RESOLUTION NO. 3678
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EL SEGUNDO, CALIFORNIA, ESTABLISHING RATES AND
CHARGES FOR WATER CONSERVATION PROGRAM
ORDINANCE OF SAID CITY.
WHEREAS, Chapter 14.04 of the "E1 Segundo Municipal Code"
fixes, adopts, and establishes the rules and regulations for the
service of water from the waterworks system of the City; and
WHEREAS, Section 14.04.060 of said Chapter 14.04 of the "El
Segundo Municipal Code" authorizes the rates and charges for water
service to be fixed and established by resolution; and
WHEREAS, the City of E1 Segundo adopted on February 19, 1991,
an Ordinance entitled "An Ordinance of the City Council of the City
of E1 Segundo Declaring a Water Shortage Emergency Adopting
Mandatory Water Conservation Regulations and Restrictions and
Declaring the Urgency Thereof" to effect a 20% reduction in water
usage.
WHEREAS, said Ordinance includes the use of three different
water rates to support the Ordinance as follows:
a) Surcharge Water Rate to be applied to water bills of all
non- exempt water customers for the purpose of off- setting
anticipated reduction in water sales revenue needed to
support the Water Utility Fund and to pay the cost of
administering the Conservation Program including for
educational and conservation materials.
b) Incentive (Credit) Water Rate to be applied to the
portion of the customer's water bills of all non - exempt
water customers who reduce their water consumption to a
level below the required 20% below a base year usage for
June 1, 1989 to May 31, 1990, inclusive that is below the
20% reduction level.
C) Penalty Water Rate to be applied to the portion of
customer's water bills of all non - exempt water customers
who do not reduce their water consumption to a level of
20% below a base year usage that is not at or below the
20% reduction level.
WHEREAS, the City Council also is desirous of assuring the
financial and physical viability of the said City Water Utility
System during the effective period of the Mandatory Water
Conservation ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL SEGUNDO,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. ESTABLISHMENT OF WATER RATE SCHEDULE FOR
MANDATORY WATER CONSERVATION PROGRAM.
A. WATER SURCHARGE WATER RATE
For all customers except (1) Lifeline cusomers, (2) those
single family residential and commercial or industrial
business customers who used on the average 15 -100's
cubic feet or less per month (or 42.5 cubic meters) and
(3) those multi - residential customers who used on the
average 13 -100's cubic feet or less per month per
residential unit (or 36.8 cubic meters) in the base year
there shall be applied for the duration of this program
an additional rate of:
Per - 100 cubic feet - $0.1018
Per - 1 cubic meter - $0.0357

B. INCENTIVE (CREDIT) FOR CONSERVING MORE THAN THE GOAL OF
20%
For all customers except (1) Lifeline customers, (2)
those single family residential and commercial or
industrial business customers who used on the average 15
-100's cubic feet or less per month (or 42.5 cubic
meters) and (3) those multi - residential customers who
used on the average 13 -loo's cubic feet or less per
month per residential unit (or 36.8 cubic meters) in the
base year whose usage is less than 80% of the base year
allowance for their account there shall be an allowed
credit for the portion of their consumption under their
conservation goal of:
Per - 100 cubic foot - $0.2045
Per - 1 cubic foot - $0.0722
C. PENALTY FOR NOT MEETING THE CONSERVATION GOAL OF 20%
For all customers except (1) Lifeline customers, (2)
those single family residential and commercial or
industrial business customers who used on the average 15
-100's cubic feet or less per month (or 42.5 cubic
meters) and (3) those multi - residential customers who
used on the average 13 - 100's cubic feet or less per
month per residential unit (or 36.8 cubic meters) in the
base year whose usage is in excess of the 80% of the base
year allowance there shall be added a penalty for the
portion of their consumption not meeting their
conservation goal of:
Per - 100 cubic feet - $0.9950
Per - 1 cubic meter - $0.3514
SECTION 2. CERTIFICATION. The City Clerk shall
certify to the passage and adoption of this resolution; shall enter
the same in the book of original resolutions of said City; and
shall make a minute of the passage and adoption thereof in the
records of the proceedings of the City Council of said City, in the
minutes of the meeting at which the same is passed and adopted.

RESOLUTION NO. 3678 was duly passed and adopted by the said City
Council, approved and signed by the Mayor or said City, and attested by
the City Clerk of said City, all at a regular meeting of the said Council held
on the 5rd day of March, 1991, and the same was so passed and adopted
by the following vote:
