CC RESOLUTION 3702RESOLUTION NO. 3702 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL SEGUNDO DENYING VARIANCE 91 -4. PETITIONED BY JOHN 40 FOWLER - INDIANA COURT PARTNERSHIP. WHEREAS, an application was received from Indiana Court Partnership requesting approval of an Environmental Assessment, Subdivision, and driveway location Variance to allow 10 condominium units on a .37 acre, rectangular- shaped site located at 719 and 721 Indiana Court in the Multiple - Family Residential (R -3) zone; and WHEREAS, an Environmental Assessment (EA -253) on the proposed ten units, variance, and subdivision, was prepared and the draft Initial Study circulated for interdepartmental comments; and WHEREAS, the Planning Commission reviewed the Initial Study and supporting evidence with the authority and criteria contained in the California Environmental Quality Act, State CEQA Guidelines and the City of El Segundo Guidelines for the Implementation of the California Environmental Quality Act (Resolution 3517); and WHEREAS, at the duly scheduled meeting of the Planning Commission of the City of El Segundo on April 25, 1991, a duly advertised public hearing was held on such matter in the Council Chamber of the City Hall, 350 Main Street; and WHEREAS, opportunity was given to all persons present to speak for or against the findings of Environmental Assessment EA -253, Variance 91 -4, and Subdivision 91 -3 /Tentative Tract Map 50489; and WHEREAS, on April 25, 1991, the Planning Commission adopted a Negative Declaration and Resolution No. 2306, and approved Environmental Assessment EA -253, Subdivision 91 -3/ Tentative Tract Map No. 50489 and Variance 91-4 subject to the findings and conditions stated in Resolution 2306; and WHEREAS, on May 6, 1991, within the ten day appeal period, an appeal of Environmental Assessment EA -253, Subdivision 91 -3/ Tentative Tract Map No. 50489 and Variance 91-4 was filed by Verdie Faas; and WHEREAS, on June 4, 1991, at a duly scheduled meeting a duly advertised public hearing on the appeal was held by the City Council after presentations by City staff and the applicant; and WHEREAS, opportunity was given to all persons present to speak for or against the findings of Environmental Assessment EA -253, Variance 91-4, and Subdivision 91 -3 /Tentative Tract Map 50489; and WHEREAS, on June 4, 1991, the City Council voted to deny EA -253, Subdivision 91 -3 /Tentative Tract Map No. 50489 and Variance 91 -4; and WHEREAS, at said hearing the following facts were established relating to the Variance: 1. The existing 15,945 square foot (.37 acre) site is two legal lots developed with two four -unit apartment buildings, two 2 -car carports, two 2 -car garages, and two 25 -foot wide central driveways, one being in the center of the lot. 2. The site is zoned Multiple - Family Residential (R -3) which requires 1,500 square feet of lot area per condominium or apartment unit. The proposed subdivision would create 10 condominium units in conformance with the regulations of the R -3 zone. 3. The project site is a flat rectangular- shaped lot. 4. The proposed project will not have a significant, adverse effect on the environment. 5. That there are no exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the vicinity and zone. 6. The proposed variance would not preserve a substantial property right of the applicant enjoyed by other property owners in the vicinity and zone. 7. The proposed variance would be materially detrimental to the public welfare, or injurious to the property or improvements in the zone. 1 I NOW, THEREFORE, BE IT RESOLVED that the City Council hereby denies Variance 91 -4.
