CC RESOLUTION 3842RESOLUTION NO. 3842 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, ADOPTING A PERMIT FEE FOR THE APPLICATION AND PROCESSING OF A LARGE FAMILY DAY CARE PERMIT AND APPROVING ENVIRONMENTAL ASSESSMENT EA -325. WHEREAS, on November 2, 1993, City Council adopted Ordinance No. 1211 as an urgency ordinance and whereas said ordinance established provision for a Large Family Day Care Permit; and WHEREAS, Section 65909.5 of the California Government Code sets forth the ability and criteria for local governing bodies to establish reasonable fees for the processing of use permits; and WHEREAS, on November 16, 1993, the City Council did hold, pursuant to Section 66018 of the California Government Code, a duly - advertised public hearing on such matter, and notice of public hearing was given in a time, form and manner prescribed by law; and WHEREAS, opportunity was given to all persons to present testimony or documentary evidence for and against proposed Environmental Assessment EA -325, the proposed fee to be assessed to applicants to cover costs and work done by the City of El Segundo to process a Large Family Day Care Permit application; and NOW, THEREFORE, the City Council finds as follows: Section 1. - The adoption of such fees are categorically exempt from the requirement of the California Environmental Quality Act (CEQA) pursuant to Section 21080(b)(8) of the CEQA Statutes; and Section 15273(a) of the CEQA Guidelines, in that the adoption and revision of such fees are charges for the purpose of meeting operating expenses, and meeting financial reserve needs and requirements; and Section 15061(b)(1) of the Guidelines, in that the adoption and revision of such fees are not a "project" as defined in Section 15300 of the Guidelines; and the City of El Segundo CEQA Guidelines (Resolution No. 3805), in that it is clear that no substantial evidence exists that the adoption and revision of such fees may have a significant effect on the environment. Section 2. The adoption of a permit fee of $375, with an additional $100 fee, if a public hearing is requested, is in compliance with Section 65909.5 of the California Government Code to cover the cost to administer the process of such permits. Section 3. The adoption of such fees is consistent with the intent and purpose of the City of El Segundo's General Plan, in that it facilitates the implementation of the General Plan. Section 4. The adoption of such fees is consistent with Section 20.20.030 of the City's newly adopted Zoning Code which establishes provisions for a Large Family Day Care Permit to provide day care for 7 to 12 children. ow Section 5. The City Clerk shall certify to the adoption of this resolution and shall post the same in the manner prescribed by law.
