A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, ADOPTING SCHEDULES OF
. FEES FOR THE APPLICATION AND PROCESSING OF
ZONING, PLATS AND SUBDIVISION PERMITS
WHEREAS, City Council Resolution No. 3617, adopted December 20, 1989, established
such zoning, plats and subdivision fees to be assessed to applicants; and
• WHEREAS, Ordinance No. 1171, adopted February 4, 1992, established interim
zoning standards, procedures and fees for administrative use permits and expedited
administrative use permits for certain CM, M -1, and M -2 properties east of Sepulveda
Boulevard, which interim ordinance was in effect until November 2, 1992; and
WHEREAS, Ordinance No. 875, adopted July 15, 1975, established a fee for the filing
of a final map; and
WHEREAS, Ordinance No. 830, adopted December 18, 1973, established a fee for
planned residential development applications; and
WHEREAS, on November 2, 1992, the City Council adopted Urgency Ordinance
No.1211, approving a new Subdivision and Zoning Code which deleted certain fees and
• established several new planning applications; and
WHEREAS, Section 66000 of the California Government Code sets forth the ability
and criteria for local governing bodies to establish all development fees and such ability may
be used now to establish all other planning approval fees that have not yet been established;
and
WHEREAS, on January 18, 1994, the City Council did hold, pursuant to Section 66018
of the California Government Code, a duly - advertised public hearing on such matter, and
• notice of hearing was given in the time, form and manner prescribed by law and opportunity
was given to all persons to present testimony or documentary evidence for or against the
Schedule of Fees, as set forth in Exhibit "A" of this resolution and incorporated herein by this
reference, to be assessed to applicants to cover costs and work done by the City of El Segundo
to process planning applications.
NOW, THEREFORE, THE CITY COUNCIL HEREBY FINDS, DETERMINES AND
RESOLVES AS FOLLOWS:
SECTION 1. ENVIRONMENTAL FINDINGS
• 1. The adoption of such fees are categorically exempt under: (A) Section
21080(b)(8) of the State of California Environmental Quality Act and Section
15273(a) of the State of California Environmental Quality Act Guidelines
(Guidelines), in that the adoption and revision of such fees are charges by this
public agency for the purpose of meeting operating expenses and meeting
financial reserve needs and requirements; (B) Section 15061(b)(1) of the
Guidelines, in that the adoption and revision of such fees are not a "project" as
defined in Section 15300 of the Guidelines, because the adoption and revision
of fees do not have the potential for resulting in a physical change in the
environment; and (C) Section 5.13(1) of City Council Resolution No. 3805
adopting procedures for the implementation of the provisions of the CEQA and
Guidelines, in that it can be. seen with certainty that no substantial evidence
exists that the adoption and revision of such fees may have a significant effect
• on the environment.
2. That when considering the whole record, there is no evidence that the project
will have the potential for an adverse effect on wildlife resources or the habitat
on which wildlife depends.
3. The City Council hereby directs the Director of Planning and Building Safety
to file the required Notice of Exemption and to file with the appropriate
agencies a Certificate of Fee Exemption and De Minimus Findings pursuant
to AB 3158 and the California Code of Regulations.
SECTION 2. The adoption of such fees are in compliance with California
Government Code Section 66000 et. al., regarding fees for development projects.
SECTION 3. The adoption of such fees is consistent with the intent and purpose
of the City of El Segundo General Plan, in that it facilitates the implementation of the
General Plan.
SECTION 4. The fees set forth in City Council Resolution No. 3617, adopted
December 20, 1989, regarding Coastal Zone Permit is rescinded and a new Coastal
• Development Permit fee along with other fees are set forth in Exhibit "A" of this resolution,
entitled "Schedule of Fees," hereinafter referred to as Exhibit "A" are hereby adopted.
SECTION 5. The fees set forth in Ordinance No. 1171, adopted February 4, 1992,
regarding administrative use permits and expedited administrative use permits, are hereby
reestablished and such fees are now set forth in Exhibit "A" .
SECTION 6. The fees set forth in Ordinance No. 875, adopted July 15, 1975,
regarding final maps, which were rescinded with the adoption Of Urgency Ordinance No.
1211 are hereby reestablished and such fees are now set forth in Exhibit "A."
SECTION 7. The fee set forth in Ordinance No. 830, adopted December 18, 1973,
regarding planned residential development, is hereby rescinded and a new fee is now set
forth in Exhibit "A."
SECTION S. In accordance with Section 66000 of the California Government Code,
the City Council establishes fees for: (1) discretionary parking permit; (2) sign plan review;
and (3) modification to discretionary approval, as set forth in Exhibit "A ".
SECTION 9. After consideration of the above facts, Exhibit "A" is hereby approved
and adopted as a Schedule of Fees to be assessed to applicants for the costs and work done
by the City of El Segundo to process certain planning development applications.
• SECTION 10. Pursuant to Government Code 66017, the fees set forth in Exhibit
"A" hereof shall be. effective no sooner than 60 days following the date of adoption of this
resolution.
SECTION 11. The City Clerk shall certify to the passage and adoption of this
resolution; shall enter the same in the book of original resolutions of said City; and shall
make a minute of the passage and adoption thereof in the record of the proceedings of the
City Council of said City, in the minutes of meeting at which the same is passed and adopted.
