CC RESOLUTION 3729RESOLUTION NO. 372 ;9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 48437 LOCATED WITHIN SAID CITY WHEREAS, Final Tract Map No. 48437 for property situated within the City of E1 Segundo, County of Los Angeles, State of California is now presented to the City Council of the said City for its approval; and WHEREAS, by Resolution No. 2273 attached hereto and incorporated by reference, the Planning Commission of the City of E1 Segundo did approve Subdivision 89 -14, Environmental Assessment EA -214 and Variance 90 -3 to allow ten townhouse condominium units at 1626 - 1628 East Palm Avenue; petitioned by Las Brisas Townhomes, Ltd., 1989.. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO, CALIFORNIA, DOES RESOLVE AS FOLLOWS; SECTION 1. The City Council of the City of E1 Segundo, California, hereby approves Final Tract Map No. 48437 and the Mayor is hereby authorized to sign on behalf of the City and the City Clerk to attest thereto. SECTION 2. The City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the meeting at which the same is passed and adopted. PASSED, APPROVED AND ADOPTED this 15th day of October, k6elo bv, City Clerk (seal) Attachment: Resolution No. 2273 Carl c`obrson, Mayor of the eity of E1 Segundo, California RESOLUTION NO. 2273 A RESOLUTION OF THE PLANNING COMIVIISSION OF THE CITY OF EL SEGUNDO, CALIFORNIA APPROVING ENVIRONMENTAL ASSESSMENT EA -214, AND SUBDIVISION 89-14 /TENTATIVE TRACT 48437, TO ALLOW TEN CONDOMINIUM UNITS AT 1626 -1628 EAST PALM AVENUE; AND APPROVING VARIANCE 90 -3 REQUESTED TO PERMIT A CENTRAL DRIVEWAY. PETITIONED BY LAS BRISAS TOWNHOMES, LTD. 1989. WHEREAS, an application has been received from Las Brims Townhomes, Ltd. 1989 requesting approval of an Environmental Assessment, Subdivision, and driveway location Variance to allow 10 condominium units on a .334 acre, rectangular- shaped site located at 1626 -28 East Palm Avenue in the Multiple - Family Residential (R -3) zone; and WHEREAS, an Environmental Assessment (EA -214) on the proposed ten units, variance, and subdivision, has been prepared and the draft Initial Study circulated for interdepartmental comments; and WHEREAS, the Planning Commission has reviewed the Initial Study and supporting evidence with the authority and criteria contained in the California Environmental Quality Act, State CEQA Guidelines and the City of El Segundo Guidelines for the Implementation of the California Environmental Quality Act (Resolution 3517); and WHEREAS, at the duly scheduled meetings of the Planning Commission of the City of El Segundo on March 22, 1990 and May 10, 1990, duly advertised public hearings were held on such matter in the Council Chamber of the City Hall, 350 Main Street; and WHEREAS, opportunity was given to all persons present to speak for or against the findings of Environmental Assessment EA -214, Variance 90 -3, and Subdivision 89 -14 /Tentative Tract 48437; and WHEREAS, at said hearing the following facts were established: 1. The existing 14,580 square foot (.334 acre) site is two legal lots developed with two four -unit apartment buildings, two 4 -car garages, and a central 18 -foot wide driveway. 2. The site is zoned Multiple - Family Residential (R -3) which requires 1,500 square feet of lot area per condominium or apartment unit. The proposed subdivision would create 10 condominium units in conformance with the regulations of the R -3 zone. 3. The project site is 14,580 square foot, rectangular- shaped lot and slopes downward from front to back about two (2) to six (6) feet. There is an existing five foot -wide easement down the center of the site, and the applicant is discussing with the City relocation of the easement along the east side property line. NOW, THEREFORE, BE IT RESOLVED that after considering the above facts and study of proposed Environmental Assessment EA -214, Variance 90 -3, and Subdivision 89 -14 /Tentative Tract 48437, the Planning Commission fords as follows: ENVIRONMENTAL ASSESSMENT 1. The proposed project will not have a significant, adverse effect on the environment. SUBDIVISION 2. The proposed subdivision to create condominium ownership, and the design of the proposed townhouse -style multiple - family residences are consistent with the intended General Plan land use designation for multiple family residential use. 3. The site is physically suitable for residential townhouse development at the proposed density of one unit per 1,438 square feet of site area for 9.72 units and conforms to Section 20.24.070 ESMC in that an additional unit is allowed when there is a fraction of a lot greater than 1,000 square feet. 4. The design of the subdivision improvements, as modified by the recommended conditions, adequately provides for public services and is not likely to cause any public health problems. VARIANCE 5. The proposed variance would preserve a substantial property right of the applicant enjoyed by other property owners in the vicinity in that the site design is similar to properties developed as separate lots. 1 6; The proposed variance wo -Id not be materiaLy detrimental to Lie public weLlare, or xo„ur<ous to the property or impro vents in the zone in that the den would be the same than if the lots were developed separately. 7. The proposed variance is consistent with the Multiple - Family Residential (R -3) designation of the General Plan and is otherwise consistent with all other elements of the General Plan in that the driveway configuration provides improved circulation on and off the property. i NOW, THEREFORE, BE IT RESOLVED that the Planning Commission hereby adopts a Negative Declaration, approves Environmental Assessment EA-214 and Subdivision 89 -14 /Tentative Tract 48437, and Variance 90 -3 subject to the following conditions: 1. Prior to issuance of a building permit, the applicant shall provide proof to the Planning Manager that Final Tract Map #48437 has been recorded with the County Recorder. 2. The project shall be constructed in substantial compliance with the site plan and architectural style as shown in the elevations reviewed by the Planning Commission. Any subsequent modification to the project as approved shall be referred to the Planning Manager for a determination regarding the need for Planning Commission review of the proposed modification. 3. The applicant shall pay a one -time police services mitigation fee of 10.5 cents per gross square foot of building floor area prior. to issuance of Certificate of Occupancy. 4. The applicant shall pay a one -time library services mitigation fee of three cents per gross square foot of building floor area prior to issuance of a Certificate of Occupancy. 5. The applicant shall pay a one -time fire services mitigation fee of 14 cents per gross square foot of building floor area prior to issuance of a Certificate of Occupancy. 6. All work within the public right -of -way shall be in accordance with the latest edition of the Standard Specifications for Public Works Construction and City of El Segundo Standard Specifications. No work shall be performed in the public right -of -way without first obtaining a permit from the Engineering Division of the Development Services Department. 7. Encroachment permits must be obtained from the Engineering Division of the Development f Services Department for demolition haul -off. Permit must be obtained at the same time the i building permit for demolition is issued. An encroachment permit for grading is also required when import or export of dirt exceeds fifty (50) cubic yards. Demolition and grading may be listed on one encroachment permit. 8. During the construction phase, the entire project site shall be enclosed by a six -foot high chain link fence. Gates shall be located at driveways and shall not open out over sidewalk /public right -of -way. No material storage is allowed in the public right -of -way except by permit issued by the Engineering Division of the Development Services Department. 9. All cracked, broken, off -grade and otherwise damaged curbs, sidewalks, driveway approaches, wheel chair ramps and pavement shall be removed and replaced or repaired. Existing • driveways not to be incorporated into the construction shall be removed and replaced with standard curb and sidewalk. 10. A cash deposit or surety acceptable to the City Attorney of $12,000.00` to be retained by the City for one (1) year from date of completion and acceptance by the City Engineer. This money will be used for correcting latent street damage resulting from construction activities. All money not committed at the end of the one (1) year period shall be refunded. It is the responsibility of the permittee to request refund of deposit. *Charge calculated at $2.50 /sq. ft. of pavement as measured from property line to property line and from curb to centerline of street. 11. All utilities shall be served underground and shall be shown on site plan. 12. All sewer laterals in public right -of -way shall be a minimum of six (6) inches inside diameter. Material shall be "vitreous clay pipe ". Each lateral shall have a six (6) inch clean -out brought to grade at the property line and securely capped. A B9 size box shall be placed around the C.O. for protection. The box shall have a cover emblazoned with the word "sewer ". If in a traffic area, cover shall be traffic approved. (All planned sewer connections shall be checked for elevation prior to starting construction). 13. Structures, obstructions or other private improvements shall not be constructed within the public right -of -way as stipulated in Section 12.04.050 of the El Segundo Municipal Code. 14. Plan and profile engineering drawings by a licensed engineer for tue proposed relocation of the water lines shall be submitted to the Engineering Division for approval. Grants of easement shall also be submitted to the City for the relocated water lines. All work and expenses associated with the water line relocation shall be the responsibility of the owner /developer. 15. The applicant shall provide sandbags along the property perimeter to prevent erosion and street deposition during grading and construction. 16. The hours of construction shall be 7:00 am. to 6:00 p.m. Monday through Saturday. Construction is prohibited on Sundays and Federal holidays. 17. All construction debris shall be removed from the project site prior to the issuance of a Certificate of Occupancy. 18. A landscaping and irrigation plan shall be submitted, reviewed, and approved by the Planning Manager prior to issuance of a building permit. Landscaping shall be installed prior to issuance of Certificate of Occupancy. 19. All landscaped areas shall be provided with a permanent automatic watering or irrigation system. • 20. The exterior security lighting plan shall he reviewed and approved for security purposes by the Planning Manager. Lighting fixtures shall be directional and shall be illuminated during hours of darkness. 21. All main entry doors (including entry door from the garage to the residence) should be of solid core construction with a minimum thickness of 1 3/4 inch. 22. Main entry doors with glass constructed in or within 40 inches (including windows along side entry door) of the locking mechanism shall use a double cylinder deadbolt with a retaining key feature or reverse the door, or reverse the position of the window. 23. The deadbolt throw shall have a one inch projection. The cylinder guard should be of case hardened steel, with the outer edge angled or tapered and free spinning. The exterior part of the lock should be connected to the inside portion of the lock with bolts at least 1/4 inch in diameter and constructed of steel. The locking mechanism should contain a minimum of a five pin tumbler. • 24. If garage doors are electronically operated, there should be no hardware on the outside. 25. A panoramic door viewer (180 to 190 degrees) shall be installed in each main entry door. 26. A lighting fixture shall be located by each main entry door. 27. All first floor sliding windows shall be adequately secured. Sheet metal screws shall be installed in the active tracks of these windows and adjusted to prevent removal from the frame. All landscaping should be low profile, especially around doors and windows. 28. Second floor patios doors and windows shall have secondary locking devices. 29. The applicant shall provide a life safety system in accordance with Fire Department regulations and recommendations. 30. A minimum of 65 cubic feet shall be provided for personal storage space for each dwelling unit. • 31. Street addresses and apartment numbers shall be affixed to the building of each unit. These numbers shall be four inches in height and shall be of contrasting color to the building. Addresses shall be illuminated during hours of darkness. 3 A . ` &2. Central mailboxes shall ) well lit with fluorescent, mercury vapor or high sodium pressure lights. 33. That prior to issuance of a building permit the applicant shall submit evidence satisfactory to the Planning Manager, that all issues have been resolved with the adjacent property owner, Frank Von Flue. BE IT FURTHER RESOLVED that according to the El Segundo Municipal Code, within ten days following the adoption of this resolution, the Secretary of the Planning Commission shall mail a copy of this resolution to the applicant at the address shown on the application and to any other person requesting a copy of same. The decision of the Planning Commission as set forth in this resolution shall become final and effective ten (10) calendar days after the date of notification to the applicant unless within such ten calendar day period an appeal in writing is filed with the City Council.
