CC RESOLUTION 3979• RESOLUTION NO. 3979 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION DECISION, THEREBY DENYING ENVIRONMENTAL ASSESSMENT EA -386 AND VARIANCE 96 -1 TO ALLOW THE CONSTRUCTION OF A NEW TWO -STORY 39500 SQUARE FOOT HOUSE WITH A 20 FOOT FRONT SETBACK AT 520 EAST GRAND AVENUE. PETITIONED BY. MITE AND SUZANNE RISTOVSKI. WHEREAS, on April 30, 1996, an application was received from Mite and Suzanne Ristovski requesting approval of an Environmental Assessment and Variance in the Two- Family Residential (R -2) zone to allow the construction of a new two -story 3,500 square foot house with a twenty (20) foot front setback instead of 25 feet, at 520 East Grand Avenue; and WHEREAS, an inter - departmental correspondence has been prepared and circulated along with all the applications and plans of the proposed house for inter - departmental comments; and WHEREAS, the Planning Commission has reviewed Environmental Assessment EA -386 and the supporting evidence with the authority and criteria contained in the California Environmental Quality Act, State CEQA Guidelines, and the City of El Segundo Guidelines for the implementation of the California Environmental Quality Act (Resolution 3805); and WHEREAS, on June 13, 1996, the Planning Commission did hold, pursuant to law, a duly advertised public hearing on such matter and notice of the public hearing was given in the time, form and manner prescribed by law; and WHEREAS, at said hearing opportunity was given to all persons present to present testimony or documentary evidence for or against the findings of Environmental Assessment EA -386 and Variance 96 -1; and WHEREAS, on June 13,1996, the Planning Commission adopted Resolution No. 2380, denying Environmental Assessment EA -386 and Variance 96 -1; and WHEREAS, on June 19, 1996, within the ten (10) day appeal period, an appeal of the Planning Commission's denial of Environmental Assessment EA -386, Variance 96 -1 was filed by Mite and Suzanne Ristovski; and WHEREAS, on July 2, 1996, the City Council did hold, pursuant to law, a duly advertised public hearing on the appeal, and notice of hearing was given in the time, form and manner prescribed by law; and WHEREAS, at said hearing, opportunity was given to all persons present to present testimony or documentary evidence for or against the findings of Environmental Assessment EA -386 and Variance 96 -1; and 1 WHEREAS, at said hearing the following facts were established: 1. The applicant is proposing to build a new two -story 3,500 square foot house with a 20 foot front setback instead of 25 feet, as required by the Zoning Code, at 520 East Grand Avenue in the Two - Family Residential zone. 2. The proposed project includes, demolishing the existing 1,000 square foot front house, and constructing a new 3,500 square foot two -story home and a new one -car garage attached to the existing two -car garage. 3. The project site is a level rectangular corner lot, 7,500 square feet in area, 50 feet wide by 150 feet deep, and is developed with two detached one -story single - family homes. The 848 square foot rear house is located 5 feet from the rear property line and provides a single -car garage. A detached two -car garage is located between the two houses. The existing rear house and garages are proposed to remain. 4. The proposed new 3,500 square foot two -story home is 3.5 times larger than the existing 1,000 square foot house, and reduces the existing street side setback from 8 feet to 5 feet. 5. The surrounding area is developed with two single - family dwelling units immediately to the west and across Grand Avenue to the north, a religious hall across Penn Street to the east and multiple- family dwelling units across the alley to the south. • 6. The homes in the neighborhood surrounding the project site and along Grand Avenue are mainly one - story, older (1940's and 1950's vintage) and smaller (1000 -1500 square feet) than the proposed residence. 7. The residences and religious hall located on the corner of Grand Avenue and Penn Street provide wider street side setbacks of 8 feet minimum. S. The Land Use Element of the General Plan distinguishes between land use density and intensity. The proposed new house is a much more intense use of the site than existing and is a more intense use than the surrounding neighborhood. The R -2 development standards adopted in 1993 require a 20 foot minimum front, 5 foot minimum rear and a 30 foot minimum total combined setbacks. 10. The applicant is requesting a variance from the Two- Family Residential (R -2) development standards to allow a 25 foot total combined setback for the front and rear yards instead of 30 feet. NOW, THEREFORE, BE IT RESOLVED that after consideration of the above facts of proposed Environmental Assessment EA -386 and Variance 96 -1, the City Council finds as follows: 1. The required four findings for the variance cannot be made. U SECTION 1. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby upholds the Planning Commission's decision and denies Environmental Assessment EA -386 and Variance 96 -1. SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered in the book of original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of meeting which the same is passed and adopted.
