A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, APPROVING SEPULVEDA ACCESS TO A 3.52 ACRE
PARCEL LOCATED AT THE SOUTHEAST CORNER OF SEPULVEDA
BOULEVARD AND MARIPOSA AVENUE FOR COMMERCIAL
DEVELOPMENT. PETITIONED BY NEW GROUP AND PTR HOMESTEAD
VILLAGE, INC..
WHEREAS, an application has been received from New Group and PTR Homestead Village,
Inc. requesting the lifting of prohibitions on access from Sepulveda Boulevard to an approved
development of a 43,206 square foot Ralph's Supermarket, and a 4,900 square foot
retail /restaurant building development on a 3.52 acre property located at 1910 E. Mariposa
Avenue in the General Commercial (C -3) Zone; and
WHEREAS, an Environmental Assessment (EA -399), including a Draft Initial Study and
Mitigated Negative Declaration of Environmental Impacts for the Ralph's Supermarket and
retail /restaurant building and Sepulveda Boulevard access, has been prepared and circulated to
all interested parties, staff, and affected public agencies for review and comment in the time and
manner prescribed by law; and
WHEREAS, the Planning Commissionreviewedthe application and supporting evidence with
the authority and criteria contained in the' California Environmental Quality Act, State CEQA
Guidelines, and the City of El Segundo Guidelines for the Implementation of the California
Environmental Quality Act (Resolution No. 3805); and
WHEREAS, an addendum to a Traffic Impact Study (EA -383, Subdivision 96 -3, Homestead
Village Hotel), was prepared to evaluate transportation and circulation impacts associated with
the project and the proposed access from Sepulveda Boulevard, and submitted with the
application; and
WHEREAS, onJanuary 30,1997, the Planning Commission did hold, pursuant to law, a duly
advertised public hearing on such matter in the Council Chamber of the City Hall, 350 Main
Street, and notice of the public hearing was given in the time, form and manner prescribed by law;
and
WHEREAS, opportunity was given to all persons present to speak for or against the findings
of Environmental Assessment EA -399, and Subdivision 96 -8 (Tentative Parcel Map No. 24631); and
WHEREAS, on February 18, 1997 the 'City Council did hold, pursuant to law, duly -
advertised public hearing on such matter in the Council Chamber of the City Hall, 350 Main
Street, and notice of hearing was given in the time, form and manner prescribed by law; and
WHEREAS, at said hearing the following facts were established:
1. The Planning Commission adopted Resolution No. 2032 on July 14, 1983, approving
Subdivision 82 -2 (Tract Map No. 15 115) to subdivide an existing 44 acre Parcel into four
(4) parcels of land. The Environmental Impact Report (EIR) for this subdivision, which
approved the original subdivision of the El Segundo Research Center, included as a
mitigation measure the limiting of access from Sepulveda Boulevard by either allowing

access only with an acceleration /deceleration lane or prohibiting access altogether. This
mitigation measure was incorporated into Planning Commission Resolution No. 2032 on
July 14, 1983, as a specific prohibition on access to any portion of the site from Sepulveda
Boulevard. This language was also incorporated into a recorded Agreement Affecting Real
Property (AARP) between the City and the applicant (Instrument No. 84- 313091).
2. The Planning Commission adopted Resolution No. 2097 on January 24, 1985, approving
Subdivision 84 -5 /Parcel Map No. 16543, to subdivide a portion of one of the four parcel
original created by 'Subdivision 82 -2. ;The prohibition on access to the property from
Sepulveda Boulevard was continued and an Owners Statement was placed on the Parcel
Map granting the City the right to restrict access to the property .
3. The Planning Commission adopted Resolution No. 2384 on September 12,1996, approving
EA -383, Subdivision 96 -3 (Tentative Parcel Map 24995) to subdivide an existing 6.7 acre
Parcel into two (2) Parcels and construct a 150 -room extended stay business hotel
(Homestead Village) on Parcel 1 (3.18 acres) and one of six development alternatives on
Parcel 2 (3.52 acres).
4. The Planning Commission adopted Resolution No. 2387 on January 30, 1997, approving
EA -399, Subdivision 96- 8(Tentative Parcel Map 24631) to subdivide Parcel 2 of Tentative
Parcel Map 24995 into two (2) parcels for the development of a 43,206 square foot Ralph's
Supermarket and a 4,900 square foot retail /restaurant building. The applicant is proposing
access from ,Sepulveda Boulevard to the project site and the construction of an
acceleration /deceleration lane to facilitate access.
5. The Planning Commission, in Resolution No. 2387, recommended approval of the lifting
of the restrictions prohibiting access to developments on the project site from Sepulveda
Boulevard.
6. The proposed project is subject to the California Environmental Quality Act (CEQA). In
accordance with State guidelines and local requirements, a Draft Initial Study and Mitigated
Negative Declaration was prepared and circulated for interdepartmental and affected
agency review. No significant adverse impacts were identified which could not be
mitigated to an insignificant level, including impacts to land use planning,
transportation /circulation, hazards, public services, and aesthetics.
7. The California Department of Transportation (Caltrans) has reviewed and approved the
design of the Sepulveda Boulevard (State Highway No. 1) access and
acceleration /deceleratio_ lane on January 18, 1997 (Permit No. 796 -6CS- 1130).
NOW, THEREFORE, BE ITRESOIVED that after considering the above facts and study of proposed
modifications to Sepulveda Boulevard access restrictions the City Council makes the following
findings:
SUBDIVISION MAP ACT CONSISTENCY
1. The proposed map, design and improvements of the Subdivision are consistent with the
General Plan Land Use designation of General Commercial.

2. The site is physically suitable for the proposed type and density of development, since it
is level, and is not located in an area of unstable topography, flood hazards, or a fault
rupture study zone. The parcels created by the proposed subdivision have adequate
frontage on public streets, exceed the minimum parcel size established for the C -3 Zone,
and are well below the allowed Floor Area Ratio (FAR) or density.
3. The design of the Subdivision and improvements, specifically the acceleration /deceleration
lane and Sepulveda Boulevard access, are not likely to cause serious impacts to public
health, safety, and welfare.
4. With the provision of an emergency vehicular access easement to serve Parcel 1 of
Tentative Parcel Map 24495, the proposed subdivision and improvements will provide
adequate access through and use of the subdivision.
S. The subdivision is consistent with the approval of EA -383, Subdivision 96 -3 /Tentative
Parcel Map 24495.
ZONING CODE CONSISTENCY
1. The site is zoned C -3 (General Commercial), which permits retail uses, hotels, motels,
medical - dental offices, public uses, recreational facilities, restaurants and general offices
not exceeding 5,000 square feet at a FAR of 1.0. The proposed land uses are permitted
under the existing Zoning designation.
• 2. The combined FAR for Parcels 1 and 2 would be 0.3 1, well below the 1.0 FAR limit. The
FAR for Parcel 1 is proposed at 0.33 and Parcel 2 will not exceed 0.23 FAR.
GENERAL PLAN CONSISTENCY
1. The proposed Sepulveda Boulevard access is consistent with the following General Plan
Economic Development Goals and Policies: ED 1 -2.1, ED 1 -2.2, and ED 1 -2.3, which relate
expanding the retail and commercial base to meet diverse needs, targeting industries that
balance economic development and quality of life goals, and balancing development with
resource and infrastructure capacity.
2. The proposed Sepulveda Boulevard access is consistent with the following General Plan
Land Use Goals, Objectives, and Policies: LU 4 -1, LU 4 -1.1, LU 4 -1.4, LU7 -1, LU 7 -1.2 and LU
7 -2.3. These issues relate to promoting high quality retail in proximity to major
employment, providing landscaping, insuring seismic safety and conformance with
environmental regulations, and requiring adequate public facilities and underground
utilities.
3. The proposed Sepulveda Boulevard access is consistent with the following General Plan
Objectives and Policies related to Circulation: C 1 -1.13, C 1 -1.15, C 1 -1.17, C 2 -1.4, C 3 -1,
C 3 -1.1, C 3 -1.5, and C 4 -2.4. These policies require full examination of project traffic
impacts and complete mitigation, encourage cooperation with other governmental
agencies, adequate right -of -way, provision of sidewalks for all new projects, full mitigation
of all project - related circulation impacts, ensure roadway improvements maintain
acceptable levels of service, and requiring developers to pay for mitigation measures.

NOW,1TiEREFORE, BE IT FURTHER RESOLVED.that the City Council approves the lifting of access
restrictions to Tentative Parcel Map 24631 from Sepulveda Boulevard, subject to the following
conditions and mitigation measures:
1. Prior to approval of the building plans, the applicant shall develop plans which indicate
that the project is in substantial conformance with plans approved and on file with the
Department of Planning and Building Safety. Any subsequent modification to the project
as approved shall be referred to the Director of Planning and Building Safety for a
determination regarding the need for Planning Commission review of the proposed
modification.
2. The applicant shall submit an amendment to the Agreement Affecting Real Property
(Instrument No. 84- 313091), originally approved on January 24, 1984, to the Director of
Planning and Building Safety and the City Attorney for review, and approval by the Mayor
(on behalf of the City Council). The amendment shall eliminate the prohibition on
Sepulveda Boulevard access to the subject property and shall be recorded with the County
Recorder's Office prior to issuance of a Certificate of Occupancy for the Ralph's
Supermarket building or the retail /restaurant building, whichever comes first.
3. The applicant shall pay the City Attorney's costs for reviewing the amended Agreement
Affecting Real Property, or any such agreements required.
4. All work within the City public right -of -way shall be in accordance with the latest edition
of the Standard Specifications for Public Works Construction and City of El Segundo
Standard Specifications. No work shall be performed in the Sepulveda Boulevard public
right -of -way without first obtaining a Public Works approval and a Caltrans permit .
SECTION 1: The City Clerk shall certify to the passage and adoption of this Resolution; shall
entered the same in the book of original resolutions of said city; and shall make a
minute of the passage and adoption thereof in the records of the proceedings of the
City Council of said City, in the minutes of the meeting which the same is passed
and adopted.
