A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EL SEGUNDO OPPOSING THE CURRENT CITY OF
LOS ANGELES BOARD OF AIRPORT COMMISSIONERS'
POLICY OF REQUIRING AVIGATION EASEMENTS OF
PROPERTY OWNERS WHO RECEIVE LOS ANGELES
DEPARTMENT OF AIRPORT FUNDING FOR HOME SOUND
INSULATION.
WHEREAS, the Los Angeles International Airport, after having
moved west of Sepulveda in the 1960's, is located immediately
adjacent to the residential area of the City of E1 Segundo; and
WHEREAS, the noise levels generated in the El Segundo resi-
dential areas are annoying and unhealthful to many E1 Segundo
residents; and
. WHEREAS, approximately 60% of the El Segundo residential
area is located within the 65 dB CNEL contour which is defined by
California Noise Standards to be non - conforming; and
WHEREAS, there are approximately 4500 E1 Segundo residents
living within the 70 dB CNEL noise contour, thereby imposing the
same level of noise impact on these residents as exists in front
of the Tom Bradley Terminal; and
WHEREAS, home sound insulation has proven to be an effective
means of reducing noise impact on receptors of airport noise,
giving residents a greater opportunity for peace within their
homes; and
0 WHEREAS, it has been articulated through Department of
Airport staff that the Board of Airport Commissioners has adopted
a policy whereby it will grant funding for home sound insulation
only upon receiving an avigation easement from the owner of the
property receiving sound insulation; and
WHEREAS, the State Noise Standards provide that a home which
has been treated acoustically so that the interior sound level
does not exceed 45 dB shall be deemed a conforming use within a
65 dB CNEL contour; and
WHEREAS, the City of Los Angeles holds an obligation under
Section 21669 of the California Public Utilities Code and under
the State Noise Standards to work toward the elimination of all
non - conforming uses within the 65 dB CNEL contour created by LAX;
and
is
WHEREAS, the requirement of avigation easements by the Board
of Airport Commissioners is inappropriate because it asks the
property owner to compensate the airport operator for mitigating
the impact created by the operator; and
WHEREAS, the City of E1 Segundo has not previously applied
for Department of Airports funds because of the requirement for
avigation easements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
1. That the City of E1 Segundo is opposed to the Los
Angeles Board of Airport Commissioners requiring that
avigation easements be granted by property owners in
exchange for home sound insulation.
2. That a copy of this resolution be sent to the Los
Angeles Board of Airport Commissioners and all appro-
priate staff members of the Department of Airports.
3. The City of El Segundo would readily apply for funds
from Los Angeles Board of Airport Commissioners or
Department of Airports should this requirement for
avigation easements be lifted.
The City Clerk shall certify to the passage and adoption of
this resolution; shall enter the same in the book of original
resolutions of said city; and shall make a minute of the passage
and adoption thereof in the records of the proceedings of the
City Council of said city, in the minutes of the meeting at which
the same is passed and adopted.
