A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
is EL SEGUNDO, CALIFORNIA, URGING PRESIDENT BUSH
AND SECRETARY SKINNER TO DIRECT THE DEPART-
MENT OF TRANSPORTATION AND THE FEDERAL AVIAT-
ION ADMINISTRATION TO REMOVE THEIR OPPOSITION
TO THE CITY OF LOS ANGELES' PROPOSED PHASE -OUT
OF STAGE 2 AIRCRAFT RECOMMENDED BY THE LOS
ANGELES BOARD OF AIRPORT COMMISSIONERS ON MAY
15, 1991 AND DESIST FROM THREATENING A LOSS OF
FUNDS IF SAME IS ADOPTED BY THE CITY OF LOS
ANGELES.
WHEREAS, airport noise is among the most offensive and oppressive of
negative environmental impacts; and
WHEREAS, all levels of government should be encouraged to take all steps
40 possible to reduce the level and impact of airport noise upon residents living near the
nation's airports; and
WHEREAS, the City of Los Angeles Board of Airport Commissioners took action
on May 31, 1990 to circulate for comment and commence environmental review of a
proposal to phase out Stage 2 aircraft at Los Angeles International Airport by its
Resolution No. 17150; and
WHEREAS, on November 5, 1990 Congress passed the Airport Noise and
Capacity Act of 1990 which provides for a national phase -out of Stage 2 aircraft and
requires the Secretary of Transportation to issue regulations to effect the Act by July
1, 1991; and
WHEREAS, the Airport Noise and Capacity Act of 1990 provides in Section
9304(a)(2)(A) that "with respect to Stage 2 aircraft, the requirements set forth in
Subsection (c) shall apply only to restrictions proposed after October 1, 1990," thereby
"grandfathering" the Los Angeles Board of Airport Commissioners proposed phase -out;
and
WHEREAS, in his letter of May 23, 1991, to Los Angeles Mayor Tom Bradley,
Secretary Skinner threatened "Action by the City of Los Angeles to restrict further the
operation of Stage 2 aircraft could have serious consequences for the City of Los
Angeles," and "Precipitous action by the City could set back our cooperative efforts in
both airport development and noise abatement...Enactment of those restrictions... may
compel action by the Department of Transportation to ensure compliance with the
1990 Act." Secretary Skinner selectively cites Section 9307 in his threats to Los
Angeles while conveniently disregarding Section 9304(a)(2) (A); and
WHEREAS, it has been reported that the Department of Transportation even
threatened to withhold funding for the Metro Rail project necessary for Los Angeles to
meet air quality standards as leverage to coerce the City of Los Angeles to drop its
proposed Stage 2 phase -out; and
WHEREAS, the phase -out of Stage 2 aircraft which was proposed by the Los
Angeles Board of Airport Commissioners would significantly reduce the noise impact
on El Segundo residents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That President George Bush should direct Secretary Skinner to
withdraw threats of withholding funding to the City of Los Angeles if it adopted its
proposed Stage 2 phase -out.
SECTION 2. That Secretary of Transportation Samuel R. Skinner should
acknowledge that the Stage 2 aircraft phase -out proposed by the Los Angeles Board of
Airport Commissioners on May 31, 1990 for Los Angeles International Airport falls
under Section 9304(a) (2) (A) exemption from the Airport Noise and Capacity Act of
1990.
SECTION 3. That the Department of Transportation and Federal Aviation
Administration should remove their opposition to the proposed phase -out of Stage 2
aircraft at Los Angeles International Airport.
SECTION 4. That copies of this resolution be sent to President Bush, Secretary
Skinner, Senator Cranston, Senator Seymour, Congressman Levine, Mayor Bradley of
Los Angeles, and other appropriate parties.
• SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
