CC RESOLUTION 4023RESOLUTION NO. 4023 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING AN ADDENDUM. TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF EL SEGUNDO, CALIFORNIA, AND THE EL SEGUNDO SUPERVISORY AND PROFESSIONAL EMPLOYEES ASSOCIATION WHEREAS, the City has met and conferred in good faith with representatives of the El Segundo Supervisory & Professional Employees Association; and WHEREAS, discussions which have taken place in the meet and confer process have resulted in a mutually agreeable addendum to the Memorandum of Understanding between the Cify of El Segundo and this Association; NOW, THEREFORE, be it resolved, by the City Council of the City of El Segundo as follows: SECTION 1. That staff is authorized to implement all terms and conditions of the addendum to the Memorandum of Understanding between the City of El Segundo and the El Segundo Supervisory and Professional Employees Association. SECTION 2. 1 -he City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. This addendum to the Memorandum of Understanding between these parties, effective April 15, 1995 through and including midnight of June 30, 1998, is entered into between the California Teamsters Public, Professional and Medical Employees' Union, Local 911, and the management representatives of the City of El Segundo pursuant to Government Code Section 3500 et seq., and City Resolution No. 3208. 2. The parties have met and conferred in good faith and have jointly prepared this Addendum to the Memorandum of Understanding. 3. This addendum incorporates the following items: a. Effective July 5, 1997, the base salary set forth within each step of the salary range applicable to each represented classified position shall be increased by 3 %. b. Effective July 1, 1997, or as soon thereafter as is possible, the City shall establish a Catastrophic Leave Bank for represented employees in accordance with Attachment A attached hereto. PURPOSE To establish a program whereby City employees may donate accumulated time to a catastrophic sick leave bank to be used by permanent, part -time and full -time employees who are incapacitated due to a catastrophic illness or injury. II. DEFINITION A catastrophic illness or injury is a chronic or long term health condition that is incurable or so serious that, if not treated, it would likely result in a long period of incapacity. III. PROCEDURES BWss hAcftn971caUvbnkspe A. There is established a joint - employer /employee committee composed of an individual from each recognized employee organization and a representative of City Administration charged with administering the Catastrophic Leave Bank. B. Employees may transfer sick leave, vacation or compensatory leave to the Catastrophic Leave Bank to be donated to an employee who is experiencing catastrophic illness and has exhausted all personal sick leave. Such a transfer can be made on July 1 of each year on forms provided by the City of El Segundo. The employee to receive the donation will sign the "Request to Receive Donation" form allowing publication and distribution of information regarding his /her situation. C. Sick leave, vacation and compensatory time leave donations will be made in increments of no less than one day. These will be hour for hour donations. D. Employees must, at the time of donation, have a minimum of one hundred and twenty (120) hours of accumulated illnesslnjury leave remaining after a donation has been made. E. The donation of time is irrevocable. Should the recipient employee not use all of the donated time for the catastrophic illness or injury, any balance will remain in the Catastrophic Leave Bank to be administered by the committee and utilized for the next catastrophic leave situation.
