CC RESOLUTION 3788RESOLUTION NO. 3788 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO REPEALING RESOLUTION NO. 3717 AND ADOPTING A NEW CONFLICT OF INTEREST CODE. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Resolution No. 3717 which establishes a Conflict of Interest Code for various City elected officials, officers, and employees is hereby repealed. SECTION 2. The City of El Segundo does hereby adopt the following Conflict of Interest Code: CONFLICT OF INTEREST CODE FOR THE CITY OF EL SEGUNDO A. I Incorporation of Standard Code. The Political Reform Act, Government Code Sections 81000 et seq., requires state and local government agencies to adopt and promulgate a conflict of interest code. The Fair Political Practices Commission has adopted a regulation, 2 Cal. Administrative Code Section 18730, which contains the terms of a standard conflict of interest code, which can be incorporated by reference, and which may be amended by the Fair Political Practices Commission to conform to amendments in the Political Reform Act after public notice and hearings. Therefore, the terms of 2 Cal. Administrative Code Section 18730, and any amendments to it duly adopted by the Fair Political Practices Commission are hereby incorporated by reference and along with the designation of officials and employees and the disclosure categories set forth herein, constitutes the Conflict of Interest Code of the City of El Segundo (the "Conflict of Interest Code "). B. Filing of Statements. Pursuant to Section 4 of the standard code, designated officials, officers and employees shall file Statements of Economic Interests with the City Clerk or Deputy City Clerk. Upon receipt of the Statements of Economic Interests of members • of the City Council, City Treasurer, Deputy City Treasurer, Members of the Planning Commission, City Attorney, and City Manager, the City Clerk, or Deputy City Clerk, shall make and retain a copy and forward the original of these Statements to the Fair Political Practices Commission. Pursuant to Government Code Section 82011(c), the City Council is the code reviewing body with respect to the Conflict of Interest Code. C. Review Procedure. Pursuant to Government Code 87306.5, no later than July 1 of each even- numbered year, the code reviewing body (City Council) shall direct the City Clerk, or Deputy City Clerk, to review the Conflict of Interest Code. The City Clerk or Deputy City Clerk shall submit an amended Conflict of Interest Code to the code reviewing body (City Council) if a change in the Conflict of Interest Code is necessitated by changed circumstance. If no change in the Conflict of Interest Code is required, the City Clerk, or Deputy City Clerk, shall submit a written statement to that effect to the code reviewing body (City Council) no later than October 1 of the same year. D. Designated Positions. The following positions entail the making or participation in the making of decisions which may foreseeably have a material effect on their financial interests. Disclosure Requirements ". * Listed in the code for information purposes only. These positions file under Government Code Section 87200 with the Fair Political Practices Commission. E. Disclosure Requirements. Designated employees shall disclose all sources of income, interests in real property and investments and business positions in business entities. • The City Manager may determine in writing that a particular consultant, although a "designated position ", is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with the disclosure requirements described in this Resolution. Such written determination shall include a description of the consultant's duties and, based upon that description, a statement of the extent of disclosure requirements. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as the Conflict of Interest Code. SECTION 3. When a new position classification is finalized by the Human Resources/Risk Management Department for approval by the City Council, included in the presentation will be a directive to the City Council to decide whether that new position will be required to file a Statement of Economic Interests, and be included as a designated position in the Conflict of Interest Code. SECTION 4. When the City Council establishes a Commission, Committee, or Board, included in the agenda item will be a directive to the City Council to decide whether the members of the Commission, Committee or Board will be included as a designated position in the Conflict of Interest Code and the members of the Commission, Committee or Board will be required to file a Statement of Economic Interests. The City Clerk, or Deputy City Clerk, is directed to forward a certified copy of this Resolution to the Legal Department of the Fair Political Practices Commission. • SECTION 6.
