CC RESOLUTION 3812RESOLUTION NO. 3812 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CAIdFORNIA, CLARIFYING A LAND USE AMBIGUITY WITH REGARD TO ALLOWING A SPORTS EDUCATION CENTER AS A PRINCIPAL PERMITTED USE IN THE PUBLIC FACILITIES (P F) ZONE AND INTERPRETING CHAPTER 20.30 OF THE EL SEGUNDO ZONING CODE. • WHEREAS, a request has been received from South Bay Brokers Incorporated to allow a Sports Education Center to operate at an existing vacant elementary school facility; and WHEREAS, the El Segundo Municipal Code Title 20 (Zoning Code) establishes a precise land use plan for the City of El Segundo to further the public health, safety and general welfare and to provide the economic and social advantages resulting from an orderly planned use of land resources; and WHEREAS, Sections 20.12.020 and 20.16.070 state that no land shall be used for any purpose other than the uses specifically provided for and permitted within the same zone in which the building and land is located; and WHEREAS, Section 20.50.010 specifically provides that in the event of ambiguity with regard to the appropriate classification or a particular use within the meaning and intent of Title 20 (Zoning Code), it is the duty of the Planning Commission to ascertain all pertinent facts and by resolution of record, set forth its findings and interpretations, which interpretation, if approved by the City Council, shall govern; and WHEREAS, the Planning Commission reviewed the related information and discussed the matter at their regular meetings of March 25, 1993 and April 8, 1993, in the Council Chamber of the City Hall, 350 Main Street; and WHEREAS, the Planning Commission, at the meeting on April 8, 1993, adopted •Resolution No. 2334 recommending that the City Council adopt a Resolution that clarify, a land use ambiguity with regard to allowing a sports education center as a principal permitted use in the Public Facilities (P -F) zone and interpret chapter 2,0.30 of the El Segundo zoning code; and WHEREAS, the City Council of the City of El Segundo reviewed the related information and discussed the Planning Commission recommendation at their meeting of May 4, 1993, in the Council Chamber of the City Hall, 350 Main Street; and WHEREAS, at said meeting, the City Council established the following facts and findings: 1. The proposed project site is zoned Public Facilities (P -F). 2. The Public Facilities (P -F) zone, Section 20.30.020 permits Municipal, County, State or other governmental buildings, Public or quasi - Public educational facilities such as schools and administrative offices, Eleemosynary (charitable) institutions, Churches, Church schools and religious facilities, Flood Control Facilities, Public Parking lots or structures, Public Utilities and Public Recreational Facilities, as principal uses. 3. The proposed use is a privately operated sports education and learning center, which offers various indoor and outdoor sporty activities and a day care. • 4. The land use designation of the s«e in the City's General Plan is "Planned Residential Development" (PRD) which allows a mixture of single and multiple family dwelling units. 5.
