CC RESOLUTION 4219RESOLUTION NO. _42j_g A RESOLUTION FINDING THE CITY TO BE IN COMPLIANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL IMPLEMENTATION REPORT PURSUANT TO GOVERNMENT CODE § 65089. The city council of the city of El Segundo does resolve as follows: SECTION 1: The city council finds that: A. The Los Angeles County Metropolitan Authority ( "MTA "), acting as the Congestion Management Agency for Los Angeles County, adopted the 1999 Congestion Management program in December 1999; B. As adopted, the CMP requires that MTA annually determine that Los Angeles County and cities within the County conform with all CMP requirements; C. Among other things, the CMP requires municipalities within Los Angeles County to submit Local Implementation Reports to the MTA by September 1 each year; D. The City Council held a noticed public hearing on August 7, 2001 during which it considered the evidence presented by staff and the public regarding how the City has implemented measures designed to mitigate the impacts of traffic congestion resulting from new development; E. Based upon the August 7, 2001 public hearing, the City Council determined that By June 15 of odd- numbered years the City conducts annual traffic counts and calculated levels of service for selected arterial intersections consistent with the requirements identified in the CMP Highway and Roadway System Chapter; 2. The City adopted and continues to implement a transportation demand management ordinance consistent with the minimum requirements identified in the CMP Transportation Demand Management Chapter; 3. The City adopted and continues to implement a land use analysis program consistent with the minimum requirements identified in the CMP Land Use Analysis Program Chapter; and 12:14 PM Resolution No. 4919 Adopting CMP Local Implementation Report 4. The City adopted the attached Year 2001 Local Implementation Report, which is incorporated into this Resolution, consistent with the requirements identified in the CMP. This report balances traffic congestion impacts due to growth within the City with transportation improvements, and demonstrates that the City meets its responsibilities under the County -wide Deficiency Plan. SECTION 2: In accordance with its findings, the City Council determines that the City of El Segundo is in compliance with all requirements of the 1999 CMP. SECTION 3: This Resolution will remain effective until superseded by a subsequent resolution. SECTION 4: This Resolution will take effect immediately upon adoption.
