CC RESOLUTION 3740RESOLUTION NO. 3740 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DENYING ENVIRONMENTAL ASSESSMENT EA -252 AND VARIANCE 91 -3. PETITIONED BY PCT ACQUISITION, INC. (PACIFIC CORPORATE TOWERS). WHEREAS, an application was received from Pacific Corporate Towers requesting approval of an Environmental Assessment and Variance to allow two rooftop patios with waivers of maximum permitted floor area ratios and maximum permitted structural height at 222 N. Sepulveda Boulevard; and WHEREAS, an Environmental Assessment (EA -252) on the proposed rooftop patios was prepared and the draft Initial Study circulated for interdepartmental comments; and WHEREAS, the Planning Commission reviewed the Initial Study and supporting evidence with the authority and criteria contained in the California Environmental Quality Act, State CEQA Guidelines and the City of El Segundo Guidelines for the Implementation of the California Environmental Quality Act (Resolution 3517); and WHEREAS, at the duly scheduled meeting of the Planning Commission of the City of El Segundo on September 12, 1991, a duly advertised public hearing was held on such matter; and WHEREAS, opportunity was given to all persons present to speak for or against the findings of Environmental Assessment EA -252 and Variance 91 -3; and WHEREAS, at said hearing the Planning Commission denied EA -252 and Variance No. 91- 3 by adopting Resolution No. 2311; and WHEREAS, on September 23, 1991 the applicant submitted an appeal of the Planning Commission's denial; and WHEREAS, pursuant to Chapter 20.74 of the El Segundo Municipal Code said appeal was scheduled within 40 days of the receipt of said appeal but the required legal notice noted an incorrect hearing date; and WHEREAS, the applicant agreed to an extension of time from the provisions of Chapter 20.74 of the El Segundo Municipal Code; and WHEREAS, at the duly scheduled meeting of the City Council of the City of El Segundo on December 3, 1991 the City Council granted a continuance of the hearing to December 17, 1991 at the request of the applicant; WHEREAS, at the duly scheduled meeting of the City Council of the City of El Segundo on December 17, 1991 the City Council granted a continuance of the hearing to January 7, 1992 at the request of the applicant; WHEREAS, at the duly scheduled meeting of the City Council of the City of El Segundo on January 7, 1992 a duly advertised public hearing was held on such matter; and WHEREAS, opportunity was given to all persons present to speak for or against the findings of Environmental Assessment EA -252 and Variance 91 -3; and WHEREAS, the City Council reviewed the Initial Study and supporting evidence with the authority and criteria contained in the California Environmental Quality Act, State CEQA Guidelines and the City of El Segundo Guidelines for the Implementation of the California Environmental Quality Act (Resolution 3517); and WHEREAS, at said hearing the following facts and findings were established: 1. Subject application pertains to an existing 24 -story, approximate 546,061 square foot commercial office building on an approximate 3.5 acre site. The remainder of subject property is currently developed with two 20 -story office towers, and associated parking structures. 2. The project site is a flat rectangular- shaped lot and is currently zoned C -3. 1 RESOLUTION NO. 3740 Page 2 3. Subject office tower was originally constructed in 1979 and subsequent amendments to the development standards of the C -3 zone rendered this project legal non- conforming. 4. A heliport pad currently exists and is operational on the roof of the office tower. Additionally, heliport operations exist at the other two 20 -story office towers. 5. The proposed roof patios would be located in close proximity to the existing heliport pad operation. 6. Code permits a maximum floor area ratio of approximately 293,594 square feet and the proposal would result in a total usable floor area of approximately 551,378 square feet. 7. Code permits a maximum structural height of 200 feet and does not allow rooftop patios as a permitted use above the height limit. The existing building height is approximately 321.5 feet and the proposal would add additional usable floor area above the height limit. 8. Section 20.35.050 of the El Segundo Municipal Code specifically provides that "no building may exceed both the allowable floor area ratio and height limits under any circumstances ". 9. That there are no special circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the vicinity and zone. 10. The proposed variance would not preserve a substantial property right of the applicant enjoyed by other property owners in the vicinity and zone. 11. The proposed variance would be materially detrimental to the public welfare, or injurious to the property or improvements in the zone. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby denies the appeal and denies Environmental Assessment EA -252 and Variance 91 -3.
