its own conclusions regarding the environmental effects of the proposed project and the environmental documents certified by the City of El Segundo, as lead agency, namely Environmental Impact Statement /Environmental Impact Report Sch. No. 200207116 ( "EIS /EIR ") and City of El Segundo Resolution No. 4314, approving and certifying the final EIS /EIR and Statement of Overriding Considerations, and has determined that the documents adequately address the environmental impacts of the proposed project. The Commission finds that it has complied with the requirements of CEQA with respect to the process for a responsible agency, and hereby adopts by reference the environmental findings previously adopted by the City of El Segundo in connection with its certification of that report for the proposed project. 2. The Commission hereby amends the spheres of influence of the City of El Segundo and the 2 4-131 0 . City of Hawthorne, and makes the following determinations in accordance with Government Code section 56425: a. Present and planned land uses in the area: The project site is currently owned by the USAF and is not subject to local land use and zoning controls. Existing El Segundo General Plan and zoning designations reflect use of the site as Federal Facilities. Future development of the project site will be governed by the provisions of land use entitlements processed in Hawthorne that establish uses, density and development standards applicable to the site. These entitlements permit development of up to 750 residential units. The proposed development is in conformance with the City of Hawthorne General Plan. Agricultural and open- spaced lands will not be affected by the proposal. b. Present and probable need for public facilities and services: The subject territory is currently undeveloped and uninhabited. Upon development and habitation, public facilities and services will be required to meet the needs of the community and will be provided as set forth in (c), below. C. The present capacity of public facilities: Adequate public service facilities are available to service the site. Fire Protection The City of El Segundo Fire Department currently provides fire protection services to the subject territory. Fire protection services are provided to the City of Hawthorne by the Los Angeles County Consolidated Fire Protection District ( "CFPD ") on a contractual fee - for - service basis. Services will be extended to include the project area and it is anticipated that the CFPD will be providing services at a greater level once development is completed and has indicated that it can absorb the additional demand for services. Library Public Library Services will be provided by the Los Angeles County Public Library ( "LACPL "). LAPCL has indicated that the size of Wiseburn Library, the closest facility may not be adequate to serve the need of additional residents; however, no developer fees are currently required for impacts to LAPCPL services in the City of Hawthorne. Statements of Overriding Considerations were adopted by Hawthorne and El Segundo that set forth the reasons why this impact is outweighed by the benefits of the project. Parks /Recreation Public parks are provided in the area of the proposed residential development to meet park and recreation service needs. However, the City of Hawthorne has indicated that existing parks are overcrowded and cannot adequately serve 3 43 10 additional population growth in the area. Payment of fees to provide additional park facilities is not feasible in the case of the Project. Statements of Overriding Considerations were adopted by Hawthorne and El Segundo that set forth the reasons why this impact is outweighed by the benefits of the project. Police Services The proposal area currently receives police protection services from the City of El Segundo Police Department. Security is also provided by the United States Air Force, 61s' Security Forces Squadron. Upon annexation the area will be serviced by the City of Hawthorne Police Department. The proposed development would not result in the need for new police stations; however, the impact of additional residents would require three to four additional police officers and equipment. The additional expenditure for added personnel will be absorbed by the City of Hawthorne through their annual budget process. Funding of additional equipment is not available but poses a less than significant impact. Sewer /Wastewater Services The area is within the jurisdictional boundaries of Los Angeles County Sanitation District No. 5. The developer will be required to pay the required sewer connection fees. Solid Waste Solid Wastes generated by the residential development will be less than that currently generated by the existing commercial uses. Waste hauling will be provided by a private hauler or through any hauler that contracts for services with the City of Hawthorne. Street Lighting Upon annexation to the City of Hawthorne, street lighting services will be provided through assessment district fees billed by the County of Los Angeles as part of the annual property tax bill. Water Water service to the subject area is provided by the Southern California Water Company, a private purveyor, and will continue to be served them upon annexation. A sufficient supply of water is available to meet the anticipated increase in demand. d. The existence of any social or economic communities of interest: There are currently no social or economic communities of interest within the subject territory; however, the City of Hawthorne has approved the inclusion of Area A to the City's Redevelopment Project Plan (Project No. 2). 3. A description of the boundaries and map of the proposal, as approved by this 12 Commission, is set forth in Exhibits A and B, attached hereto and by this reference incorporated herein. 4. The subject territory consists of 50 ± acres, is uninhabited, and is assigned the following distinctive short form designation: "City of El Segundo Reorganization No.2003 -01" 5. The Commission has considered the factors set forth in Government Code section 56668 and all other relevant factors in reaching its conclusions regarding the proposal, and based thereon finds that: a. The proposed reorganization would occur in an urbanized area of the County. Proposed residential development would occur in developed areas containing existing urban infrastructure systems. The proposed residential development would accommodate population growth in this area of the County that is projected to occur in this area during the next 10 years in accordance with the adopted Southern California Association of Governments ( "SCAG ") forecasts for Hawthorne and the South Bay Cities subregion. This population growth would occur in proximity to other populated areas. Although the population density would be higher than the immediately adjacent residential area, the population density resulting from development of the reorganized territory would be consistent with recent trends in the Hawthorne and the South Bay Cities subregion. Proposed development would be consistent and compatible with adjacent residential uses through the application of development and design controls and requirements for landscape buffers between proposed and existing residential areas. Proposed development would occur on land characterized by generally level topography containing no natural features or boundaries. The development site is drained by an existing urban storm drain system maintained by the Los Angeles County Department of Public Works. b. Proposed development would require organized community services in the areas of police protection, fire protection, schools, public parks and public libraries and utility services in the areas of water service, waste water disposal and treatment and solid waste disposal. Police protection services would be provided by the Hawthorne Police Department. Provision of police services to this area of the City would require additional officers and equipment, which would be provided over time in accordance with the established City budgeting procedures. Satisfactory police protection services can be provided to the residential 5 development on the project site. Fire protection services would be provided by the CFPD in accordance with an existing Agreement for Services between the CFPD and Hawthorne. The CFPD has indicated that it can absorb additional demand for services that would be associated with the proposed residential development. School services are provided by the Wiseburn School District (elementary/middle school) and Centinela Valley Union School District (high school). Both school districts have indicated that they can adequately serve the projected growth in school age students that would result from the proposed residential development. Public parks are provided in the area of the proposed residential development to meet park and recreation service needs. However, the City of Hawthorne has indicated that existing parks are overcrowded and cannot adequately serve additional population growth in the area. Payment of fees to provide additional park facilities is not feasible in the case of the Project. Statements of Overriding Considerations were adopted by Hawthorne and El Segundo that set forth the reasons why this impact is outweighed by the benefits of the project. Public library services are provided by the LACPL system. LACPL has indicated that the size of Wiseburn Library, the closest library facility, may not be adequate to serve additional residents in the area and that, because of County wide fiscal constraints, LACPL may not be able to expand the existing facility in a timely manner. No development impact fees are required in Hawthorne for library services. Statements of Overriding Considerations were adopted by Hawthorne and El Segundo that set forth the reasons why this impact is outweighed by the benefits of the Project. Water service to the Project would be provided by the Southern California Water Company, which has indicated that sufficient infrastructure is available to serve the Project. Water consumption on the affected territory would decrease by approximately 1,500 gallons per day compared to the existing uses on the Project site. Wastewater conveyance and treatment is provided by the Los Angeles County Sanitation Districts, which has indicated that adequate conveyance and treatment capacity is available to serve the Project. Wastewater generation on the Project site would decrease by approximately 1,250 gallons per day compared to the existing uses on the Project site. Disposal of solid waste generated by the proposed project would be provided at one or more existing County landfills. There is available capacity at these existing landfills to accommodate solid waste generated on the project site. Solid waste generation on the project site would decrease by approximately 760 pounds per day compared to the existing uses on the project site. C. The proposed action will have a generally positive effect on adjacent areas by providing a more compatible residential land use than currently exists on the site. The site is currently occupied by LAAFB offices, parking and buildings. Based upon approvals granted by El Segundo, Hawthorne, and Los Angeles County, the proposed action is in the best mutual social and economic interest of all jurisdictions involved, given the potential for the Air Force Base to close, which 6 43 ?p will have a detrimental effect to the region. The reorganization should not have a detrimental effect on the local government structure of the County. d. The proposal will provide for a well - planned, orderly and efficient pattern of urban development. The site is currently developed. Redeveloping this infill site with residential uses will provide much needed housing to support the strong employment base in the area surrounding the site. Existing infrastructure and services will be available to serve the development. The proposal is a compatible land use to the surrounding residential uses to the north and south of the site. The proposal also complies with Government Code Section 56377, as the proposal is located in an urbanized area and will not affect prime agricultural lands. e. The Project site is located in urbanized areas and has not been not used for agricultural purposes for at least 50 years. The Project would not result in the conversion of Prime Farmland, Unique Farmland, or Farmland of Statewide Importance (Farmland), as shown on the maps prepared pursuant to the Farmland Mapping and Monitoring Program of the California Resources Agency, to non- agricultural use. The Project site is not zoned for agricultural use, and no Williamson Act contracts apply. The Project would not involve other changes in the existing environment, which, due to their location or nature, could result in conversion of farmland to a non - agricultural use. f. The boundaries of the territory have been clearly established. The proposed boundaries of the proposal correspond to lines of assessment or ownership. The southern and eastern boundaries match the current city limit line for Hawthorne. The proposal does not create any new islands of unincorporated territory. g. On July 17, 2003 the City of Hawthorne amended its General Plan to add the proposed site to the General Plan as the "Pacific Glen Specific Plan" area, and therefore, the proposal is fully consistent with the City General Plan and the adopted Specific Plan. h. The proposed reorganization includes an amendment to the spheres of influence of Hawthorne and El Segundo, and if approved will be consistent therewith. i. Hawthorne should generate sufficient revenue from the territory to provide services. The affected local agencies have entered into a tax transfer resolution to transfer the territory's property tax revenues to Hawthorne. The Hawthorne Redevelopment Agency, and the developer have entered into an Owner Participation Agreement, and the developer and Hawthorne have entered into a development agreement. Both of these agreements provide mechanisms for Hawthorne to receive payments from the developer or from local bond revenue to compensate Hawthorne for some of the costs of providing services which are the subject of this proposal. 7 40 E 3 j. The Project site is located in an urbanized area served by existing water infrastructure. Existing land uses on the site already consume water. The proposed residential development on the Project site would consume approximately 1,500 gallons per day less water than is consumed by the existing uses. The Southern California Water Company has confirmed in writing that it has adequate infrastructure to meet the expected demand for water. k. This proposal is unique in that the Project area was not within the Sphere of Influence of Hawthorne, nor designated for housing by El Segundo. The proposal will greatly assist Hawthorne in achieving its fair share of the regional housing need since as many as 750 units would be added to the local housing stock that were not anticipated prior to the initiation of the Project. The Project would provide housing units that exceed the fair share of regional housing needs established by SCAG for Hawthorne in the most recent Regional Housing Needs Assessment (RHNA, November, 2000). The Project would include 750 residential units, while the RHNA total for Hawthorne between 2000 and 2005 is 597 units of all income levels (189 above moderate income units). Moreover the project would include a 20% tax increment set aside for the construction of low and moderate income units elsewhere in the City and would generate a requirement for the construction of 113 low and moderate income units (15% of the total units constructed) in Hawthorne, which would work to fulfill the City's RHNA requirement of 409 low and moderate income units between 2000 and 2005. The proposed project would include development of new residential units that would accommodate projected population growth in Hawthorne and the South Bay Cities subregion contained in adopted SCAG forecasts. The Project would provide housing in a jobs -rich area, thus providing enhanced opportunities for employees to reside closer to their place of employment. The Project would implement a number of important regional growth policies related to location of housing near employment centers and location of urban development in areas that are currently well - served by transportation and utility infrastructure and that do not contain substantial biological, ecological or other natural resources. 1. The Project site is currently owned by the USAF and is not subject to local land use and zoning controls. Existing El Segundo General Plan and zoning designations reflect use of the site as Federal Facilities. Future development of the Project site will be governed by the provisions of land use entitlements processed in Hawthorne that establish uses, density and development standards applicable to the site. These entitlements permit development of up to 750 residential units on the Project site. Proposed development is in conformance with the land use entitlements adopted by Hawthorne. Ef 431p.. .. 6. The Commission hereby approves City of El Segundo Reorganization No.2003 -01 subject to the following terms and conditions: a. Detachment of the subject territory from the City of El Segundo. b. Annexation of the subject territory to the City of Hawthorne. C. Annexation of the subject territory to Los Angeles County Consolidated Fire Protection District. d. The territory so annexed shall be subject to the payment of such service charges, assessments or taxes as the City of Hawthorne may legally impose. e. The regular County assessment roll shall be utilized by the City of Hawthorne. f. The subject territory will not be taxed for existing bonded indebtedness of the City of El Segundo. 7. Pursuant to Government Code section 56663(c), the Commission hereby finds and determines that: a. The territory to be annexed is uninhabited; b. All owners of land within the affected territory have given their written consent to the change of organization; and C. All affected local agencies that will gain or lose territory as a result of this change of organization have consented in writing to a waiver of Commission protest proceedings. Based thereon, protest proceedings are waived. C 1. - ; 8. Based upon the above, the Commission hereby orders the uninhabited territory described in Exhibits A and B detached from the City of El Segundo and annexed to the City of Hawthorne and the Los Angeles County Consolidated Fire Protection District. 9. The Executive Officer is directed to transmit a certified copy of this resolution to the City Clerks of the Cities of El Segundo and Hawthorne upon the payment of the applicable fees required by Government Code Section 54902.5, and prepare, execute and file a certificate of completion with the appropriate public agencies, pursuant to Government Code section 57200, et seq.
