CC RESOLUTION 3631RESOLUTION NO. 3631 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL • SEGUNDO, CALIFORNIA, APPROVING UNCLASSIFIED USE PERMIT UUP 89 -1, AND ADOPTION OF THE NEGATIVE DECLARATION OF ENVIRONMENTAL ASSESSMENT EA -210 TO PERMIT A DOG /CAT KENNEL LOCATED AT 235 EAST FRANKLIN AVENUE. APPLICANTS: JACK BALDELLI AND DAVID NIELSEN. WHEREAS, an application has been received from Jack Baldelli and David Nielsen, 1401 Sepulveda Boulevard, Manhattan Beach, California, to permit a Dog /Cat Kennel at 235 East Franklin Avenue; and WHEREAS, the City Council did hold, pursuant to law, a duly advertised public hearing on such matter in the Council Chamber of the City Hall, 350 Main Street, in the City of El Segundo on April 3, 1990, and notice of said hearing was given in the time, form and manner prescribed by law; and WHEREAS, on March 22, 1990 the Planning Commission did adopt Resolution No. 2267 recommending to the City Council adoption of a Negative Declaration and approval of Unclassified Use Permit UUP 89 -1; and WHEREAS, opportunity was given to all persons to present testimony or • documentary evidence for or against proposed Unclassified Use Permit UUP 89 -1, Environmental Assessment EA -210; and WHEREAS, the City Council has reviewed the Initial Study and supporting evidence in accordance with the authority and criteria contained in the California Environmental Quality Act, State Guidelines and the City of El Segundo Guidelines for the implementation of the California Environmental Quality Act (Resolution No. 3517); and WHEREAS, at said hearing the following facts were established: 1. The subject property is zoned SB (Small Business) district in the Smoky Hollow Specific Plan. 2. The City Council has determined that the proposed use is accessory to the primary use and that additional parking is not required. 3. The Fire Department has determined that the kennel is similar to a multiple family occupancy and that fire life safety is in jeopardy due to the number of boarders. • SECTION 1. That after considering the above facts and findings the City Council adopts the following actions and conditions: 1. The portion of the building to be used for boarding purposes shall be soundproofed, entirely to the satisfaction of the Building /Safety and Planning Division. 2. An attendant shall be on duty 24 hours a day, 7 -days a week. 3. Daily hours of operation shall be limited to 7:00 AM to 8:00 PM. 4. In order to evaluate any changes in use or parking requirements, the Unclassified Use Permit shall be reviewed by the Planning Commission every two years. The fee for the review shall be paid for by the applicant. The review application shall include an average daily customer count at the time of review. 5. Animals allowed to occupy the boarding facility will be limited to domestic dogs and cats only. At no time will the facility keep, maintain, have in its possession, or under its control any poisonous or venomous snake or any wild, carnivorous animal. (ESMC 8.02.030) a6. Water runoff from washing the cages and floors of the facility shall not be allowed to discharge onto the public right -of -way. Water runoff shall be collected on site and conveyed to a proper plumbing fixture which is connected to the sanitary sewer system. 7. Applicant shall contact the Los Angeles County Department of Public Works regarding industrial waste discharge and permit requirements. • 8. Entry doors shall have protective plates over the deadbolts to prevent forced entry. 9. A security lighting plan for the building shall be approved by the Planning Manager prior to the issuance of a Certificate of Occupancy. 10. An automatic fire sprinkler system shall be installed prior to the issuance of a Certificate of Occupancy. 11. Should the Animal Hospital terminate their operations, the Kennel shall be required to provide parking as determined by the Planning Commission. SECTION 2.That according to the El Segundo Municipal Code, the site plan granted by the City Council becomes null and void if not exercised within one year from the date of this Resolution. SECTION 3. The City Clerk shall certify to the passage and adoption of this resolution, shall enter the same in the book of original resolutions of said City, and shall make a minute of the passage and adoption thereof in the record of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
